    • @MakeitinGermanycom
      @MakeitinGermanycom  3 года назад +1

      Hi, if you want to work and live in Germany, you will need a visa to enter Germany.
      Nationals of Albania, Bosnia-Herzegovina, Kosovo, Macedonia, Montenegro and Serbia, the so-called "Western Balkans regulation" applies. According to the regulation, the Federal Employment Agency can grant approval for the exercise of any employment with the so-called “Vorrangprüfung”, the priority examination (from 1 March 2020). However, you need an employment contract or a binding job offer. The recognition of your qualification is not a prerequisite for this. Unless you work in a regulated profession (e.g. doctor), in which case your qualification must be recognised. Learn more here: www.make-it-in-germany.com/fileadmin/MiiG_Fachkraefte/PDF_s/Fachkraefte/Visum/2021_01_04_Einwanderung_nach_Deutschland_zwecks_Arbeitsaufnahme_EN.pdf

      Dear uğur alparslan,
      So, you're asking about the power of attorney granted by the foreign skilled worker to the employer in Germany?
      You need a power of attorney so that the employer can apply for the procedure on behalf of the foreign skilled worker. You can find a template on our website version for employers. You can use it and forward it to your employer ➡️ www.make-it-in-germany.com/en/looking-for-foreign-professionals/support/downloads

    I have already had my foreign education recognized in Germany through ZAB (die Zeugnisbewertung) and obtained my professional licence for my engineer title through the corresponding chamber of engineers in Germany. I currently reside in Germany as well.
    Having said those, my questions are as follows:
    1) Can I apply for a suitable work permit (with the entire necessary documentation) directly to "Ausländerbehörde" without having to go back to German consulate in my home country (Turkey)? German consulates currently do not process applications due to COVID-19 anyhow.
    2) In a fast-track procedure, would it still take "Ausländerbehörde" 2 months to process my application since I already have the required recognitions available?
    3) How long could a normal (non-fast-track) skilled worker procedure take for Ausländerbehörde to conclude?
    Thanks in advance.

      Hi Berkan, this depends on your current residence status in Germany. Generally, you need a binding job offer from a German employer for a work permit. You also need this for the fast-track procedure for skilled workers.

The company in Germany has been waiting for me since May however I cannot come because I cannot apply for blue card visa in Turkey. Both German embassy and service provider company for visa processes don't give new blue card visa appointments even though according to international sources I can get an appointment and get my visa. Not just me, a lot of people have the same problem and they are afraid they may loose their job because they cannot get their visa.

      if the applicant intends to join the family members in the fast-track procedure for skilled workers, corresponding powers of attorney by the spouse/life partner and the legal guardian for the children to the employer are required.
      In addition, the residence law requirements for the family reunification must be fulfilled. Here you can find more information: www.make-it-in-germany.com/en/living-in-germany/family-life/spouses-joining-citizens-non-eu

    Two questions:
    1. What if I have submitted by degree to the foreign education agency (ZAB) and has been issued a comparability certificate for my degree, will my employer still have to go through the process again, or can my statement make the process shorter in time frame?
    2. Can the pre-approval cover my family? If yes, what documentation and points do I need to cover along the fast-track process?

    • @MakeitinGermanycom
      @MakeitinGermanycom  2 года назад

      Hi Segun Oworu,
      thank you for your message. We will gladly give you some answers:
      1. Yes, if the statement of comparability is sufficient, this can shorten the process in time. You can find detailed information on the process here: www.make-it-in-germany.com/en/looking-for-foreign-professionals/targeted-recruitment/entering-working-in-germany/the-fast-track-procedure-for-skilled-workers
      2. Within the framework of the fast-track procedure for skilled workers, the entry of family members is also possible. However, family reunification is limited to spouses and minor, unmarried children. You require, for instance, the corresponding powers of attorney from the spouse/life partner and for the children. @MakeitinGermanycom  2 года назад +1

      Hi, thank yor for your message! According to the law, the recognition authorities have a maximum of 2 months to complete the equivalence check and provide feedback to the Immigration Office during the fast-track procedure for skilled workers. This does not mean that the authority need the full 2 months time. You can try to submit an individual application to the ZAB, but you have no further claims if the procedure is delayed.

    Hello, what's the minimum wage requirement to be eligible to apply through fast-track procedure? Please advise. Thanks

    • @MakeitinGermanycom
      @MakeitinGermanycom  4 года назад

      Hi, the fast-track procedure is primarily designed to speed up visa application procedures. For the visa you have to fulfill certain requirements, for the work visa e.g:
      - Your qualifications must be recognised in Germany, or be comparable to those from a German higher education institution. If you are seeking employment in a regulated profession, i.e., health professions, a professional practice permit is required. For more information regarding the recognition process, see Recognition.
      - Have you received an actual job offer from an employer in Germany? If so, it is important to ensure that your recognised qualifications enable you to perform the job for which you are being hired. This means that you are able to be employed in related professions.
      - Are you over 45 years old and coming to Germany for the first time for employment purposes? If so, your gross annual salary for the position you intend on taking must be at least EUR 45,540 (in 2020), or you must provide proof of adequate old age pension provisions.
      You can find more information about the visa here: www.make-it-in-germany.com/en/visa/kinds-of-visa/work-qualified-professionals/
      In addition, the Federal Employment Agency in Germany checks the employment contract , including whether you are adequately paid.
      Further information about the procedure can be found here: www.make-it-in-germany.com/en/looking-for-foreign-professionals/targeted-recruitment/entering-working-in-germany/the-fast-track-procedure-for-skilled-workers/

    • @MakeitinGermanycom
      @MakeitinGermanycom  2 года назад

      Hi Joffin,
      If you have submitted all the necessary documents to the competent authority, the processing will then take up to three months. By then, at the latest, you receive recognition notice containing the result. In certain cases the competent authority is able to extend the recognition procedure by one month. It may last longer, for example if a skills analysis takes place.
      Under certain circumstances, employers are able to apply for the so-called fast-track procedure for skilled workers from third countries. The recognition procedure may then take only 2 months. Approach your future employer about this!
      Good luck!

    Once i get my recgonition in Germany , can i apply for a skilled worker visa under the law ? Or the authorities make the application ... im talking for a accelerated skilled worker process

    • @MakeitinGermanycom
      @MakeitinGermanycom  3 года назад

      Hi, during the fast-track procedure for skilled workers, the Foreigners Authority initiates the recognition procedure or the equivalence assessment of the foreign qualification.
      The competent offices are to decide on the recognition within two months after submitting the complete application documents. In the case of documents being missing, the Foreigners Authority will immediately forward the subsequent demand to the employer. If you already obtained a recogntion of your qualification, this step won't be necessary. Hi Mevlan, it depends on several factors. If you have an appointment with the embassy in the near future, you may should keep this appointment.
      Do you already have job offer in Germany ? Because your future employer in Germany has to apply for the fast-trackprocedure for skilled workers. The employer can initiate the fast-track process at the relevant immigration authority with a power of attorney from the foreign professional. My employer applied for the fats track visa for skilled worker on 29 march 2023 in central immgration office for skilled worker NRW but its only reach upto 1 step of submission of documents and my employer received that my documents is processed for 2nd step on September 1 , but till today 19 October there is no update on next step. I am quite disappointed with process speed.
    I am tired of sending mails but there is no answer. Its already 6 months completed. Still recognition is not even started. Which itself take time ( 2 months as mentioned on website) then there will be visa process. So approximately 3 months ( 6 months+ 3 months ) totally time line will be 9 months. I mean really it is fast track..? Please if anyone knows where i can raise my concern please let me know. I am very disappointed now with the process speed.
    Please please please do something with the process timeline.

      Hi Akhila, do you mean the approval procedure of the Federal Employment Agency during the fast-track procedure for qualified professionals? The approval of the BA is deemed to have been granted if the BA does not communicate anything contrary within one week: The Foreigners Authority complies with the deadline. Ok thank you.
      But I already applied for BA and now after two months still didn't get any information.so my employer tried to find out why its delaying and they got a answer that due to the current situation in india they are not able to provide BA(zav).
      Is that right or not?
      What do you think, kindly reply me 🙏
