Hi Linda. The material issue, based on the information you've provided, appears to be if the 3rd party purchaser is bona fide. In other words, was the 3rd party aware that the car he's buying for valid consideration has another owner. In such an event, it may be unlikely that the 3rd party would have to return the car to Sam as there would be no way of compensating the bona fide 3rd party for the loss he would suffer monetarily since the seller has fled.
