I'm finding it hard to agree with this one Terry.
Conditioned is an interesting choice of words here too. It implies that we should always accept the decision of an authority figure no matter what.
If that really was the case then why are there usually rights to appeal such decisions?
Incorrect decisions and corruption are obviously not the same thing, but my experience is that decisions are not always based on facts, be it on sport, the workplace or elsewhere.

Incorrect decisions are amenable to appeal, perhaps a number of appeals. Where’s the corruption then?

    • @White_Chapel
      @White_Chapel 9 месяцев назад +1

@@terrygorry I'm not saying there is corruption. The point I was making is that being conditioned to accept unfavourable conditions isn't always a good thing. It only applies when decisions are made based on facts and evidence.
Otherwise, the same conditioning would result in the acceptance of incorrect decisions.
On the point of appeals, you will be well aware that other obstacles will present themselves the further you have to go in the appeals process, but that's another matter.

@@terrygorry appeals in a corrupted system produce the same results. What Ireland needs are Structures of Accountability which can hold everybody to account and use facts and evidence free of all biases, prejudices, politics, conflicts of interest etc.
Read the Judical Council Act 2019, the Judicial Council Guidelines and Judicial Council rules and the Bangalore Principles. Why are these necessary Terry if you claim the system is not corrupt ? As as soccer referee, I must (respectfully your honour) add a bit of perspective and some other differences between referees and judges which has helped me personally in dealing with 'our respected judiciary'. First of all (VAR aside) a referee must make decisions on-the-spot and in-the-moment, without the time, space or easily-accessible additional legal sources to check if his decision is right. And for most working referees, being 'right' is very, very important. Need we ask if 'being right' is important to Irish judges? Furthermore, to be able to be consistently 'right' a referee MUST have a comprehensive, workable grasp of the 'Laws of the Game' sufficient NOT to outrage all of the players and spectators present, who will most certainly let him/her know if-and-when the referee may have made a mistake. Judges on the other hand - whether or not they are incapable, incompetent or corrupt, can simply tell you to shut up "or else"! Similarly, if a referee makes a ridiculously stupid or clearly-corrupt (biased) decision, well, that's the end of that referee's career. Dirty judges on the other hand seem to get promoted - or at the very least protected - at the expense of justice. The ability of dirty judges to corrupt the 'laws of the game' without immediate sanction or reprimand is THE great and enduring failure of our so-called justice system and of the so-called 'profession' of Law. This is because (in simple terms) 'the law' in Ireland comprises an utterly corrupt monopoly that houses not only these serial taxpayer-funded miscreants, but also, the mechanisms that we ordinary people are supposed to turn to for relief; the appeal courts, the police and the various so-called 'statutory oversight bodies'. When judges start getting held to the same basic standards as local sports referees in respect of their knowledge and applicability of the 'rules of the game' and of their own personal honesty and integrity, THEN we might celebrate the return of something approaching morality and ethics to what I see (as a recently-retired referee) as an utterly compromised and diabolical institution; i.e. the Irish judiciary - and the so-called Irish justice system!

Since the foundation of the Irish State the Legal Profession has had the most elected TD. Yet we have little or no Legal Reform. Many of the Common Laws have been changed by the UK from where we inherited them. Yet !! The Legal Profession in Ireland has been a stable influence in Ireland for corruption, incompetence, abuse and ignorance of the their true role to defend the Republic. We really need this type of Profession to wash their ineptitude on platforms where they believe no one is listening.Legal independence- yeh lads you wouldn’t know what the word’s meant.

I dont think the system or individuals in the system are corrupt. There is , however, some poor quality people in positions of authority making decisions on peoples lives. Sadly in the legal system we dont have VAR to review those decisions. The other big issue with the legal system is the cost where only rich and poor people can afford to access the system.

You can now seek a judicial review on a judges behavior though. This will hopefully reduce tantrums, biases and bad decisions based on what mood they decide to put themselves in.

A decision against you doesn’t always me the judge was corrupt. But sometimes it does and that’s what needs to be addressed. There are many honest decent judges but there exists some judges that are as bent as a nine pound note and your comparison of a judge and referee is slightly flawed as a bent referee won’t destroy your life but a bent judge can, big difference

In Ireland you have the right of appeal. Certainly judges are afforded some leeway, and the judgements they make can be informed by their own biases, but for the most part they are restrained from doing anything wildly out of the norm.

I would advise Terry Gorry to contact Integrity Ireland and Stephen Manning and get more details about this corruption. For example, is perjury in court a crime or not ? according to some court officers it is not.
There is evidence for denial of due process, fair hearings, audi alteram partem, and equality of arms and for breaches of superior court rules, and court procedures and Judicial laws and guidelines. Solicitors and barristers have to overcome confirmation bias and professional loyalties to get to the truth of these matters.
Before the tribunals in the 1990's and 2000's the elected politicians and gardai were all presumed to be not corrupt and to be law abiding. We need new tribunals to resolve the issues raised by Integrity Ireland and other organizations.

My opinion is that it is corrupt, the law ‘society’ says it all. It has its own language. Far too arbitrary and a cosy club. I’ve witness conversations in regards to peoples lives I thought appalling.
The profession is also paid far too much, so much so that it deters people from seeking justice.

Estate agents in this country should be all in prison. (1) Why are they allowed to have sole rights to the sale of ANOTHER PERSONS home for one ? It should be advertised with as many estate agents as the vendor desires to create COMPETITION and to get them all off their lazy asses and to all actually WORK at selling it ? The one that sells it then gets the comission. Here with exclusive rights over EVERY SALE they can sit on it forever and invent phantom bidders etc ? Most of them are makling a very good living from the advertisement fees they are charging alone. So they don't care if it ever actually sells or not. They are not seving your best interest and are all only about serving their own ? So how sick and totally corrupt is this ? When I lived in Portugal a buyer by law had to pay 10% of the asking price as a non refundable deposit. If they backed out their deposit went to the seller. Likewise if the seller backed out they had to repay the buyer DOUBLE this 10% deposit. This is the LAW there. This cuts out all gazumping, phantom bidders and all time wasters on both sides pulling out at the last minute with no penalties for doing so. What we have here in comparison are all totally self serving criminals who IRISH people give over sole and total control of the sale of THEIR PROPERTY TOO ? Everything here is designed to favour the ESTATE AGENT who the property OWNER is paying to engage ??? All insanity here ??? The entire industry here needs to be totally overhauled with 90% of the total control these totally self serving diabolicals all presently have needs to be totally TAKEN AWAY FROM THEM.

In many instances I would agree with you. The main body of legal practice in Ireland is in fact a very effecient and dynamic system that produces the correct result time and time again.
That said, there is clearly a need for the creation of a body to inform judges of changes to the law. Apparently and shockingly there is no office responsible to do just that. I'd be very interestedin your opinion regarding the letter the Master of the High court issued pertaining to the vulture funds. Some really shocking relevations have been expressed and as yet remain unanswered by anyone in the establishment.

@@Paul5520 While many if not all Judicial assistants perform this task to varying degrees of competency. That does not change the fact that there is no office charged with the responsibility for doing so. If such an office existed the upcoming debacle regarding mortgages being fraudulently sold and registered at land registry could not have happened. This failure has caused multiple families, businesses and property owners to be dispossessed when in fact it can now be proven that the vultures' did not in fact have or hold the right to sue for possession. When mortgages were sold and securitized etc. many rights were subrogated but not all. In Ireland property can only be transferred by deed.

You sound like you have inside knowledge of the courts service to make a statement like that. These people are public sector employees (courts service or Dept. of justice) so I’m sure if you emailed either they would take your issue under consideration. In terms of the property stuff, I agree to an extent but not absolutely. Are you aware of the start mortgages decision some years ago? Do I think banks should be capable of selling non performing mortgages to vulture funds? Absolutely not. Vulture funds should be illegal. However, When the borrower defaults I think the bank gets that discretion from the terms of their mortgage. It’s disgusting really. No deed is necessary from the purchaser as the bank owns the security (ie the property) until the mortgage is paid. ‘Event of Default’ those three words are most important. The state has dedicated units to deal with the likes of the vulture funds. I know that for a fact. MABS deal with people every day who have to get nonsense letters from these crowds & deal with them on their behalf (for free) so let’s have it right.
