On further Investigation it is seen that the SOCIETY SCHEFULED PROPERTY WAS MORTGAGED BY DEPOSITING TITLE, HENCE INDENTURE OF CONVEYANCE WAS NEITHER REGISTERED NOR THE MORTGAGED WAS REGISTERED WITH REGISTRATION AUTHORITIES. CONDIDERING THE WELL SETTKED RUKE THAT MUTATION ENTRY DOES NOT PROVE OR DUSPROVE OWNERSHIP .AND IT HAS BE PFOVEN THFU A VALID PURCHASE SALE AGREEMENT.. SO WHAT IS YOUR TAKE.. But clog on redemption says any condition in the contract which makes sale absolute in case of default of payment is void. Are these two concepts contradicting each other? Kindly provide your opinion on this.
