Under the Goa Panchayat Raj Act of 1994 to section 66 the Panchayat has the authority to stop the construction or extension or addition to a structure. Even after getting a stop Order the Panchayat has turned a Nelson's eye on the illegal construction and it is alleged that the Sarpanch has gone on leave. The Deputy Director of Panchayat should intervene as the Sarpanch is remiss in her duties and action taken for demolition of such structure. In the alternative a blind wall is permitted if both parties agree as per the TCP Act a blind wall is permitted but it has to be within the acts and rules. The police should verify if these labourers have permits issued by the labour department. Till now a defamation case against Eslinda was threatened by the Panchayat and a compromise was reached but still no respite to the Complainant.
Both are to be arrested. If after issuing a Stop order, the onus falls on the Owners to comply within the Acts and Rules as the Panchayat has issued increase in Re assessment of house tax by 10% provided that it is within the limits and cannot circumvent the law as the Owners are relatives of the Panchayat. The law has to be equal for all citizens. The Police should verify the ID of the labourers if they have a labour Card.
Kudos to this lady for challenging this illegal construction. Ut should be demolished as lots of illegal construction on illegal land is being constructed across Goa.
It is very difficult when they have political power. It happened to me corrupt deputy collector passed order to cut my jackfruit tree just me the matter was coming up for hearing in High Court. All are corrupt. There is no limit for corruption under corrupt government
I also fight this fight against non goan nothing is happening only supporting illigal.party panchayat n MLA also only 120 square mitre land n d outsider build d house sorry to see this all
If i have understood the news correctly, the Sarpanch was absence and has shown his/her participation in a corruption. I am happy that there are other arms of law and order to rely on to fend illegalities. But the matter has to be resolved in favour of the complainant if she has all legal paper work.
Yes, the owner should be arrested since there's a stop order from the Panchayat and the BDO.But through the blessings from the Sarpanch the illegal works are being completed.
Panchayat members are the real culprits in many cases across goa... BUT they dare ro do illegalities because other people stay quite saying" Amka kitte podlam". All illegalities should immediately stop... Old ancestral properties are rented out by panchayat members without the notice and knowledge of the owners...
