I believe that for Pakistan to be stable courts needed to be consistent e.g. for complete justice the SC should have not just ordered the voting to take place, but to decide the matter of the party rebels, as it was the talk of the town. It did not. So the Vote of No Confidence was held and the Govt lost.
Those same rebels votes became controversial in the Provincial election in which PMLN gained the majority, and the matter went to court. The SC court ruled party members cannot rebel and took action against them, their votes were deducted.
Remember that in the Vote of No confidence the Speaker ruled that the matter could not proceed to a vote as evidence came to light of a foreign conspiracy. The matter was taken to the SC and it ruled that the Vote MUST TAKE PLACE, and gave a timetable. IMPORTANTLY, THE COURT ORDERED THAT ALL THINGS HAD TO BE RESET TO THE TIME BEFORE BEFORE THE ACT OF THE SPEAKER’S RULING, almost a week before.
Then consider that, we have just had the decades old Zulfiqar Ali Bhutto case re-opened and decided by the SC. Here the original decision was overturned to correct a historical wrong.
So courts regularly do this. Though normally on the basis of a review or appeal.
But it is for so called ‘complete justice’ that they take this step.
But for the Vote of No Confidence on 9 April 2022, the issue of the rebel votes has not been re-visited. And at every future juncture where the opportunity arose to right this wrong, the opportunity was not taken.
You commented that CJP Bandial tried hard but faced difficulties from the military. I have no doubt about such interefence in the justice system. The only answer to such pressures is to speak out, much like abuse victims, and to down tools. The justiciary should have announced to the nation that they cannot and will not work under such circumstances. I believe the world would have paid attention. The Govt would not have a leg to stand on if our justiciary protested, since all agreements and monetary systems revolve around the SC providing the legal basis to the country.
Without consistency in judgements, you introduce randomness. Any judge gives his decision or makes out an order, the next CJ makes out his order. And each order starts to seem personal and political. This divides public opinion and causes divisions. When in fact the SC is meant to use evidence to give a decision that people can understand and gather around.
Thus sacking PM Yusaf Gillani for not obeying a court order SHOULD MEAN Shahbaz Sharif should be sacked for not obeying a court order. Again there is inconsistency.
I do not consider personalities when looking at cases of wrong doing, only what they have done and the strength of the evidence.
This is all my points were about - the clear and obvious inconsistencies in the decision making, obviously as a result of pressures. But that is what the job description says Chief Justice of Pakistan.
