We the American people can demand for the Supreme Court justices to be expelled from office per section 3 of the 14th amendment. Because the Supreme Court justices just provided aid and comfort to a known insurrectionists known as Trump.

Judge Luttig should be Chief Justice now, no leadership on the Court today.

I’m a democrat but sincerely appreciate Judge Luttig’s views. I learn something every time I hear him. He’s courageous and speaks truth to power.
I think this ruling has created a total undermining of any respect of the Court and is a stain on the US judiciary. The justices need to only interpret the Constitution as it was written - not rewrite it. What an abysmal occurrence.

I can only repeat, the 14th Amendment says he can't HOLD office. It does NOT say he can't run. The court didn't decide, if he can get sworn into office, if he wins the vote. In my opinion, the Supreme Court only decided if states can remove someone from the ballot, so you don't have individual states remove insurrectionists, while others do not. The 14th Amendment still applies and Trump CAN NOT HOLD office, win or lose in the election. This is an even better outcome in my opinion because in a situation like the Civil War you may have an insurrectionist make it onto enough ballots to still win the election.

Supreme Court justices are nominated, they aren’t elected. Only the Senate gets a say. It’s how the Founding Fathers set it up in the Constitution.

People are talking about it. It is a cause for some hope. Decisions that aid Trump risk making the court irrelevant if he ever steps into the Oval Office again. It might temper the instinct of one or two justices to side with the dear leader, regardless of how stupid, narcissistic, and corrupt he is. Since there’s no other entity that is above the Supreme Court to reverse their decisions of course they will stand. Congress could change the wording of the 14th amendment, section 3 to make it more forceful in what it is intended to accomplish, but the Republicans would never go along with that. We need to expand the court to 13 justices because there’s 13 judicial districts. Some of the justices have 2 districts to oversee and others have one. President Biden needs to appoint four more justices! The Republicans will fight that but they will lose. The court will be made more equitable and America will have justice.

@CaliforniaBushman - The man knows the law and the Constitution. He stood against tfg, and his former clerk John Eastman, in the 2020 election. He wrote that Trump and his allies "instigated" a war on democracy "so that he could cling to power." He continued, "It is breathtaking that these arguments even were conceived, let alone entertained by the President of the United States at that perilous moment in history". He's conservative, but his legal outlook is finely honed.

Lol. You obviously know nothing about how the law works. When a case comes before the supreme Court, The court rules on the limited issue that comes before the court in that particular case, alone. Often times those decisions have far-reaching consequences. The most recent case involving the Colorado ballot issue was decided unanimously (9 to 0). What the justices disagreed on was the need to render an opinion beyond the simple decision of a state not having the authority to unilaterally preclude a candidate (for a federal office) from being on the ballot. However, the supreme Court has done nothing to keep Donald Trump out of jail or whatever you're claiming, and I would like for you to explain how they are aiding and abetting a criminal. And if your comment involves Trump allegedly participating in an insurrection, what has stopped the United States Justice department from criminally prosecuting Donald Trump or any other person involved in January 6th for the crime of "insurrection" which is set forth in the United States criminal code? The executive branch, which is currently democratically controlled, is the branch of the government that enforces the law. So rather than blame the Supreme Court, why won't you blame Merrick Garland?

@@douglassepic9030 by delaying the one case that could go to trial & produce results, for the benefit of the electorate, before election. If trump were to win he’d dismiss case, and avoid jail. SC could have taken the immunity case on an expedited basis (or as J Luttig said it was unnecessary to even take the case at all) .. I’d accept the opinion of a Constitutional Scholar .. but they opted for the extended scheduling. Thereby increasing the risk that this case could ultimately never be tried. Scheduling is at THEIR discretion. In their ruling on this 14th Amendment issue they have effectively ‘annulled, amended’ that part of our Constitution that protects our democracy. Good news for future insurrectionists.

Never thought I would say that I love a conservative Federalist Society Judge, but I love this one. Judge Luttig is insightful, thoughtful, truthful to his legal beliefs, and honest in expressing them, without favor. He seems to have the knowledge and integrity that was lacking in the SCOTUS ruling. Even if I were on the other side of an issue, I would trust his legal opinion being made in an unbiased manner, based on facts, and I'm good with that. He is very measured in his remarks even when disagreeing with something, merely stating where he finds faults and why. I thoroughly enjoy hearing from him on these important topics and so glad you have interviews with him and not just short sound bites. I just said the same thing!! He's been on the short list for nominees at least once; I don't understand how he didn't make it to an appointment. Oh well ~ it's good to know that he's on the side of sanity and the law, regardless. And, I don't think there's anyone in D.C. that doesn't respect, if not admire, him. He is that well thought of by both parties.
I couldn't wait for Judge Luttig's analogy of SCOTUS's decision. I am in awe of this man's wisdom.

I, for one, am totally, totally disappointed in our Supreme Court. Not only on their handling of the decision on the 14 Amendment but Judge Thomas not rescuing himself on these cases involving the insurrection!! Sad , sad day for America !!!

The young attorney arguing for Colorado was absolutely brilliant. No one is talking about how eloquent and direct his responses were to each and every question asked.
The whole Colorado trial and appeal is on C SPAN, that young attorney and the rest of the Colorado team were brilliant! It is 6 days of evidence and much smarter argument than what SCOTUS held, and the Maine and Illinois decisions draw on it. Also follows on from Jan 6 cttee findings, well worth watching this pivotal trial.

Judge Luttig is amazing to watch... At times it can be a little monotony and his choice of words come across sometimes as dull ... Sometimes you have to watch him speak more than once to understand what he's saying... He requires a lot of patience to listen to... But if you do he is fascinating❤

Congress is partisan. Supreme Court is not supposed to be political..
I'm over 80 years old now .. while I recall decisions made by the Supreme Court with which I have not agreed, I do not recall any decision before that has made it impossible to have respect for the court. This "non-decision" "decision" smacks of tailoring it's questions and reasoning to a position derived prior to presentation of arguments. It smacks of responsive to politics in stead of to the Law. It smacks of pandering to the party filing the appeal. It smacks of quid-pro-quo bias. It smacks of irresponsible injustice. It smacks so much, it smells.
It presents itself as a genuinely "Bimbo Court ".
And THAT, truly breaks my heart!
So sickening, congress can’t even responsibly pass a budget. We’re expected to trust them with something like this???
