    I don't think symbolic speech means what you said. I think those are establishment clause issues. Symbolic speech means expressive conduct, aka draft-card burning and flag burning. The test you articulated is used for that conduct.

    The First Amendment is a "Right", it's not a privilege. A "Right" is an action that does not cause harm to other being. "Rights" are granted by the Creator (Declaration of Independence) and not by other human beings or group of human beings calling themselves "government".
    If the speech could insight violence or harm to another individual, their property,, or their freedom - than the speech is not protected under the Bill of Rights or the Declaration of Independence.
    The Bill of Rights is an extension of the 1787 Constitution, which in Article VI states that the Constitution is the Supreme Law of the Land and Judges in every state shall be bound thereby. Any thing in the Constitution or Laws of any State to the Contrary notwithstanding.
    That means things like Free Speech zones and maritime admiralty law, does not stand.
