Legally, you have to honour the term of the contract. So he could sue you for the difference. But speak with him, perhaps he may let you out of the lease because rents are higher.

So just on the basis of owners not liking to fix maintenance issues, can they serve me a move-out notice? Negotiate with the tenant. You have no obligation to let them out of the lease, but to collect may be a difficult process. You'll have to go through the Landlord and Tenant Board for the N4/L1 process to get an order, then you have to go to the courts to get a judgement, and then take it to collections. You may even need skip tracing services to find them if they do the midnight move. But ultimately they are still on the hook. So best to negotiate to have a favourable outcome. Like, they'll pay for the leasing fees, and will cooperate with showings. Otherwise you have to sue. Book an appointment if you want to chat for more details. Or consult a landlord lawyer.
Hello..I have one more question and would greatly appreciate your response.I had an emergency repair done in October 2021 in my rental condo in vancouver,BC where I live currently to fix a plumbing issue in my bathroom which I paid $600 for 2 hours of work as it was a holiday and this was the lowest amount plumber was charging to fix issues..I called my property manager on that day but he didn’t pick up and sent me a test saying they will reimburse me..I still live in the same apartment and they haven’t reimbursed me yet, it has been 10 months now..I reminded him multiple times through text and email but he doesn’t respond on email and on call he says he will let the accounting team of his company know and then no replies…So it looks like he doesn’t have any intention of reimbursing me..In this case, May I know what are my options?

Hi Karamjeet, I'm not a lawyer so I cannot advise you on your specific landlord and tenant board issue. However, keep in mind that a lease is a valid lease, and you must honour it. If it is a roommate that is causing you issues, the LTB does not have any ruling over multiple occupants in an individual unit. However, if it's a tenant in another unit, then the landlord has to get involved to attempt to mediate the issues (for example, noise from units above). If you don't want to live there any more, consider finding a replacement tenant as a sublet agreement. The landlord cannot unreasonably withhold permission to sublet, assuming it is a qualified tenant. If you fear for your safety, please call the police. Good luck to you.

Yes typically first and last month’s rent is due upfront. I’m not sure if that’s what you’re asking.

A tenant can assign the lease with permission from the landlord, but that permission cannot be arbitrarily withheld.
