I have a contractor that was paid 25% ($8,000) for a foundation job and then he split after doing dirt-work and forms. I am currently taking them to court because they agreed to pay back $5,000 but haven't. They never gave me their W-9 and I doubt they will. I have requested it multiple times and am now going to fill out the 1099-NEC and leave the TIN/Social blank, but I didn't withhold any money so can I leave that blank too? What is the fine or issue on my side of things? Thanks

Missing instructions on which copy goes where and how to get it to the IRS; which forms to send, etc.
