    In a case judge did not deal my argument and even did not mention the evidence favouring my client.i think every lawyer should file a written argument so that a judge can not

    • @LegalInspiration
      @LegalInspiration  Год назад

      Dear viewer,
      Thank you for your comment and for sharing your experience. I understand your frustration with the judge's handling of your case and the feeling that your arguments were not given proper consideration.
      In situations like these, it can be helpful to consider filing a written argument with the court. This can ensure that your arguments and evidence are clearly documented and considered by the judge.
      However, it is important to note that the rules and procedures regarding written arguments can vary depending on the jurisdiction and the type of case. It may be necessary to consult with a local attorney or seek guidance from the court to ensure that your written argument is filed properly and meets all necessary requirements.
      In addition to filing a written argument, it may also be helpful to seek out opportunities to improve your oral advocacy skills. This can include attending seminars or workshops, practicing with other advocates, or seeking feedback from judges or experienced lawyers.
      Ultimately, the goal is to present the strongest possible case for your client, whether through written or oral advocacy. By being proactive and seeking out opportunities to improve your skills, you can help ensure that your arguments are given the consideration they deserve.
      Thank you again for your comment and for your commitment to effective advocacy.
      Best regards,
      Adv. Nahush Khubalkar

    Thank you Sir, for explaining this complicated issue in a layman language. Sir , we would be grateful if you could upload a video on written statement. I have a query. Can we quote legal provisions and case laws in a written statement?

    • @LegalInspiration
      @LegalInspiration  Год назад

      Dear Subhash Jarodia,
      Thank you for your kind words and I'm glad that you found my explanation helpful. As for your query regarding written statements, I must clarify that as per the first rule of pleading, a written statement should only plead facts and not law. Pleading case laws or legal provisions in a written statement is tantamount to pleading law, which violates the first rule of drafting of pleadings.
      However, during the hearing of oral arguments or in written notes of arguments, you can certainly cite case laws to support your arguments. It is important to note that while citing case laws, you should ensure that they are relevant to the case at hand and add value to your arguments.
      I hope this helps to clear your doubts. Thank you for watching my video and for your continued support. If you have any further questions, please feel free to ask. In my available time I may try to answer them.
      Best regards,
      *Adv. Nahush Khubalkar*

    Pls aap domestic violence act case me protection officer sirf wife ke bayan ke aadhar par bina koi investigation kiye yani jaha gharelu hinsha hone ka bataya ja raha he vaha visit kiye bina, respondent s ki side sune bina aur responds ke statment liye bina only wife ke bayan ke aadhar par DIR report banakar pesh kar dete he jo normally abhi sabhi protection officer ki practice he.... Jab ki mere knowledge se yani me jitana janta hu ki protection officer ko jaha gharelu hinsha hone ka bataya ja raha he yani husband ka ghar vaha visit kar, ghar ke logoke statment aur aas padosiyoke, friends ke statment record kar wife side and husband side ko sunaneke baad DIR report banakar court me pesh karni chahiye but abhi only wife ke statment ke base par DIR report banakar court me pesh kar di jati he.....
    Pls sir aap detail me bataye as per laws DV ACT me DIR report kese banai jati he .. usse releted kuch case laws ho wah bhi bataye and folse DIR report kese challenge kare bataye.... Pls sir this topic detail vedeo banaye 🙏
