I am not a guru in the legal sector but I think our “innocent” man might have it rough. I am sure they will not be able to prove the lady wasn’t a minor. Section 124 of the evidence act “…..Provided that where in a criminal case involving a sexual offence the only evidence is that of the alleged victim of the offence, the court shall receive the evidence of the alleged victim and proceed to convict the accused person if, for reasons to be recorded in the proceedings, the court is satisfied that the alleged victim is telling the truth” says that her confession is the only thing that can set our man free. From the confession, even though the girl says it was not a rape case, she confesses that they had sex. She is a minor (as per the law) and she is deemed to be incapacitated to make the right decisions. Up to this juncture, the law is totally against our man. However, common law is permitted in our country. The judge might invoke their interpretations and free the man. I am not a guru in the legal sector but I think our “innocent” man might have it rough. I am sure they will not be able to prove the lady wasn’t a minor. Hours, minutes, or even seconds consider while determining her age. However, her confession is vital! Section 124 of the evidence act “…..Provided that where in a criminal case involving a sexual offence the only evidence is that of the alleged victim of the offence, the court shall receive the evidence of the alleged victim and proceed to convict the accused person if, for reasons to be recorded in the proceedings, the court is satisfied that the alleged victim is telling the truth” says that her confession is the only thing that can set our man free. From the confession, even though the girl says it was not a rape case, she confesses that they had sex. She is a minor (as per the law) and she is deemed to be incapacitated to make the right decisions. Up to this juncture, the law is totally against our man. However, common law is permitted in our country. The judge might invoke their interpretations and free the man. What I am sure is that the woman will not get the three million (unless she gets it out of the formal proceedings) and the girl, the cop, and the mum might find themselves answering charges for the doctored confession.
