Idk, as much as I want this woman to get her just deserts, I wouldn't go so far as to confidently say that she is clutching her belly as an act of manipulation. Belly clutching is something that pregnant women do, especially later on in the pregnancy. You ever clutch your belly when you had a stomach ache? Imagine having a living baby kicking around down there. Its instinctual. I've seen pregnant women do it all the time, especially when the baby is the subject of conversation. Good or bad.

Got away with what? Even the prosecution said they couldn’t prove causation hence the plea agreement, he’s smiling because the judge originally thought her BAC was 0.2 when it was really 0.025 well below the legal limit, he’s smiling because he was able to keep his client out of jail despite that you could tell the judge wanted to put her there but didn’t have a basis for it. Yes, she’ll have to remain sober and attend some drug treatment sessions BUT she stays out of jail so yes, despite what you think the lawyer did his job.

Special needs mom here.... the judge is not wrong. When he says you will have to babysit your child if he or she has mental issues which is punishment in and of itself. I never drank or did drugs ever in my life but my son has level 3 autism.he is almost 9, nonverbal and has alot of issues. I love my son... But being a caregiver is extremely challenging, and the hardest thing ive ever had to deal with in life and it will never go away. I will always be responsible for him til he dies and its very sad 😢 When I was pregnant I did everything I could to eat right, etc. It's so disrespectful that women out here are intentionally hurting their unborn babies with drugs and alcohol

Your son is still just as human, emotional, and real as any other child, one that needs your love and nurturing. I'm glad to be high functioning autism, but I have also had challenges such as non-verbal for months at a time, and I can say from my own experience with it, we can tell when someone cares, and accepts, vs doesn't care, who doesn't understand, who tries to push us into discomfort and misunderstanding. It's hard, it really *really* is a challenge, but I genuinely applaud you for this, I applaud you for choosing to stick by his side, to love him no matter what, and even though you find it challenging (and that it is extremely challenging), you want to be and will be responsible for him until he dies, and yes it's very very hard, very sad, you wish you could have done something. But, it's not your fault, you can do everything right, anything you possibly can, but some things are outside of control. It is not that which counts towards you being better or worse, for 'Giving him this life', because it wasn't and isn't your fault he is special needs, and from what I see here you are clearly, and passionately dedicated to making sure that he is okay, that he knows he is loved, and that he knows he is alright. YES JUDGE! When I was 6 years old, I lost the use of my legs because a woman was driving drunk and high on painkillers. She received ZERO jail time, and declined to apologize when offered the chance. (Even her boyfriend that was in the car with her, tearfully apologized to me) I was 9 years old when she was finally sentenced. I couldn’t wrap my head around the fact that I have to spend the rest of my life in a wheelchair because of her actions, and she doesn’t have to spend 1 single day in jail. I wasn’t asking for her to go to prison for life, or even 20 years. Just a prison sentence of some kind. She received 5 years probation, and proceeded to violate probation 7 times, still no jail time.
what do you expect? the law is created with human bias attached. women get shorter terms and have super high rates of getting probation while men do not.

I got this and didn't kill anyone. -.- guess what I wasn't, pregnant. Oh, also no proof either that the drug in my system caused it (car had sped up to pass, I stupidly just used my mirror, and didn't have the reaction time to correct due to intoxication. Also got three days in jail. No history of this behavior.) I'm kind of shocked she got a pass....because she's pregnant. As a woman, I'm kind of disgusted.
I've been off hard drugs for almost 4 years and have built a stable and good life after a rough road in my 20s. But again, I'd be sitting in jail long term if I had killed someone.

The issue is they cannot prove if it was her fault or the other persons. She was not drunk at the time which is why the judge switched up real fast when they corrected him. .025 could happen from using mouthwash. She prob just cracked open her beer. If she had money and got a real defense attorney she easily could have walked away with an open container charge dead body or not.

Sometimes people smile at innapropriate times. I could imagine him smiling that the judge was corrected on how much alcohol she had. Seemingly they already investigated and determined that the intoxication didn't cause the accident. so though it's a serious offense to drive in that condition and it COULD have caused a fatality that was not the cause in this case. Now if they proved that a sober person could have easily stopped in time but she didn't then that might make it different. (also several people have indicated that she was not pregnant or knowingly so at the time. unsure if that's true but it can take a long time to get to court.)

He should have refused the plea and took it to trial. Had she not driven under the influence, the lady could still be alive. Her reflexes were slower, so when the car did spin out, she could have reacted a different way.

I agree, as a truck driver a co-worker of mine was rear- ended while he was stopped at a light waiting to turn left into our yard. All the facts in the case show that my coworker did nothing to cause the accident. The guy was speeding and drunk and hit something on the right side of the road, then crossed three lanes and rear-ended my coworker. He was arrested because he was 2 minutes beyond the time to start his break when he came to a stop at that light. He was arrested two years ago and is still in jail under the premise that he should not have been there legally. He was sober, aware, and otherwise did nothing wrong.

If a reasonable person could not have avoided the crash then the drugs weren't relevant to the death and therefore she shouldn't be charged for that aspect. To reiterate my point let's make a different hypothetical. Say someone with an expired license is stopped at a red light and someone else rear-ends them. The person with an expired license isn't automatically at fault just because they should not have been driving, they have to have actually caused the accident (their mere presence isn't sufficient).
Thankfully I was adopted at age 3 out of this situation…..BUT….As a child of a woman (my biological egg donor) who drank alcohol and did drugs the entire time she was pregnant with me, I think this woman here needs to go to prison and lose her child. This. I also think it was an excuse on the prosecutors part saying "it was a causation issue since the other vehicle was on the roadway" like, um, okay?? Where else was the vehicle supposed to be?? IMAGINE being the family that gets approached by the DA with this "deal" (which is a deal of the CENTURY for this defendant) and having to ACCEPT that this may be the hardest sentence they'd be able to get for her. I'm glad this judge was like, "not in my courtroom. Not when there's a dead body". She's lucky that her unborn child wasn't harmed in the crash. It's unfortunate the other driver wasn't as lucky. She definitely needs jail. A week behind bars is NOTHING, she'll barely be done with withdrawals (depending on how hard of a user she was) by that point. She will literally be on the tipping point and will go out and get more drugs the MOMENT her foot touches the ground. I'm sure she had to give up her dealer and that's the only reason she got as good of a deal as she did. The argument is that her condition didn’t matter and that’s why the district attorney didn’t want to pursue manslaughter- the car in front of her spun out and it’s looking like she hit the side of it while it was spinning (which drastically slows down a car). Like the judge says, the impact the crash most likely has inflicted on the child in her stomach. Theres many complications she'll be facing throughout her life raising the kid. She didn't ruin 1 life and their family and friends, she destroyed her own and worst of all her unborn child's life. Even the prosecution said they couldn’t prove causation hence the plea agreement, he’s smiling because the judge originally thought her BAC was 0.2 when it was really 0.025 well below the legal limit, he’s smiling because he was able to keep his client out of jail despite that you could tell the judge wanted to put her there but didn’t have a basis for it. Yes, she’ll have to remain sober and attend some drug treatment sessions BUT she stays out of jail so yes, despite what you think the lawyer did his job.

Special needs mom here.... the judge is not wrong. When he says you will have to babysit your child if he or she has mental issues which is punishment in and of itself. I never drank or did drugs ever in my life but my son has level 3 autism.he is almost 9, nonverbal and has alot of issues. I love my son... But being a caregiver is extremely challenging, and the hardest thing ive ever had to deal with in life and it will never go away. I will always be responsible for him til he dies and its very sad 😢 When I was pregnant I did everything I could to eat right, etc. It's so disrespectful that women out here are intentionally hurting their unborn babies with drugs and alcohol

I'm glad to be high functioning autism, but I have also had challenges such as non-verbal for months at a time, and I can say from my own experience with it, we can tell when someone cares, and accepts, vs doesn't care, who doesn't understand, who tries to push us into discomfort and misunderstanding.
It's hard, it really *really* is a challenge, but I genuinely applaud you for this, I applaud you for choosing to stick by his side, to love him no matter what, and even though you find it challenging (and that it is extremely challenging), you want to be and will be responsible for him until he dies, and yes it's very very hard, very sad, you wish you could have done something.
But, it's not your fault, you can do everything right, anything you possibly can, but some things are outside of control. It is not that which counts towards you being better or worse, for 'Giving him this life', because it wasn't and isn't your fault he is special needs, and from what I see here you are clearly, and passionately dedicated to making sure that he is okay, that he knows he is loved, and that he knows he is alright.

YES JUDGE! When I was 6 years old, I lost the use of my legs because a woman was driving drunk and high on painkillers. She received ZERO jail time, and declined to apologize when offered the chance. (Even her boyfriend that was in the car with her, tearfully apologized to me) I was 9 years old when she was finally sentenced. I couldn’t wrap my head around the fact that I have to spend the rest of my life in a wheelchair because of her actions, and she doesn’t have to spend 1 single day in jail. I wasn’t asking for her to go to prison for life, or even 20 years. Just a prison sentence of some kind. She received 5 years probation, and proceeded to violate probation 7 times, still no jail time.

I really don’t even think about being in a wheelchair, I barely have any memories of being able to walk. It’d be really weird to not be sitting. Thank you for the well wishes

Sometimes people smile at innapropriate times. I could imagine him smiling that the judge was corrected on how much alcohol she had. Seemingly they already investigated and determined that the intoxication didn't cause the accident. so though it's a serious offense to drive in that condition and it COULD have caused a fatality that was not the cause in this case. Now if they proved that a sober person could have easily stopped in time but she didn't then that might make it different. (also several people have indicated that she was not pregnant or knowingly so at the time. unsure if that's true but it can take a long time to get to court.)

He should have refused the plea and took it to trial. Had she not driven under the influence, the lady could still be alive. Her reflexes were slower, so when the car did spin out, she could have reacted a different way.
I'm usually onboard with this logic but based on the way the accident alleged happened, it sounds like her reaction times weren't the issue which is why they didn't charge her with manslaughter. I will concede to the fact she technically SHOULDN'T have been on the road, tho.

I agree, as a truck driver a co-worker of mine was rear- ended while he was stopped at a light waiting to turn left into our yard. All the facts in the case show that my coworker did nothing to cause the accident. The guy was speeding and drunk and hit something on the right side of the road, then crossed three lanes and rear-ended my coworker. He was arrested because he was 2 minutes beyond the time to start his break when he came to a stop at that light. He was arrested two years ago and is still in jail under the premise that he should not have been there legally. He was sober, aware, and otherwise did nothing wrong.

Because technically yes, he shouldn't have been there but I'd mark that up with getting in a car accident but being charged for running a yellow light because you shouldn't have been past the intersection where the accident occured, if that makes sense.
@@Dratchev241 That's not how it works. The specific thing that matters is whether the drugs affected the outcome. If a reasonable person could not have avoided the crash then the drugs weren't relevant to the death and therefore she shouldn't be charged for that aspect. To reiterate my point let's make a different hypothetical. Say someone with an expired license is stopped at a red light and someone else rear-ends them. The person with an expired license isn't automatically at fault just because they should not have been driving, they have to have actually caused the accident (their mere presence isn't sufficient).
Thankfully I was adopted at age 3 out of this situation…..BUT….As a child of a woman (my biological egg donor) who drank alcohol and did drugs the entire time she was pregnant with me, I think this woman here needs to go to prison and lose her child. Period. Someone died as a result and cocaine in her system. Prison time. Regardless of how the accident happened, she had drugs and alcohol in her system and there’s a dead body involved….. I think she should have gotten prison time.
This. I also think it was an excuse on the prosecutors part saying "it was a causation issue since the other vehicle was on the roadway" like, um, okay?? Where else was the vehicle supposed to be?? IMAGINE being the family that gets approached by the DA with this "deal" (which is a deal of the CENTURY for this defendant) and having to ACCEPT that this may be the hardest sentence they'd be able to get for her. I'm glad this judge was like, "not in my courtroom. Not when there's a dead body".
It's unfortunate that he had to accept the deal anyways. :(
She was holding her belly trying to emphasize that she's 9 months pregnant without the thought that she was NINE MONTHS PREGNANT while committing these heinous acts. She's lucky that her unborn child wasn't harmed in the crash. It's unfortunate the other driver wasn't as lucky. She definitely needs jail. A week behind bars is NOTHING, she'll barely be done with withdrawals (depending on how hard of a user she was) by that point. She will literally be on the tipping point and will go out and get more drugs the MOMENT her foot touches the ground.
I'm sure she had to give up her dealer and that's the only reason she got as good of a deal as she did. Pathetic excuse for an egg donor, she should lose her child and forfeit any future rights to any other children she may conceive.
They should definitely have her go to prison after she delivers and do an ankle lock. The baby situation is terrible. She probably has to give up her baby to foster care or something because what she did caused a life. She is not fit for a mother. Period!

The argument is that her condition didn’t matter and that’s why the district attorney didn’t want to pursue manslaughter- the car in front of her spun out and it’s looking like she hit the side of it while it was spinning (which drastically slows down a car). Not murder, and the death being “caused” by her is debatable.
The victim would have died regardless who was driving her car. And that's the point: she wasn't at fault.
If a maniac jumps in front of your car you wouldn't be charged with murder either.

@@Sonic-gy7kqtbf they can’t prove causation because the vehicle the victim was in spun out prior. Since they can’t prove that she was the direct cause of the murder they can’t charge her with manslaughter. He was still tougher than the prosecutor, who just wanted 18 months of probation

Basically if you can't hold your liquor at all and are typsy on .02% BAC you shouldn't drive. Personally I think it is a bad idea to be driving with any alchol in your system.
Was a 0.25 from the blood draw, which is usually a few hours AFTER the accident. Think what she might have been at the time of the accident.

I lost my only & baby sister to someone just like her!!! It causes a ripple that destroys so many. Thanks to God, the murderer had previous serious charges. This time, he was up on meth for days, drunk, heroin & Xanax in his sytem in his parents stolen car. He got life w/o the possibility of parole. This woman deserves much time & many treatment classes.
