ill make that argument that a cab isnt public simply based on the fact a cab will never stop for u if they have someone in the cab already. the moment you hire a cab u are the only one thats in it aka a private form of transport, if there was the chance a cab could stop for u and someone else was already in it, and u had to go to there stop first then its public. and if you google public transport a cab breaks like 2-3 of the "rules" to consider it public. is a cab available to the public, yes , it it private, no, in the same way an uber is private. Cabs are ubers u dont use an app for.
