Mwaf I have seen how much confusing it has been and the fact that you really wanted to learn how this works in court. I have attended courts severally as a lawyer where children are involved and this is the breakdown.
The Children Act defines a child in conflict with the law as a person above the age of 12 but below the age of 18, who has been dealt with and punished according to the Act for an offence except the offence of murder.
In Kenya, a child is criminally liable if the child commits an offence at the age of 12 years. Children are investigated and indicted in the same way as adults. A person under the age of twelve years is not criminally responsible for any act or omission. A child who commits an offence while under the age of fourteen years is presumed not to be capable of differentiating between right and wrong, unless the Court is satisfied on evidence to the contrary. A child offender cannot be ordered to imprisonment Notwithstanding the nature of any offence, cannot Be ordered to suffer death penalty or be committed to rehabilitation school if below 12 years of age.
A person under the age of eight years is not criminally responsible for any act or omission.
A person under the age of twelve years is not criminally responsible for an act or omission, unless it is proved that at the time of doing the act or making the omission he had capacity to know that he ought not to do the act or make the omission.
A male person under the age of twelve years is presumed to be incapable of having carnal knowledge.
A child convicted of murder cannot therefore face life imprisonment. It is usually a dilemma courts face when sentencing an offender who was a minor turned into an adult at the time of sentencing or at the time of an appeal. Remember the purposes of the sentences provided for under the Children Act are meant to correct and rehabilitate a young offender. Usually they will face shorter sentences in borstal institutions.
However if it is proven that the child had carnal knowledge at the age of 16 years, the court can sentence him in any other lawful manner. it is a grey area in law and usually it just depends on the nature of the crime and the circumstances.
