Provisional assessment interest provision is totally bullshit, It is totally unfair to the assessee.. why they are charging interest from the first day of the month of BoE and if they take whole 5 months to do final assessment that's also upon the assessee because we have to pay interest of the months because of custom department inefficiency, also they want 15% interest from assessee? Which bank gives govt. 15% on their deposit?? On the other side when it comes to giving interest on refund only 6% which is less than half the amount they are charging from us and that too taking 3 months after the final assessment How much more unfair this provision can be ??

If the freight charges from export port to place of importation is not provided then we have to take 20% of FOB, we use transit and loading, unloading and handling charges from factory to export port in calculation of FOB to achieve 20% of FOB but will not add those expenses in assessable value as they are already covered in 20% of FOB.
Please Note : In Baggage rule 6, items of Annexure 1& 2 is not allowed and items Annexure 3 is allowed
