They were. I understand that kids will be kids, and they can get rowdy, especially when unsupervised, but their ID should not have been taken unless a parent or guardian was present. Kids don't know their rights, mom and/or dad might.

It is not the full video of the event so it can be twisted either way. Did the manager ask these kids to leave and warned them that they were trespassed or it was just in the manager's head? Did they leave or did not?
Whatever the answer to your question is, would be hearsay. She would have to ask them to leave in front of the police, and at that point they could leave without having to ID. If they then, however, after being asked to leave in front of the police, stay, THEN they could be ID's and detained for CRIMINAL TRESPASS, because at that point they broke a law. There are 2 types of Trespass. Trespass Warning, and Criminal Trespass.

Police can be called in case the warning was violated. Your intro says the manager trespassed the kids. Did she do it before calling the police or when the police came and acted as the McDonalds agent? If it’s the latter then yes, the officers could just ask the kids to leave and never came back.

Manager wanted them trespassed which after told if they dont leave than they can ID them. Seems they violated their constitutional rights.

TBH I think 99% of police officers don't actually know that they have to be asked to leave first.

By law, the police DO have to ID them if they’re being trespassed.
Trespass warning is not a crime, therefore no ID is required.
