Even in this made-up definition that's far more inclusive, Miss Hernandez refuses to classify her experience as rape. So, the fact that people label Sinatraa a rapist is laughable. Unless you have a degree in forensic science and a rape kit that says otherwise, I'd shut up.
Interestingly enough, in this scenario, Miss Hernandez stated that she “gave in due to the fear of emotional abuse.” If "gave in" means giving consent in this context, then obviously she wouldn't have a case because it categorically wouldn't be rape. And unfortunately, regrettable sex with your boyfriend is not a crime.
