    Today I'm at Worksop Galvanising, A large galvanising plant on the Claylands Estate in Worksop.
    While videoing I was told that the road I was on was a private road, but it's been adopted by the council, I have never come across a road that has been adopted by the council and it's still a private road, it's deffo a new one on me.

    "An adopted road is a road that is maintained at public expense. Road adoption is a term used to describe the council taking ownership of a 'private street'."

    • @collincovid6950
      @collincovid6950 3 года назад +1

      Correct. Been a party to a private road that was not adopted by the local council, and so saved them money to waste elsewhere. As you rightly point out there is a distinction

    • @MarkPercival
      @MarkPercival 3 года назад +2

      @@collincovid6950 The distinction is that roads which meet the minimun dft standards can be adopted, those that don't will not get adopted because they will cost the public purse money - it has nothing to do with saving them money but to do with gaurding the pubic purse. After all, it's you and me that has to pay in the end!

    99.9999999% sure that they do not pay for repairs. The whole point of an adopted road is that the council takes over the maintenance.

      Spot on. The worker wants it both ways. Council to pay for repairs but to him it’s private. Planks at their best.

    It's an adopted road. Meaning that the council will have made those businesses pay to bring the road up to standard before they would adopt it. The Council pays for the roads maintenance, although may well then charge these businesses for repairs if they are proved to have damaged the road. However as you said it becomes public once adopted and you are entitled to be on it.

    County Councils keep a Statutory list of 'highways maintainable at public expense' if the road Is on this list it is Not Private.

  • @danielgardecki1046

    Mine and my neighbours private (roughly 100 metre) mud "road" gets routinely damaged by one neighbour specifically, as he drives down it like a maniac at 20+ mph in a very tall White van.
    One day he'll probably hit one of my next door neighbours crazy inbred kids.
    Therefore every so often, I have to fill in the potholes on our stretch of the road with anything I can find, which includes:
    Broken bricks, broken stones, pebbles, gravel, sand etc.

  • @simshogun2240
    @simshogun2240 2 года назад +1

    Agreements are reached between councils and companies and if a company gives the road a lot of wear, or excessive wear their business rates will rise dramatically, to get around this many companies agree to maintain a road at their expense to avoid the much higher business rates, its still a public road but with a codicil attached meaning the company pays to maintain it.

    No such as an adopted 'private' road. See the following.
    Adopted highway
    An adopted highway is a highway that was privately-owned road, but has becomes a public road, managed and maintained by the highway authority (typically the local authority). They can also be referred to as a 'maintained highway'.
    Section 38 of the Highways Act 1980 provides that when planning consent has been granted for a new development, developers may ask the highway authority to ‘adopt’ new roads that have been constructed as part of the development, along with associated infrastructure such as drains, lighting and supporting structures.
    The conditions of a highway being adopted include:
    There being a direct link with the existing public highway network.
    It being of sufficient use for the public (i.e. having a wider use than just access to residential or commercial properties)
    It being open to the public at all times, and so on.
    It being constructed to a suitable standard.
    There will be a fee associated with adoption, covering the cost of; checking designs, preparing the agreement, inspecting the works, and ongoing maintenance of items not essential for highway purposes (commuted sums). There may also be a requirement for a bond from the developer to cover the highway authority against the possibility that the developer fails to properly complete the works, for example if they become insolvent.
    For more information see: Section 38 agreement.
