Obviously you haven’t done any time cigarettes have been banned in USA prisons for over 10 years so before you go to prison you go to Jail it’s mostly a building no windows or fresh air then when you get to prison the only way to get a smoke is illegally so don’t knock people until you have been in a position.
You could also tell the officer was hesitant to charge him for that because be is clearly having some sort of a mental breakdown/drug induced state. Most officers understand that adding charges to people like these really isn’t going to help them honestly.
