      The questions about the ammo, storage and condition of readiness of the firearm are irrelevant to the discussion as it doesn't matter if he walked around his house chambered with his finger on the trigger. Just like asking if he knew it was James outside the door, another erroneous query.
      IT'S MY HOUSE.
      MY LEGAL FIREARM GIVEN TO ME BY MY F.I.L. IS LOADED WITH LEGAL AMMUNITION.
      SOME DUDE WAS ATTEMPTING TO FORCE HIS WAY INTO MY HOUSE AFTER I TOLD HIM TO LEAVE AND WARNED HIM I WAS ARMED.
      Any questions regarding how the gun was stored, kept and fed are only asked for one reason.

    I’m a lawyer. Never ever make a statement without speaking to a lawyer. This guy was protecting his daughter. He still got charged and he still was put in front of the grand jury. He was not indicted. We lawyers are there to protect your rights. I know you hate us but we can’t help you unless you let us.

    As a former police officer, NEVER NEVER NEVER talk to the police without an attorney!!! They will pretend everything is fine and they are your friend. Some of them are, and alot of them, especially in this circumstance will understand. But do NOT take that chance. EXERCISE YOUR RIGHTS!! That chance may be the only one you get that can change your life forever!

      @@megamonster1234 it's such a gray area because it seems wrong to lie and play psychology games with people who are especially innocent. But sadly that is the way alot of bad people get caught. However the lesson is the same whether you're guilty or innocent having a legal representative will massively change the tone of the interview/interrogation. That's why there's hardly any videos of it, because detectives can't use any of that GOTCHA garbage

      What's wrong with the police department pressing charges against this Father who was well within his rights to protect his home from a home invasion by his daughter's ex bf. The ex bf didn't break down the door just to talk!!! when told to leave! when warned by the homeowner that they have a gun! The ex bf was asking for what he got!

      @@DearMe247 They didn't. Even when it is self defense prosecutors must bring it to a grand jury and they grand jury decides whether to prosecute or not. Since killing someone is a Felony it is up to a grand jury. The purpose of a grand jury is "to determine whether or not there is probable cause to believe that one or more persons committed a certain Federal offense within the venue of the district court."

      The young man in question thought it would be a good idea to habitually use hallucinogenic drugs, which destroyed his sanity. It's in the interview with the daughter. She said his personality changed completely.

      I wish we had information on the autopsy report and if any substance was in his system. He looked out of it.. like he was not himself or under some influence of something. I do not think he was fully aware of what he was doing. However, that does not excuse the fact that he was breaking the law and that the response he got was the full meaning of 'stand your ground'.

    Police are not asking questions out of curiosity they are attempting to formulate the basic elements of any crime by your own admission. Never (especially in this situation ) speak to police without your attorney. NEVER

      Let it be known that nothing you say to police can *ever* help you at court. It is against the rules of evidence to use the accused's words to exonerate him. Whatever you say to police, it can only ever incriminate you, in can never exculpate.

      Most people don‘t know anything about the judicial system and dont understand their rights. It is so sad to see the poor family beeing interviewed right after the tragedy happened. The police detectives should be ashamed, not to recommend a lawyer and explain that the accusation of killing someone , even in self defence is pretty serious

      @@LadyBirch even if you don’t have a lawyer, you tell the police (politely) that you’re not going to answer any of their questions without your lawyer present, even if you don’t have one on hand, by law they have to stop the interview until you have one present. Don’t volunteer any information just go find a law firm and get a lawyer

    Never talk to the police without a lawyer. There are plenty of people who have killed or wounded in self-defense but still ended up in jail because at a terribly confusing time where you're coming off a adrenaline high(not a good type of high) and you might say something wrong that may forever taint your case.

    As a retired federal agent for 32 years, you ask to go directly to the hospital to be treated and then contact an attorney immediately. You never give a statement while you’re recovering from a critical incident. Your adrenaline and blood pressure will be through the roof and there is a good possibility that you will make a mistake in your statement. You have to have an attorney!!!!

    My dad was in law enforcement for 36 years. He told me if I was ever in a situation where I was being interviewed/interrogated to remain silent until I had an attorney present even if I'm innocent of any wrongdoing. You never know how they will coerce you or twist your words.

    It doesn't matter how long the kid was outside the door, on the porch, trying to get into the house, anytime someone breaks down your door, they are not there to sell you girl scout cookies, they are there to harm you! You are allowed to defend yourself, even in California, where most in other states would think otherwise. The Dad did what he had to do

    I took criminal defense classes in college. The first things lawyers tell you is, don't talk to law enforcement, hire an attorney, because all they're trying to do is to incriminate you. They may act like your friend, or pretend that they understand you. All they're trying to do, is to build a case against you.
    I don't think the dad did anything wrong, he was protecting himself and his family. The perpetrator was damaging private property in order to get to his daughter. If he's capable of damaging private property, who knows what else he's capable of.

    I read an article where Mr. Rayl's sister was demanding justice and did what everyone seems to do when in denial, praised his virtues and ignore his flaws. While I cant imagine loosing a loved one the evidence here is beyond obvious. The man was trying to break down the door to a home he didn't own and didn't belong at, it was never going to end well and it was by his own doing he is dead.     For all new gun owners, NEVER TALK TO POLICE WITHOUT AN ATTORNEY PRESENT.
    It's not to say the detective is out to hurt the poor guy or ruin him but without an attorney, you never know how the prosecution will read and use your statements against you.
    It's especially in these self defense cases that you never speak without an attorney, for your own safety

    As a person who has never been in trouble I would feel urged to speak to detectives. However, thank you to these channels I know better now. I now would NEVER EVER speak to detectives without an attorney. Most cops/ detectives are dirty and will do anything to get what they want.

    Been an officer for 28 years and I tell everyone to have a lawyer present when questioning even if your in the right... Better to be protected. you see where the officer was asking a lot of questions and some that might have sounded as leading. in this case when officer asked about the calls, did he go outside, and where he got the gun or placed it afterwards, any little thing like that is fishing to see if he is guilty like knowing this kid was coming over and he intentionally shot him, etc... to many variables here that a lawyer will pick up on and advise you not to answer as it may lead into where DA will accept and or draw up more charges on you even if you were 100% in the right to protect yourself and others. it is your right to remain silent use it.
    even on car stops you ask them if you know why I pulled you over and you may end up admitting to other violations (though those that were misdemeanor the officer has to visually see those to charge you with them, however we all know there are bad apples everywhere and one could take that as an admission and he could could lie and say he witnessed it) no reason to really answer any questions that do not pertain to why we are talking to you...

    One thing right that second cop said was "good thing you had that ring doorbell" YES or you would be facing murder charges right now. In this situation the police ARE NOT YOUR FRIEND!!!! USE YOUR RIGHTS!!! You have the right to have an attorney present. This guy has probably never been arrested before and thinks if he tells the truth he will be ok, nothing could be farther from the truth. and don't forget about your gun because they will take it and NOT return it unless you ask for it, believe me I'VE been through this myself already.

      Depends on the situation always best not be put in a situation where you could be judged by 12. Look at the two who pulled guns on the woman with her daughter after an argument in a store. They were both charged maybe they get out of it likely not they could have just gotten in their car and called police waited. DA's charge because they have no downside to charging citizens with crimes where defendant risking everything. IMO the prosecutor should be held liable when a defendant is found not guilty.

    As a retired LEO, I have to tell you that I saw a lot of people get charged with manslaughter or murder after they made their statement after they thought they were in the right after they stopped the threat. People, Like everyone here is saying, It is a must to have a lawyer with during questioning. Police can quickly find a loophole in the story, and you are done. Please again, Get a lawter.

    I’m sure I’m in good company when I say, as a law enforcement officer I would have aggressively hinted at this man requesting legal counsel before any of this took place. When the responding officers conducted an after action, they relayed what went down during this event. They told this investigator that this was a defensive shoot and the shooter was upheld within his rights under the Castle Doctrine. I personally feel that I wouldn’t be able to let this man go on without an attorney.
    I’ve worked in investigations for quite a while, one poor choice of words can force the investigator to reclassify you as a suspect. My instructor told me during a training where I am told a scenario and I have to attempt to mislead detectives, “you can easily be the most intelligent person in the room, but you will never be the most prepared.”
    Lawyer up, every single time.

Cops can kill someone for a cellphone that makes them fear for their lives in broad daylight, but others have to prove their innocent from an armed intruder breaking into their house. If you're actually a cop, you need to talk to all the judges, mayor and every other cop that you see everyday and stop this corruption. If (again) you've even law enforcement, you would of hinted and say it like you're the hero when it's your brothers in blue, doing the bs. Why not just tell your brothers to stop this?

    The daughter’s boyfriend was dangerous. He was trying to break into her residence despite calls to stop and being informed that the father was armed. No one knew if the boyfriend was armed and the father had every right to defend his family. The father may or may not have saved his daughters life THAT day. But there’s a good chance he eliminated a future threat and one when he would not be there to defend his daughter.

      If you shoot someone, whether you think you were justified or not, you should be investigated hard. That's the job of the police. It's not the job of the police to determine guilt or innocence.
