Squatters laws vary from state-to-state in the US. Where I live, a squatter can't just take over a property registered to another owner, lessee, or renter. Adverse possession doesn't apply in Massachusetts, so squatters would be immediately arrested for breaking and entering and trespassing. Regarding abandoned property, it would belong to the bank if it was foreclosed on, and the bank would have squatters arrested. The law should be the same nationwide, in my opinion... but each state has its own guidelines, and operates differently.
I heard of a homeless man that moved into an historic home that had been abandoned for over 10 years. It was basically in ruins. He was a handyman by trade before he became homeless. Not only did he restore the house, but he did it to historical period. He also started a business in his community and the neighbors were tickled for what he did for the property. He saved the property and was trying to buy (land value) it from the bank that abandoned it. Too bad all squatters can't be this way. I feel that abandoned properties with no real hope of selling in rough condition should be offered to capable people rent free if they can do a care taker service for the property for however long it takes to do it plus a few years after that.

Again, this was rare because he had a love for structures like this, but if something like this were offered to people WHO KNOW HOW, not just a squatter, it would be a good thing for that person and the community.
I was renting a house to my son in-laws brother who I never met until he came and signed a rental agreement. Always late on rent when he did pay, I lowered the rent so he could possibly afford it but no payment. Finally he was arrested for spouse abuse. Lucky for me I didn't have to evict him. Then I heard he was telling people I abandoned my house, so I assume he was trying to take my house....funny. This was about 2 years ago. And the lowlife is still in prison....well he don't have to pay rent now.. We all pay his rent now, the piece of shit..
the purpose of the law is to prevent banks from repo'ing a house and letting it sit dormant. its far better to have an occupant than waste a perfectly livable property.
Adverse possession laws go back to Henry VIII. They are designed to put unproductive land back into production. Back in Henry's day, it was big landowners who held huge areas of fertile farmland but did not do anything with it except hunt deer. That law came to the US and at the time of the Revolution and the US Constitutional government, the states all had the same law. There are abandoned properties and adverse possession is used by many people to get possession of them. You have to live on the property, pay the taxes, and publicly claim ownership for a specific period of time. The problem here is that these properties are not abandoned and have owners who have to go to court and eject the squatters. In fact, depending on the state you are in, you can often simply call the police and have them come out and remove the squatters. If you listened to the actual television report you would know that people trying this often in up with criminal charges filed against them.
Here in Canada this law came into effect in the early days of settlement because the wealthy were buying up and hoarding thousands of acres but not settling and interfering with development. This I learned from researching the Black Donnelley's story.

Apparently the people who responded to you don't know how to read because these squatters don't just move into homes that have been foreclosed on by the banks. There are cases where people who own the homes have it on the market. And for whatever reason they aren't living in the house. Either they are living in their new home waiting for the old one to be sold. Or they had to move to another state before the home was sold. And some squatter comes along and moves in.

I am for this in detroit.it actually helps the neighborhood in many cases.because a lot of squatters are families who have fallen on hard times.they keep these houses maintained do work in them and Keep them from being vandalized or turned into trapp houses.In fact lots of times neighbors are relieved in some cases.
Squatters were big news in NYC, my hometown, back in the 80s. Loots of buildings were abandoned in the East Village, then considered an undesirable neighborhood. People moved in , somehow provided electricity and running water and generally improved the buildings. It couldn't last, of course. The owners of record (if memory serves, the city itself, in most cases) had the squatters removed, sometimes violently. The properties currently go for some of the highest rentals in the city, which is saying something.

I brought my 83 yr old mom to live with me after the hurricane from 2017 and the house is deteriorating. If the land behind the house isn't fixed, next hurricane it'll go down that 20 foot ravine. Theres a little stream back there that grows exponentially whenever there are torrential rains and it took away about 10 feet of her yard for Marie. I had it surveyed and fixing it with a retention wall will cost over $15k. Plus the earthquakes have broken and loosened up tiles in kitchen and bathroom. I'm already paying to keep the lawn cut on a monthly basis, but I'm afraid of investing anymore money to keep it up for fear of losing what I put into it. That's my retirement fund. Why not do like I do. Put a ADT alarm on your property. When these squatters try to move in and trip the alarm the Police will sent out to the property and when the squatters cannot provide the correct password to the ADT alarm company off to jail they go for Felony Burglary. Last count for me as of this year 38 squatters arrested and jailed. Much cheaper than going to court to get them out and no property damage...

What's better is, you pick a expensive house in California. They only require you stay in the house for 5 years before you can get ownership. Then once you have the title to the house, you can put it on the market. Easy and quick way to make quite a large amount of money.
This happened to a friend of mine .... We put cameras on the property,waited until he left,changed all the locks ......and waited until he returned....he then called the police... While he was gone we took all his belongings and put them in the garage.....staged all room as we had " rented" them to some females "while back"..we had toothbrushes , boxes of tampons ,shoes ,underware all over the place... When the police and this jackass came to the door we said" When we came back to the residence we notice some idems in the house and put them in the garage( TV etc.) We told the police( sorry about the lies but had to do what we had to do) "All the rooms, 3 bedrooms have been rented out... We do not know who this indevidual is but we did put some stuff in the garage if he wants them ,he can have them"... The police did come inside the residence ,checked the rooms and Lord behold all the rooms looked like " other ppl were living in them"..... worked for us ... On the way out the squatter looked back and said" Didnt think of this trick before". Law will not work in these cases sorry to say that.
Exactly... if you’re going to become a squatter you must pay the property taxes and also file at the local courthouse when you start paying property taxes on a house you are legally the owner. Most bank don’t pay the property taxes when the home is off the market. If your going to be a squatter take picture of the home inside and out. Change the locks keep all receipts of all home-improvement that you’ve done to the house and also pay the property tax. You can know charge the bank for double for the money you spent to up keep the property.... I’ve seen this done servers times....
What's also ridiculous is the bank will foreclose the house because they have trouble making the mortgage due to various circumstances, but are still able to pay some of it. Instead of working out a plan with the owners, they let the house sit there for months. When squatters see no activity in the house they move right in and claim it. Banks need to be held accountable.

If these laws where even easier, as it used to be, unemployment and poverty would be near non-existent. If somebody owns it, the law protects his interest. So, adverse possession is not taking property away from an owner. The process can take 5 to 10 years, leaving plenty of ample time for an owner to come forward. The process involves the courts and must be completely in the open for all to see. Funny, how people engaging in a legal process are labeled terrorists. Sure, the neighbors are angry, because they couldn't figure out how to get their house for next to nothing. Denying adverse possession in most cases will end up to benefit the 1%, as their lawers will use different methods of deriving ownership rights from bounced credit swap deals that paid out insurance when the deal went sour. Law was made back in the days when people moved out and abandoned their home or were killed. The new settlers came in and took it over. It wasn't meant for any empty house, especially in this century.
My dad had a nightmare renter. Guy was a good tenant until he lost his job. My dad was extremely reasonable and let him stay for a long time, but as always sooner or later people will take advantage of your kindness. My dad went over to collect rent and saw a brand new car in the driveway but of course the guy had no money for rent. Took over a year to evict him and when they finally did evict him he trashed the place. Some people are just trash. I will never be a landlord, it's just not worth it. There are easier ways to make a buck.

This adverse possession business is a crime, it's squatting, and needs to be treated as such. In order to apply for adverse possession tehy need to be living in the house for 7-10 years (some states as high as 20 years). So really, how are you owning a property that you've never checked up on in 7 years?

We live in one of the best countries in the world (USA). My neighbor is from Romania and his wife was born in China. They both say that living here is a blessing and most Americans have no idea how good they have it. We can't be completely free to do what we want because what we do affects those around us. If there were no law about loud music my other neighbor could blast his music day and night. I'd probably have to creep over there in the middle of the night and kill him (well, not really, but maybe I'd steal all his radio equipment). That's why there's laws that some of us aren't happy about. We need the laws to help keep the peace.

I know someone who came back from vacation and found someone in their home who abandoned so they claimed that it was their home for this reason. Not all homes that are empty of people are abandoned. It took them months to get these people out and in that time period they had sold some of their personal items. They got them for steeling but could not replace what could not what they sold. They are only taking part of the law not all. There is more to that law than they are claiming.
This happens all the time but now these criminals are using what's called quit deed scams to steal people's homes while they are still living in them. People my age, I'm 25, don't want to work for anything and think they are entitled to free homes. I'm embarrassed.
I think the State should have to pay people for not protecting their home and allowing squatters in their home while they are on vacation. The State should have to pay for what they stold if they was going to let them steal somebody's home.

This can be a real problem slowing the wheels of "justice" in these matters. I've had to deal with something like this once before and it was a long drawn out process to get them to move on.
I would much rather see a homeless, houseless person living in one of these ABANDONED homes for free than to see them go to rot. I read a story not to long ago about a neighborhood who went after the banks that had foreclosed on several houses on their street. They filed suit against the bank because they would not keep the properties up and the houses were in such disrepair that it was driving the price of the occupied homes down. The bank came back and claimed that they did not really "own" the houses and used some loophole to get out of maintaining the houses. Needless to say, they law is only there to protect the banks and they have a way of getting out of their responsibility to maintain the houses they are foreclosing on. I see so many houses empty and falling apart these days, wouldn't it be better to let someone live there for free just to keep the property from rotting away? Sounds like a good plan to me! We live in one of the richest nations in the world and there is no reason why millions of families should be without homes while good homes rot.
I had to foreclose on my house back in April of this year. Sucks, but given the situation I really had zero choice in the matter. After I left in April to me typing this right now the bank has done absolutely nothing with the house. When I walked out it was in 8.5/10 condition and worth 75k. I still talk to my old neighbor and he said the house is now one step from needing to be bulldozed. Vagrants keep trying to squat there and or strip any and everything out of it. An entire section of the back roof completely collapsed in. Guessing it sprung a minor leak and after half a year of leaking the entire roof rotted away and smashed in. When it rains hard he said you can see water flooding out from under the front door, so the entire house is a lake inside when it rains. It's an entire eye sore to the neighborhood and is drawing crackheads and hookers to their street. Their cars are getting broke into, one guy's utility shed got cleared out. No doubt the house has taken 20-25k off the value of every house in the street. It's now just worth the lot minus the cost to bulldoze the house, so pretty much worth $5000 at most.

If they get paid for the house by their insurance then the house should be free to anyone willing to just purchase the title. It is a shame to let a house waste away while a family goes homeless. I hope things get better for you and I am so sorry to hear about your house. The lending companies should be responsible for the upkeep of these houses but they have a loop hole that they use in order to get out of the responsibility! Find that loop hole and take your house back!

I had no where else to go, I was newly disabled and hadn't applied for social security. So I had no income. It is only through God's grace and mercy that I didn't suffer a mental breakdown. Sadly, my stepmom's passed,I forgive her. I now help her daughter and son financially or emotionally at times. I'm really enjoying being a surrogate gramma to her 2, grandsons the youngest is disabled but a real sweet boy, who I love and have a close bond with. The older is a teenager, so he's too grown for auntie. God is definitely, good.

My parents beach house in California had a squatter and we live in Texas so we only go there twice a year sometimes and he was saying he owned the house it was nasty we chokehold him and kicked his ass it was a huge issue but after court and all he was found guilty

Did you watch the entire thing? They all got kicked out and arrested. And the law says you have to live there for years. The owners can kick you out at any point though. You only get the land if the owners fail to act for 10+ years. So no, you can't just get the land that easily. It takes years. You may get a couple months free rent but then you'll most likely end up in jail. So you decide. Is jail worth saving a couple months rent?

And also not having new econonic reform such as an option to have an extention of the loan to the owners children, the monent they are old enough to work. This would reduce the pressure of time limitation, plus, lets say if it was for a 25 year mortgage for $400,000 house at 2.5 interest per annum, the interest would be a total of $250,000 but the monthly repayment would be $2,167. However, if it was a 40 year mortgage, the interest would be $400,000 but it would be $1,667 a month. $500 a month is a huge difference. In most Asian countries, we do this. That is why a lot of smart youths still stay with their parents, they help to finish off a 40-50 year old home loan. And then the grandchildren would not to spend a lot of money on a new home loan but to just loan for home improvement or making the house bigger. That is why the economies of most Asian countries are rising since getting independence from Western countries between the 1950-1980s.
I have watched a lot of these beautiful homes on youtube laying empty and rotting away many I understand from what I have read are owned by the bank. Yes you can. Easy way to make a large amount of money. California would be the fastest way. You only need to stay there for 5 years before you get the title to the house. I live in Seattle, been squatting in a place now for almost 2 years. I'm a holdover though, the lease ended but I stayed. I haven't been bothered or anything, and I'm pretty comfortable here. Squatters are such a national epidemic that I see a huge money-making opportunity for hiring offsite property managers. They only need to live in the area so can swing by any time, change the locks, and be enough of a presence to deter anyone from moving in (or staying there). Banks own so many abandoned properties, it makes no sense that they don't at least hire someone to protect the ones in the better neighborhoods. For an absent property owner, what options are there to protect their empty property? Hire a full time house sitter ? (Not cheap). I don't know if the offsite property manager business model exists, but seems to me there's a huge demand for this kind of service.

This is horrendous that a squatter can move in and after a certain amount of time be able to claim they are now a tenant and tge homeowner loses all their rights and is subjected to court processes of eviction and those costs!! What about deleting that "obscure law" ? What I can live with is that if houses are empty more than a certain period, for ex. 3 years, that the owner can choose two options: either pay a high tax on this empty house or step to a to be created organisation, that selects homeless people based on a number of criteria who can move in for a certain period, say, until they found a house to rent. That organisation is then responsible to keep track of the efforts that the temporary occupants do, or even, to propose the temporary occupants such an option. The temporary occupants can only refuse 2 times such an offer. And of course, the rightful owner of the house can claim its property back in the same way as he or she can, should he have rented the house. Of course, there's one remaning problem, what if the temporary owners steal things out of that house (marble etc.) or degrade it, change it to their liking etc.
Adverse possession means the house has to be actually empty for a certain timeframe before a person can move in & take it over. There are more details to adverse possession & these people are interpreting these rights in a way that is quite plainly taking advantage of the meaning to adverse possession rights.

Foreclosed or not it is not a free house the bank still owns it. The only way it works is if it was a paid off property the owner abandons or dies with no heir. Then someone moves in then pays all owed property taxes lives there for 7 years and there is no other claim on it.
Ok these are over the top examples but there are legit people doing this in places like Detroit where homes are abandoned. Usually you go into a less than perfect house and start investing to fix it up. You are adding to the community and there is not really an owner to being with...at least not trackable. But dudes do it on a house that nobody cares about!

Squatters laws vary from state-to-state in the US. Where I live, a squatter can't just take over a property registered to another owner, lessee, or renter. Adverse possession doesn't apply in Massachusetts, so squatters would be immediately arrested for breaking and entering and trespassing. Regarding abandoned property, it would belong to the bank if it was foreclosed on, and the bank would have squatters arrested. The law should be the same nationwide, in my opinion... but each state has its own guidelines, and operates differently.

I heard of a homeless man that moved into an historic home that had been abandoned for over 10 years. It was basically in ruins. He was a handyman by trade before he became homeless. Not only did he restore the house, but he did it to historical period. He also started a business in his community and the neighbors were tickled for what he did for the property. He saved the property and was trying to buy (land value) it from the bank that abandoned it. Too bad all squatters can't be this way. I feel that abandoned properties with no real hope of selling in rough condition should be offered to capable people rent free if they can do a care taker service for the property for however long it takes to do it plus a few years after that.

I was renting a house to my son in-laws brother who I never met until he came and signed a rental agreement. Always late on rent when he did pay, I lowered the rent so he could possibly afford it but no payment. Finally he was arrested for spouse abuse. Lucky for me I didn't have to evict him. Then I heard he was telling people I abandoned my house, so I assume he was trying to take my house....funny. This was about 2 years ago. And the lowlife is still in prison....well he don't have to pay rent now.. We all pay his rent now, the piece of shit..

Adverse possession laws go back to Henry VIII. They are designed to put unproductive land back into production. Back in Henry's day, it was big landowners who held huge areas of fertile farmland but did not do anything with it except hunt deer. That law came to the US and at the time of the Revolution and the US Constitutional government, the states all had the same law. There are abandoned properties and adverse possession is used by many people to get possession of them. You have to live on the property, pay the taxes, and publicly claim ownership for a specific period of time. The problem here is that these properties are not abandoned and have owners who have to go to court and eject the squatters. In fact, depending on the state you are in, you can often simply call the police and have them come out and remove the squatters. If you listened to the actual television report you would know that people trying this often in up with criminal charges filed against them.

Apparently the people who responded to you don't know how to read because these squatters don't just move into homes that have been foreclosed on by the banks. There are cases where people who own the homes have it on the market. And for whatever reason they aren't living in the house. Either they are living in their new home waiting for the old one to be sold. Or they had to move to another state before the home was sold. And some squatter comes along and moves in.

I am for this in detroit.it actually helps the neighborhood in many cases.because a lot of squatters are families who have fallen on hard times.they keep these houses maintained do work in them and Keep them from being vandalized or turned into trapp houses.In fact lots of times neighbors are relieved in some cases.

Squatters were big news in NYC, my hometown, back in the 80s. Loots of buildings were abandoned in the East Village, then considered an undesirable neighborhood. People moved in , somehow provided electricity and running water and generally improved the buildings. It couldn't last, of course. The owners of record (if memory serves, the city itself, in most cases) had the squatters removed, sometimes violently. The properties currently go for some of the highest rentals in the city, which is saying something.

I brought my 83 yr old mom to live with me after the hurricane from 2017 and the house is deteriorating. If the land behind the house isn't fixed, next hurricane it'll go down that 20 foot ravine. Theres a little stream back there that grows exponentially whenever there are torrential rains and it took away about 10 feet of her yard for Marie. I had it surveyed and fixing it with a retention wall will cost over $15k. Plus the earthquakes have broken and loosened up tiles in kitchen and bathroom. I'm already paying to keep the lawn cut on a monthly basis, but I'm afraid of investing anymore money to keep it up for fear of losing what I put into it. That's my retirement fund. When these squatters try to move in and trip the alarm the Police will sent out to the property and when the squatters cannot provide the correct password to the ADT alarm company off to jail they go for Felony Burglary. Last count for me as of this year 38 squatters arrested and jailed. Much cheaper than going to court to get them out and no property damage...

We put cameras on the property,waited until he left,changed all the locks ......and waited until he returned....he then called the police...
While he was gone we took all his belongings and put them in the garage.....staged all room as we had " rented" them to some females "while back"..we had toothbrushes , boxes of tampons ,shoes ,underware all over the place...
When the police and this jackass came to the door we said" When we came back to the residence we notice some idems in the house and put them in the garage( TV etc.)
We told the police( sorry about the lies but had to do what we had to do)
"All the rooms, 3 bedrooms have been rented out...
We do not know who this indevidual is but we did put some stuff in the garage if he wants them ,he can have them"...
The police did come inside the residence ,checked the rooms and Lord behold all the rooms looked like " other ppl were living in them"..... worked for us ...

Exactly... if you’re going to become a squatter you must pay the property taxes and also file at the local courthouse when you start paying property taxes on a house you are legally the owner. Most bank don’t pay the property taxes when the home is off the market. If your going to be a squatter take picture of the home inside and out. Change the locks keep all receipts of all home-improvement that you’ve done to the house and also pay the property tax. You can know charge the bank for double for the money you spent to up keep the property.... I’ve seen this done servers times....
What's also ridiculous is the bank will foreclose the house because they have trouble making the mortgage due to various circumstances, but are still able to pay some of it. Instead of working out a plan with the owners, they let the house sit there for months. When squatters see no activity in the house they move right in and claim it. Banks need to be held accountable.
30% of all houses are empty. Adverse Possession has a very practical purpose. Why else would there be laws that provide a legal process for that? If these laws where even easier, as it used to be, unemployment and poverty would be near non-existent. If somebody owns it, the law protects his interest.
So, adverse possession is not taking property away from an owner. The process can take 5 to 10 years, leaving plenty of ample time for an owner to come forward. The process involves the courts and must be completely in the open for all to see. Funny, how people engaging in a legal process are labeled terrorists. Sure, the neighbors are angry, because they couldn't figure out how to get their house for next to nothing.
Benefits for society:
Property has to be maintained => nicer neighborhood, keeps resale values up
Property taxes have to be paid => teachers get paid
Property owners spend more money => improves local economy
Registered resident => more government funding for the community
Property returns into circulation => increases spendable cash in the economy, instead of becoming a permanent sour
Adverse possession prevents squandering => avoids the negative effect of the above, plus prevents crime from moving into a neighborhood
Just because it is a nearly forgotten provision in the law doesn't make it a bad idea. The early settler used a similar process to claim land much the same way. That was one of the major drivers for prosperity.
How different would our economy look like if a few million people could transition from homelessness, subsidized housing, rent into owned homes. Does that sound like jobs, economic boost, reversal of depopulation of rural communities. Makes a lot of sense to me.
Denying adverse possession in most cases will end up to benefit the 1%, as their lawers will use different methods of deriving ownership rights from bounced credit swap deals that paid out insurance when the deal went sour.

Law was made back in the days when people moved out and abandoned their home or were killed. The new settlers came in and took it over. It wasn't meant for any empty house, especially in this century.
My dad had a nightmare renter. Guy was a good tenant until he lost his job. My dad was extremely reasonable and let him stay for a long time, but as always sooner or later people will take advantage of your kindness. My dad went over to collect rent and saw a brand new car in the driveway but of course the guy had no money for rent. Took over a year to evict him and when they finally did evict him he trashed the place. Some people are just trash. I will never be a landlord, it's just not worth it. There are easier ways to make a buck.

This adverse possession business is a crime, it's squatting, and needs to be treated as such. Squatters are criminals, and crimes like squatting (trespassing, breaking an entry, unlawful entry) need to be punishable, not rewardable. IMHO anyone squatting in a house should be forcibly removed and confined to jail.
In order to apply for adverse possession tehy need to be living in the house for 7-10 years (some states as high as 20 years). So really, how are you owning a property that you've never checked up on in 7 years?

We live in one of the best countries in the world (USA). My neighbor is from Romania and his wife was born in China. They both say that living here is a blessing and most Americans have no idea how good they have it. We can't be completely free to do what we want because what we do affects those around us. If there were no law about loud music my other neighbor could blast his music day and night. I'd probably have to creep over there in the middle of the night and kill him (well, not really, but maybe I'd steal all his radio equipment). That's why there's laws that some of us aren't happy about. We need the laws to help keep the peace.

I know someone who came back from vacation and found someone in their home who abandoned so they claimed that it was their home for this reason. Not all homes that are empty of people are abandoned. It took them months to get these people out and in that time period they had sold some of their personal items. They got them for steeling but could not replace what could not what they sold. They are only taking part of the law not all. There is more to that law than they are claiming.

This happens all the time but now these criminals are using what's called quit deed scams to steal people's homes while they are still living in them. People my age, I'm 25, don't want to work for anything and think they are entitled to free homes. I'm embarrassed.

This can be a real problem slowing the wheels of "justice" in these matters. I've had to deal with something like this once before and it was a long drawn out process to get them to move on.
I would much rather see a homeless, houseless person living in one of these ABANDONED homes for free than to see them go to rot. I read a story not to long ago about a neighborhood who went after the banks that had foreclosed on several houses on their street. They filed suit against the bank because they would not keep the properties up and the houses were in such disrepair that it was driving the price of the occupied homes down. The bank came back and claimed that they did not really "own" the houses and used some loophole to get out of maintaining the houses. Needless to say, they law is only there to protect the banks and they have a way of getting out of their responsibility to maintain the houses they are foreclosing on. I see so many houses empty and falling apart these days, wouldn't it be better to let someone live there for free just to keep the property from rotting away? Sounds like a good plan to me! We live in one of the richest nations in the world and there is no reason why millions of families should be without homes while good homes rot.
I had to foreclose on my house back in April of this year. Sucks, but given the situation I really had zero choice in the matter.
After I left in April to me typing this right now the bank has done absolutely nothing with the house. When I walked out it was in 8.5/10 condition and worth 75k. I still talk to my old neighbor and he said the house is now one step from needing to be bulldozed.
Vagrants keep trying to squat there and or strip any and everything out of it. An entire section of the back roof completely collapsed in. Guessing it sprung a minor leak and after half a year of leaking the entire roof rotted away and smashed in. When it rains hard he said you can see water flooding out from under the front door, so the entire house is a lake inside when it rains.
It's an entire eye sore to the neighborhood and is drawing crackheads and hookers to their street. Their cars are getting broke into, one guy's utility shed got cleared out. No doubt the house has taken 20-25k off the value of every house in the street.
It's now just worth the lot minus the cost to bulldoze the house, so pretty much worth $5000 at most.

If they get paid for the house by their insurance then the house should be free to anyone willing to just purchase the title. It is a shame to let a house waste away while a family goes homeless. I hope things get better for you and I am so sorry to hear about your house. The lending companies should be responsible for the upkeep of these houses but they have a loop hole that they use in order to get out of the responsibility! Find that loop hole and take your house back!

Sadly, my stepmom's passed,I forgive her. I now help her daughter and son financially or emotionally at times. So no, you can't just get the land that easily. It takes years. You may get a couple months free rent but then you'll most likely end up in jail. So you decide. Is jail worth saving a couple months rent?

And also not having new econonic reform such as an option to have an extention of the loan to the owners children, the monent they are old enough to work. This would reduce the pressure of time limitation, plus, lets say if it was for a 25 year mortgage for $400,000 house at 2.5 interest per annum, the interest would be a total of $250,000 but the monthly repayment would be $2,167. However, if it was a 40 year mortgage, the interest would be $400,000 but it would be $1,667 a month. $500 a month is a huge difference. In most Asian countries, we do this. That is why a lot of smart youths still stay with their parents, they help to finish off a 40-50 year old home loan. And then the grandchildren would not to spend a lot of money on a new home loan but to just loan for home improvement or making the house bigger. That is why the economies of most Asian countries are rising since getting independence from Western countries between the 1950-1980s.

I have watched a lot of these beautiful homes on youtube laying empty and rotting away many I understand from what I have read are owned by the bank. Yes you can. Easy way to make a large amount of money. California would be the fastest way. You only need to stay there for 5 years before you get the title to the house. I live in Seattle, been squatting in a place now for almost 2 years. I'm a holdover though, the lease ended but I stayed. I haven't been bothered or anything, and I'm pretty comfortable here. I already consider it my house.

Squatters are such a national epidemic that I see a huge money-making opportunity for hiring offsite property managers. They only need to live in the area so can swing by any time, change the locks, and be enough of a presence to deter anyone from moving in (or staying there). Banks own so many abandoned properties, it makes no sense that they don't at least hire someone to protect the ones in the better neighborhoods. For an absent property owner, what options are there to protect their empty property? Hire a full time house sitter ? (Not cheap). I don't know if the offsite property manager business model exists, but seems to me there's a huge demand for this kind of service.

What about deleting that "obscure law" ? What I can live with is that if houses are empty more than a certain period, for ex. 3 years, that the owner can choose two options: either pay a high tax on this empty house or step to a to be created organisation, that selects homeless people based on a number of criteria who can move in for a certain period, say, until they found a house to rent. That organisation is then responsible to keep track of the efforts that the temporary occupants do, or even, to propose the temporary occupants such an option. The temporary occupants can only refuse 2 times such an offer. And of course, the rightful owner of the house can claim its property back in the same way as he or she can, should he have rented the house. Of course, there's one remaning problem, what if the temporary owners steal things out of that house (marble etc.) or degrade it, change it to their liking etc.

Adverse possession means the house has to be actually empty for a certain timeframe before a person can move in & take it over. There are more details to adverse possession & these people are interpreting these rights in a way that is quite plainly taking advantage of the meaning to adverse possession rights.

Foreclosed or not it is not a free house the bank still owns it. The only way it works is if it was a paid off property the owner abandons or dies with no heir. Then someone moves in then pays all owed property taxes lives there for 7 years and there is no other claim on it.

Ok these are over the top examples but there are legit people doing this in places like Detroit where homes are abandoned. Usually you go into a less than perfect house and start investing to fix it up. You are adding to the community and there is not really an owner to being with...at least not trackable. To claim adverse possession and do it legally, not the bullshit way some squatters attempt to do, but that the people @jessica is referring to do it (from the sounds of it) you do in fact pay the taxes on the abandoned property. The law actually categorizes improvements and to be considered an improvement it has to be something the "everyman" would consider an overall improvement to the property.
IE: Landscaping, fixing of holes in house, renovating the house, fixing roof, etc.
A person who does adverse possession legally, and the right way, is not in the wrong, because it is 100% legal the way they do it if the do it actual, open and notorious, exclusive, adverse, and continuous.
What this means is that they have to continually improve on the property, have no contest to ownership of the property for a continuous amount of time, not hide their living on the property, and must pay taxes on the property, and in most states, must do so for 7+ years.
An abandoned house brings property values down for the entire neighborhood, and if a bank who forecloses on a home, and leaves it sitting for more than 7 years, not contesting the ownership of the property, it is better suited to the adverse possessee`. Because their improvements on the house, and keeping the house maintained, will provide economic growth for everyone in the neighborhood in the form of higher property values due to not living near a decrepit house.
