    The judge did not overstep at all. He advised the defendant that he needed legal counsel instead of representing himself. Dumbellicus refused because he had watched several episodes of Perry Mason but decided to act like Benny Hill. The judge was very lenient with him, he didn't get what he deserved, which was 30 days for contempt.

    The judge didn’t overreact. When you represent yourself you are supposed to be held to exactly the same standard as a licensed attorney. If an attorney started asking the judge stupid questions that they were supposed to know the answer to, the judge would go ballistic, just like he did here.

    Choo choo your way down to the law library and start learning the 3 easy steps to defending yourself. Step 1. Realize that you are in trouble with the law and your freedom and/or pocketbook is at stake. Step 2. Realize you're in over your head without a life preserver. Step 3. Hire a lawyer or get one appointed if you can't afford to hire one.

    There was no bond recommendation from the prosecutor, the judge says he didn't think he was a flight risk, he has no criminal history..... but he didn't know to ask for no bond, or a lower bond than $5000. LAYUP. Your arraignment is basically only two things - bond/bail conditions, and your initial plea to the charges. That's it.

    I think the guys change in demeanor after getting dressed down like that fully justifies the judge tearing him a new one. He needed to learn the importance of respecting the court, and it seems like he did.

    The only thing that would make sense is if you were found guilty and your fine was a thousand dollars but if you were innocent and your lawyer bill was 2000 dollars then it's a no brainer!

    There is a theory that it's an 80% guilty rate because the judges, lawyers, and professional legal staff involved in the case will throw the book at that person to teach them a lesson, and that's not just for sovereign citizens. I had heard of this happening before 2020.

    It is worth pointing out that the UK has two separate legal sovereign territories, Scotland and the Kingdom of England which includes Wales. Scots Law is more similar to the FrancoGerman system based on codified Roman style law. Sovereign Citizens fail hard in Scotland. Their entire script is reliant on using snatches of terms and words that sound legal. The legal language in the Scots system is so different Sov Cits are just shouting gibberish. Also the legal foundation of police authority is quite different. Police are an extension of the court system and Sheriffs are actually a type of local judge. Their arrests and court appearances tend to short and brisk.

      German here, and indeed we don't use common law. We use civil law, specifically a form of Germanic law from what I can gather, and all police (including investigative police) are led by each of the 16 state Ministries of the Interior respectively, and the same with the Bundespolizei (federal police, aka the former Bundesgrenzschutz) and Bundeskriminalamt on the side of the Federal Ministry of the Interior. The only exception are (obviously) the Feldjäger (aka military police) which is part of the Armed Forces, the Bundeswehr, thus under the Federal Ministry of Defence.
      Scotland is not the only place where it's a mix of civil and common law. The province of Québec, Canada uses such a mix that is based on Napoleonic law, same does apparently the state of Louisiana in the United States. Where I live in Central America, civil law is used and based on Napoleonic law, and regular blue-uniformed police is a ministry of its own with the Ministry of Public Security, while the investigative police is led by the Ministry of Justice.

    It's obvious why these Sovcits choose to represent themselves. Any real lawyer they speak to will tell them to drop the Sovcit arguments because they have no basis in law. The defendant doesn't want to hear this and doesn't believe it and cannot find any lawyer that is willing to do what they want.

    Usually sovcits don’t want attorneys because licensed attorneys cannot make the legal arguments they want them to make. Any lawyer that stood in front of a judge and spouted sovcit nonsense would end up in jail for contempt. They want a lawyer that will claim no jurisdiction, or “traveling not driving”, or “no injured party so no crime”, or any of the other brain dead theories these fools espouse. A lawyer must represent his or her client but they can’t claim defenses that they know have no basis in law.

    I don't know but I would speculate that the conviction rate for ALLLLLL defendants who go to trial is over 80%. Typically DA's do not take loosing cases to trial.

    Re: "study" that shows higher conviction rates for self represented defendants, correlation does not imply causation. Possible, for example, that defendants who are guilty and where the evidence is overwhelming don't bother to hire an attorney because they think they would be better saving the expense and using their cash for something else. Perhaps it's the case that pro se defendants are convicted more but receive lower penalties or shorter sentences - maybe it's a good strategy to accept an easier conviction if you are guilty but go pro se to get a lighter sentance.
    I don't know if either of these things are true, but I know it's not as simple to say "pro se defendants are convicted at higher rates therefore attorneys are essential to have." Maybe your study addresses some of these situations but based on the way you presented it, I think your conclusion is potentially premature.

    So lets be honest public defenders aren't terribly better rates. They're just gonna push you to plea out and not even try to defend yourself. None of these guys are choosing between big name expensive firms and defending themselves. They're choosing between the public defenders office, who's going to be overworked and not at all prepared to take on an actual case that goes all the way.
    Until we see plea deals get shut off it's going to continue to be a nightmare for people like that.

      If this guy's car has accident damage, they got his plate number as he drove off and they stopped him 5 blocks from the scene, yeah, the public defender is going to try to get a plea deal.
