      We heard some seriously uneducated and unprofessional questions from Kagan. She's a fraud who talks like she is semi-illiterate yet she's very condescending to those who do not espouse the ideology that she follows and may believe. I'm starting to think that many of the politicians and bureaucrats on the left are well-paid bad actors. What else are you going to do with all the acting school major rejects that didn't make the A-list? Not that the Hollywood A-list is impressive these days. Every bar and standard has been lowered. Harvard was founded by great minds. Look at our academic institutions today. Glorified and exorbitantly expensive insane asylums and day cares.

      These aren't intelligent questions. They wouldn't ask some of these questions if they were familiar with previous SC rulings and the findings of the lower court. The lawyers often are simply repeating facts from the record to answer questions

I would hope that you would be willing to admit that many a judge would have danced around the questions for much longer even though a response was provided.

      That should be true at private colleges, but not colleges that receive taxpayer funding. Colleges that accept American taxpayer funding should indeed consider whether the applicant is American. And American government research projects should be sent to American taxpayer funded colleges (for security reasons). I'm Asian American and I feel strongly about this.

    The quickest way to solve this is to remove any question of nationality from ALL applications anywhere private or government. The only questions to be asked. Are you an American Citizen? Do you speak English?

      @@funnybunnymomoney388 The left actually published papers on how to figure out someone's race from other information because they are such racist scum that they desperately want to discriminate based on ethnicity even in cases where it's blatantly illegal. I'm not exaggerating; the Biden DOJ has openly talked about strategizing on how to work around the law.
      For that reason, we have to hide even things like city and zipcode from them (things they use to guess race), and really, we just need to remove these evil people and punish them harshly to set an example because they won't ever stop otherwise.

    The applications should not include a persons race, sex, or name. The whole process should be based on merit, i.e., academics, extracurricular activities and community service.

      My daughter has an Italian last name. Mine. Her father is Asian. Some people mistake her for Hispanic on visual inspection. She did not get into MIT. However, she went to a very fine engineering university and graduated with high honors. Interestingly enough, when my daughter applied to MIT, the Dean of Admissions was a fraud. In 2007: "The Massachusetts Institute of Technology’s dean of admissions, Marilee Jones, resigned Thursday and confessed to the ultimate sin of her profession: lying on an application. Jones, who had led the admissions office since 1998, falsely claimed degrees at three schools in upstate New York, an MIT spokeswoman said. In reality, Jones briefly attended just one of the schools, Rensselaer Polytechnic Institute (RPI), and never enrolled at the other two." - The Crimson. Shows what a fraud and joke the whole admissions process has become.

    If racial diversity is so “necessary” is it really helping people of certain backgrounds getting into a lot of universities unqualified to meet a quota?
    I looked up 6 yr college drop out rates:
    Native American 41%
    Black 40%
    Hispanic 30%
    White 22%
    Asian 17%
    (There are some variations among sites)
    Would a lot of these student have greater success going to less rigorous colleges? A JC first? How about a respectable trade school?
    Seems to do a lot of harm to one’s self esteem that they cannot compete.

      But as I see it today. it is doing a lot of harm to young people’s esteem to set them up for failure. Those who just needed a hand up can still go to lesser colleges with lower standardized scores and transfer to a top university. Their degree will be from where they graduate.

      My old university (I don't think it's Alma Matter since I'm a drop out stat) once gave a speech about wanting more blacks and diversity (of course). In this they bragged they had managed to bring in so many more black students (by being extremely racist), then lamented how the black dropout rate exploded. They genuinely didn't seem to connect that bringing in unqualified students is just setting them up for failure.

      I am serious when I say this. Only reformed theologians could cast out the demonic possession of Harvard that exists today. The Puritans founded Harvard. Everyone should study the reformation from its very beginnings with Wycliffe at the University of Oxford to Oliver Cromwell to Puritans founding Harvard and other academic institutions in early America to today's reformers. A real education in so many disciplines. People would learn about the Guttenberg press. I could wax on. (I also learned a lot about the risk reward curve and puts and calls in my Investments and Securities classes, which I took as electives.) Ah, those were the days. Well, the founders of Harvard may be turning over in their graves. Isn't it ironic that these university employees work so hard to discriminate in the name of racial diversity and work so hard to shut down diversity of opinion? They must be exhausted. Just listening to their lawyers' racing thoughts makes one realize how everything about them is on overdrive and gets them all tangled up in their underwear.     Toxic diversity has nothing to do with racial equality or any equality or equal rights. Toxic diversity is divisive identity politics and the diversity being sought is in a homogeneity of propagandist thought. Different standards are applied that reduce any academic standard to the lowest levels so that a "student" is easily controlled, manipulated and exploited. Asian students in particular ARE being discriminated against. Students are NOT being admitted on academic excellence, achievement and merit but instead, they are being admitted based on "personality" and divisive identity politics groupings that are relativistic and subjective.

    A great bill to write our Congressman is to award all citizens and perminant residents $25,000 in a lump sum anytime after 36 months of full time work, part time and volunteer work included in the total sum, for the purchase of a home, whenever the citizen is ready to purchase one. This is a Grant, not a loan. Also in the bill the citizen or perminant resident will receive between $150,000 and $1.5 million in a lump sum anytime after 100 months of full time work, part time and volunteer work included in the total sum, for the citizens business start up or already existing business. The dollar amount awarded is determined by the size and scope of the business and work experience. The citizen must spend at least 50% of funds awarded on their business or business related items. This is a Grant, not a loan. The printing and issuance of money is validated by any legitimate labor, production, goods or services for society. Also in the bill is a mandate on U.S. Banks to pay their depositers at least 90% of all interest collected, according to the monthly or quarterly average account balance, because it is the depositers money that was loaned out to begin with. Contact your U.S. Congressman or Senator for an exceptional bill in Congress.

    Way to talk around the issue. I'd prefer more direct lines of questioning to get to the same end to avoid misconception and eliminate squirming.
    Specifically, if you can discriminate based on race to achieve proportionate representation in your organization, why can you not descriminate based on religion.     Harvard does not track religion or give it a tip because it disfavors religion. It’s ministry minsters to 27 kids from different religions. Harvard and other private colleges should,pay taxes for the privilege of being in A,Erica like the rest of us.

    Has anyone ever offered real, quantifiable evidence that showed diversity was a net good? For example. given a task with various steps that lead to a measurable end, do "diverse" groups (in quotes since I've never heard a good definition of diversity) do better than homogenous groups? I know an argument was made by one of the lawyers that seemed to answer this question: He gave an example of a "diverse" group having more success in investing their funds than a non-"diverse" group. Do you think a group of racially diverse people who all grew up together in a suburban neighborhood will be more successful than a racially homogenous group that come from all parts of the social and financial spectrum? I would argue that later is the more diverse group. Or has "diversity is good" just become a truism that should be accepted and never questioned? I think it was Thomas Sowell who said something like our strength is not diversity, it's the ability to get along despite it. See Balkans

    Kavanaugh’s question is of perceptually concrete minded instead of conceptual.
    If a person asks “Why don’t you keep track of “Latin” acceptances?” Instead of asking do we only have a certain type of admission candidate, and what type of person is that? Is he a Harvard person? By virtue.

      Large US employers think like the Ivy League universities these days, so that won't happen across the board. But so long as government regulation is kept to a minimum, the best and most persistent young people of all backgrounds will continue to find their own path to success in the US.

      @@Reach41 I understand. Elitist racism makes me cynical sometimes. But it's actions like this lawsuit that give me hope. I went to one of these schools many years ago on a scholarship. I'm not sure what they're doing with admissions these days, but I stopped caring about that school many years ago, ever since I came to the realization that I disagree with them on just about every subject that matters, unfortunately.

    In Baltimore Maryland over 70% of teens entering high school can't read at a 4th grade level. I'm sure the same is true in most large Democrat run cities. Whose fault is this? Is it the students fault? Is it the parents fault? Is it the teachers fault? Why aren't people being held accountable for this failure?

    Like Destiny's Child song is entitled, "I'M A SURVIVOR!" I was born during a time when it was ILLEGAL for me to walk on certain sides of the street; enter buildings from the front door; could not go to school with Whites; could not drink from the same water fountains as Whites; could not VOTE; could not go to most state universities; etc. In other words, I have a DOCTORATE, A MASTER of SCIENCE and a BACHELOR of FINE ARTS from this same nation. So much as happened during my little life time. I will NEVER be afraid of speaking up for what's right or wrong.     Personality interview score also rates applicant for integrity (honesty). Asian students as a group score lower than blacks, Hispanics and whites. As a group Asians score so low that it negates their high SAT scores. That is pretty bad for an ethnic group to be exposed by the interview to be in general so dishonest. So if all major US colleges use Harvard fair and valid method for scoring applicants can a company assume most Asians who are not honest enough to be admitted should not be hire. No matter how smart you are being proven to be dishonest is not worth the risk for employers.
