If you visit the hospital ER and you told staff that you were hurt in an accident at a business or car accident, and they ask for details, names, etc., then why do they bill your medical insurer and not the party you told them about?

i feel like ima get a pretty big settlement. they accepted 100% liability immediately with a million dollar policy. I was taken to the hospital by EMS in the hospital for 21 days with three surgery's including tib fib, flap, skin graft, never repair(possible permanent nerve damage). with almost a year of recovery and out of work for 6 months. i caught the accident on video and the camera caught everything. it shows my leg snapped and bleeding and me screaming and crying like a baby.

Great video!, I was assaulted right after I left a night club on Christmas Eve right before my deployment by 15 guys that were drinking underage. I had 3 fractures in my jaw and permanent nerve damage to my face , numerous surgeries . I been waiting 3 years hopefully its worth it.

Hey so I know you can’t give advice on a California case but I was recently in a motorcycle accident, lady pulls u turn causing me to evade her and crash I never touched her car but my bike was totaled I broke my ankle needed surgery and require a future surgery, I’ve recently hired a lawyer and we are working on the case to prove her negligence but there was no witnesses and no proof and the police report was inconclusive, have you seen cases like this get proved in the motorcycle riders favor? I am a truck driver and had a knee injury about a month ago and reported it a couple of days after that and took off work about a week after that and have been off work for about a month now. I have sent information and filled out medical paperwork to them and last years weekly income for a couple of months that was about 1900$ per week. I know this injury will not go away. I still have major pain, but am getting around better, but know if I move to fast or the wrong way, it will re-injure myself.

I was wondering if you know about the possibility of opening up a case again past the Statute of Limitations? I called the State and Orange County Bar and they said yes, but sent me to someone who’s paralegal told me no. In big million dollar law suits where a 3rd party claimant had extensive surgeries, do the 1st party's liability insurer calculate only the discounted amount the healthcare insurer paid providers in this case?
