No.. you are referring to difference between stranger to contract and consideration. That concept was different.. here only under certain exceptional cases contract must be in writing. It is because we need some proof of benefit to stranger to enable him to file a case

Carrier bhi toh buyer hi bhejta hai na. Buyer will bear means he can then recover it from the carrier
