He has no regeneration, that frost at the end of the manga already allows him to die. He is not alive, he is dying, it is no longer a miracle for the others, because they will say goodbye to him. At this point in the story he is dying. In an omission panel it is already implied that Dabi is already dead, which is why it moves slowly. Tears represent nothing, and when they mention that medical probabilities give great passes, they are referring to edghost, and the more common Spinner. Don't confuse it with a clue, if that's the case, it would be a gap in the script, and they should save toga or kurogiri. It's not a clue, nor a coincidence. What's interesting is that Toya, probably one of the more unhinged villains in the series, is the only villain who's expressed some seeming remorse over the people that he's killed. When he thought back to what Snatch (the sand hero) asked him in season 4 about the families of the people he's killed, he actually shed a tear and said that he had. It's a fleeting scene, but a fascinating one.
Also, Japan has the death penalty, and fighting for Touya to survive, only to sentence him to death for his crimes afterwards, would be counterproductive to the story as it would only make it longer and sadder, which is why there is no debate for fans anymore, because it closed it, and letting Touya die alone is a nice compromise and closure for the character.
