Section 50(17) of the Land Act, 2020 (Act 1036) reads as follows: "(17) Subject to subsection (6) of section 10, a lease for a fixed term granted by a Ghanaian to a non-Ghanaian is not subject to renewal unless the lease expressly provides otherwise." Take note of the expression "unless the lease expressly provides otherwise". What it means in effect is that even though there is no automatic renewal with respect to leases from Ghanaians to non-Ghanaians, the parties to the agreement can decide to insert a clause which will give the foreigner the right to renew the lease. When such a renewal clause is inserted, on the strength of section 50(17), such a clause will be given effect to. It is therefore advisable to always engage the services of a lawyer in the acquisition of landed properties in Ghana in order to be sure that the clear expectation of the parties is what is captured in the Deed of Lease.
