  • The plaintiff says she and the defendant lived together, but her ex-roomie still owes her for old utility bills she never paid, so she’s suing her. The defendant says the plaintiff told her she didn’t have to pay for oil in the house, and she insists she owes nothing.

    That plaintiff lied about the verbal agreement to not pay for the oil. U can tell but the judge had no choice bc of the writing.

    I def think she Sued out of spite of not getting the Dog. I think the plaintiff did tell her not to worry, because why would she alter the 2nd month to month lease with that SAME change? It’s just weird.

      I want to know what kind of luxurious home she’s living in. I rent a 2 bedroom apartment in San Diego just 1.5 miles from the beach for the same amount this woman is paying to rent a room. Yeah you have to pay your fair share but I’m thinking this woman was taken advantage of.

      Yeah on the East coast where I reside we have pretty cold winters and some houses have heating boilers that run off of a special oil that ranges between $400-$600.

      @@stonew1927 While I agree, what she described wasn’t abuse. Putting a dog in ‘time out’ by crating them isn’t abuse, it’s a way for them to be disciplined. Now if she were screaming/hitting/kicking a dog, then I’d classify that as abuse. You’re not training a dog at that point, you’re scarring them

      No, it can work. You must vet your prospective roommate to ensure they're compatible with you and have steady employment in order to pay the rent. Some people just throw up an ad on Craigslist and accept any nutjob off the street because they're too lazy to do the research. Personally, I wouldn't let that defendant in my yard, much less share my apartment with her.

      @@michellehard83 I was just as confused as you were. I had to do some research. But, apparently some people heat their homes with oil instead of gas. I never knew. I personally don't know anyone who does this but I guess it's becoming a more popular option.

    The defendant is full of it. It is quite normal to pay half of ALL the utilities when you are a roommate with one other person. I don't get the excuse that she did not have any money as if that clears you from paying with you owe.

      In NH and many other states, no one can demand parts of bills that are based on usage such as heating bills without separate meters for each person. Internet and cable is something else, that's a flat fee monthly.

    Oil is SO hard to tell people how much it will be. I had an oil stove for a couple of years. One year it would be $400 to fill up my tank then the next year it would be $600 then back down to $400 then on year it was $900. That’s when I switched to a wood stove. Oil prices are usually around the cost of Diesel Prices. So if Diesel is up so will oil.

      I rented a home where the cost to fill the oil tank was often higher than the cost of the monthly rent. That was during the Gulf War so, some parallels as to what we are seeing today.

    Home heating oil is basically dyed diesel fuel, meaning untaxed for road use. Home heating oil is generally whatever the local diesel fuel cost is minus the road tax that's included at the pump, usually .80 to $1.00 less than the price at the pump. Heating oil is still very common in Ohio, Indiana, Kentucky, Tennessee..etc. The current price per gallon in central Indiana is $4.17 per gallon and most standard tanks are 275 gallons...a complete fill up at that price would be almost $1200.

    Heating oil is absolutely NUTS. We rented a 1950's house with crummy insulation and we paid over $2,500 in the winter for heating oil ALONE.

    Trying to evict someone in New York is an non-landlord friendly process. A judge will allow a tenant to live rent free in you space for an additional 6months to a year b4 they finally remove them from your place. And good luck trying to collect the back rent and/or lawyer fees. Ha!! This is why so many landlords are so particular with who they rent to.

      I used to work in foreclosures in NY, and you'd be surprised at how many chances people get to pay when they're clearly not going to. Settlement conferences have to be held before you can get a judgement to foreclose on the house, and we had files where they would have 15/20+ conferences. You get to the point where you wonder when a judge is going to realize these people aren't making an effort.

If I can’t walk into a boutique and walk out with clothing or a grocery store with food with just a promise to pay back when or if I get around to it, I shouldn’t be able to live on someone else’s property and do the same. Some ppl sell items, some ppl sell ideas, others sell housing and should be compensated for it like every other market.

    She should have got the change in writing. The fact that the new lease had no oil being charged implies that’s what they were doing. Just doesn’t prove it. Lesson learned

      Yes, oil is very expensive. I used to work with Energy Assistance and next to propane, oil is the most expensive type of heating.

      That is the plaintiff's point of view; we have no idea if she is really "mean" or not. I got the impression she treated the dog more like a pet than a person and the plaintiff did not agree with that.

    The defendant leaves the court room agreeable happy and cheerful, even though she ''lost'', the plaintive got her money but comes out STILL BAD MOUTHING THE DEFENDANT, NOT CONTENT that she won the case because she just had to get those miserable insults in.

    So you can afford an extra 100 a month for oil.
    Do you understand that they don't feel oil once a month? That bill is probably 3 to 4 months worth, which is a lot less. Go to a hundred a month a bum is a bum
