You are so ignorant. Civil Asset Forfeiture is actually fraud. Mislabeling property "The Defendant" when the property owner is known then taking their stuff is fraud and/or theft (crimes). The owner is responsible for the property. Government ends up skipping out on Due Process and forces the owner to prove the property is not involved with a crime when no crime was ever stated (like some kind of scam). Skipping out on Due Process is Unconstitutional (unlawful). Seizing property without Due Process is also Unconstitutional (unlawful) and also counts as theft or Larceny (felonies) as they never proved the property was involved with a crime. Republicans are having "law enforcement" unwittingly commit fraud. Racketeering (organized crime) could also apply. If they get caught they can invoke qualified immunity or plead mentally incompetent. More than enough proof of mental incompetence.
thank you for bringing this deep problem up to the light. this process needs to be stopped totally in all states period. let me know how a regular citizen can help.
Let's face it folks, Law enforcement in the U.S. didn't have a wholesome start to begin with, as an armed arm of big business and government. Therefore, no one should be surprised with this latest round of insults to our civil liberties. It should be equally unsurprising how cheap the price is to convince law enforcement to cross the legal line.
There does not have to be any crime at all for this kind of theft to go on. Oklahoma police complicate all your money in your credit cards right on the side of the road. This entire thing is totally outrages.
Complete garbage. The government runs amok. We need to pass a bill that all money's and the property's taken for victimless crimes all of it is given back to law-abiding citizens at the end of each year. Not any civil servants.
As much as I support law enforcement and want to understand these sheriff's points of view, I think this would set a dangerous precedent. The ultimate outcome of something like this will inevitably affect EVERYONE not just it's intended target the drug cartels. Good intentions don't make good public policy. There's got too be another way to take the advantage away from the cartels and give it to law enforcement. Secondly I do believe that the war on drugs needs to come to an end or at least be drastically revised.
There is too much profit on the supposed war on drugs, but when you have certain agencies advocating for drugs being here, but want no accountability for enabling their existence here, there will always be scapegoats to divert your attention away from the actual culprits. Smoke and mirrors.
Dear Mr. Paul....I have been a fan of yours for decades. You are living proof that some (not many) politicians are aware of the limitations of state power...as laid down in the federal and state constitutions. However, I am still looking for some person with political knowledge and experience who will expose the government's secret legal theory regarding civil seizures. It is a fair question: "Who..amoung the political class has the intellectual courage to expose the states reliance on Admiralty Law as its underlying rationale for civil seizure"? I reference the federal case: "Bennis v. Michigan" where one of the federal justices said: "We can seize your car because we can seize a ship at sea." This fundamental truth has long been known by the judicial system...but the public is largely ignorant of this "fact of law". But you sir are well respected and loved by true Americans and therefore might be the ideal person to "liberate" this fundamental truth. Wishing you well. Earl.
Forget about what the constitution promises or the laws states. It your god given rights to defense yourself from thieves. Who care about due process or new legislation, you have a right to live and defend yourself from tyranny.
I think (and hope) President Trump either has not took a good look at this law or has been misinformed by one of his advisors. I would not think that he would be allowing this if he did know all the facts and just how wrong this law is being used. If he I aware of the truth then he just lost a whole lot of credibility with me!
Oklahoma state police have swipe thing installed in there cars that allows them to swipe your debit car or any card and see what's in your account and withdraw all of your money in your account and it goes into the state of Oklahoma's account . Your savings and paycheck are taken because the officer thinks you might have done something at some time !
I learn something messed up everyday. NPR has a good article titled 'Device Lets Police Seize Digital Cash, Raises Civil Liberties Concerns' on these devices known as ERAD's. Police Department and the company that makes the devices argues that they can only seize money on prepaid cards, but there are a lot of people that don't have Bank accounts and legitimately use prepaid cards and without any meaningful oversight, what is going to protect their money from the inevitable advise of this unconstitutional practice?
Brian MacKay No, it was never a good idea. The Founders knew that and so it was explicitly BANNED in the bill of rights. They had suffered those abuses under King George (all three of them and their predecessors).
You don't even have to be a suspect to have you property seized. Just have a large some of money, like bank deposits in your possession. What has Mr Paul done besides speak out about it.
Nice, neo-nazi cop in fake uniform boo hoo need a conviction to steal. Sorry guys, the horror stories of your goons out on the highways shaking down tourists and other innocent travellers - pure extortion and fascist behavior. Suck it up. Baby man Trump using this crowd to push his 'above the law' agenda is odious. The courts are there for exactly this reason, the USA has a Constitution and if he or anyone else doesn't follow it, they WILL be there to call you out and put you away if necessary.
It's what I called retribution Look What U demons did to the original people of the Americas you thought you can get away with it you reap what you sow
Only from non-citizens. For everyone else, there is NO such thing. No drug war, or any other craziness. Only ID required, then the CITIZEN will hear, "Do you need help? Have a nice day, please move along."
Why are people blaming 'law enforcement'? Aren't the 'idiots' who make these laws responsible? I never believed it was right neither. Get rid of 'stupid lawmakers'!
They blame law enforcement because law enforcement is the one who uses it to take and line their own pockets. Yes, the legislators who enacted it are to blame for allowing it to happen. But lets' be honest here, who is more at fault? the person A who handed a gun to person B, or person B who used to gun to go on a shooting rampage? Yes it's horrible that the cops were given the power to seize in this way, but its worse that cops would use this power on the innocent simply to line their own organizations pockets.
How many politicians have pulled over normal people and took their money. It's the cop's that have decided to line their department's pockets with innocent people's money.
It's best to AVOID carrying large sums of cash on you anyway; the standing advice, besides the danger of losing the "wad", is being ROBBED. However, I never dreamed the "Robbers" would have BADGES. If you're in a situation where you must carry a wad, even briefly, keep it on your PERSON at all times, preferably in an inconspicuous manner. If the money is in a glove box, they have greater latitude to conduct an impromptu search, BUT, if it's on your person, they MUST either arrest (and have probable cause not related to the cash, as carrying cash is not itself a crime nor it is considered 'reasonable suspicion' of same) and then conduct a bodily search incidental to the arrest, OR, get a WARRANT. If the cop does a "pat-down" to perform a cursory search for concealed weapon (aka "Terry Stop"), and he asks you what you have, you do NOT have to tell him, nor VOLUNTARILY produce it! Many of these horror stories have resulted from law-abiding citizens naively trusting the police and volunteering that they had cash; they were surprised that the cops just take their dough w/o even questioning them further or pressing charges! It's obvious that in many of these podunk locales that civil asset forfeiture is just a lame excuse to rob passerby and get away with it. Some may think of hiding the cash in a secret compartment, and while that might be successful, IF indeed it's found, then there's a HUGE problem...for one, the fact that it was concealed in secrecy might of itself convince a judge that it was the fruits of nefarious activity and therefore be subject to seizure. Also, many states, CA included, consider the existence of a hidden compartment to be a FELONY of itself, even if it's a feature from the factory!
If you think not carrying large sums of cash is the solution wait till you hear this. Back in 2016 police departments acquired a device called an Electronic Recovery and Access to Data (ERAD) which can be used to freeze and seize funds from prepaid credit cards only (supposedly). NPR had a good piece on this titled "Device Lets Police Seize Digital Cash, Raises Civil Liberties Concerns"
ANY ACTIVE WORKING CASE ON DRUGES, AND CRIMES BEING COMMITED. BUT AN AVERAGE CITIZEN NO WAY , THEN IT BECOMES PURE THIFE. ANY AGENT THAT DOES IT SHOULD BE JAILED, FOE STRONG ARM ROBBERY, FBI,POLICE,OR ANY OTHER AGENCY.
we must keep in mind, as long as the drug pushers can profit there will be drug pushers. I agree with civil asset forfeitures, though the law could stand to be tweaked a bit.
Mmm Hmm..."tweaked a bit." This is America, dumbass. Taking a non-criminal's assets, at tremendous expense and stress? Go back to Cuba or wherever, please sir.
Salute to Ron Paul, truly a great American!
David Basset WOULD HAVE VOTED FOR THIS MAN. But it gives Them SON OF A BITCH DEMOCRATS TOO MUCH OF AN EDGE.

This is why I voted for Ron Paul twice.
I didn't. You were wise, I was not.
Ron Paul. You the man!!! I can’t understand how the Supreme Court ruled this to be legal. Are they smoking crack
Lol "equates?" No no no, it literally IS theft.
Ron Paul was Amerika's last hope. God save us. Seriously.
The only way that has really ever existed is to find and follow the narrow path to Yahshua
Next hope is Tulsi G.
Ron Paul, the greatest president we weren't allowed to have.
One of the few things I agree with Ron Pual on is that taking property before a conviction is theft.
Ron Paul is the best!!!!!!!!!!!!!!
thank you for bringing this deep problem up to the light. this process needs to be stopped totally in all states period. let me know how a regular citizen can help.
trump has to rethink this civil forfiture,,he might be a one term president
Might?
They will offer someone that is even worse.
Any way we look at it we loose inthis world.
Except to find and follow the path less traveled to Yahshua
This didn't age well sadly
Trump is slowly loosing me as a voter
Their excuse is that you are not the suspect, your property is and your property has no rights... Greed doesn't care about freedom or integrity.
Time to legalize marijuana and put some drug dealers out of business.
It is NOT about the drugs.
It is about a corrupt legal system the suck money from hard working citizens.
they didn't tell the prez that if they didn't have drugs they still take your cash
Civil asset forfeiture and qualified immunity need to go
In a free country with a free society, what a citizen puts in his or her body is his or her own business! Kill the drug war and defund The DEA!
Stealing is stealing, it's wrong no matter who's doing it, we must protect our rights and way of life.
There does not have to be any crime at all for this kind of theft to go on.
Oklahoma police complicate all your money in your credit cards right on the side of the road. This entire thing is totally outrages.
I think that if there is no conviction than the government official that violated that person's civil rights shall forfeit his or her life.
You think this bad wait they want arrest you because they think you might commit a crime. And just put you in jail no trial.
What is the best way to calm down a heated debate between Republicans and Democrats? Ask them to debate about Civil Forfeiture.
Ron Paul. We need you to stand up for the average guy.
Complete garbage. The government runs amok. We need to pass a
bill that all money's and the property's taken for victimless crimes all of it is
given back to law-abiding citizens at the end of each year. Not any civil

trump has a lot of hotels to get forfeited
If he is not part of the solution he is part of the problem.
As much as I support law enforcement and want to understand these sheriff's points of view, I think this would set a dangerous precedent. There's got too be another way to take the advantage away from the cartels and give it to law enforcement. Secondly I do believe that the war on drugs needs to come to an end or at least be drastically revised.
There is a simple solution: legalize all drugs then there will be no more drug cartels.
There is too much profit on the supposed war on drugs, but when you have certain agencies advocating for drugs being here, but want no accountability for enabling their existence here, there will always be scapegoats to divert your attention away from the actual culprits. Smoke and mirrors.

Trump really let us down on this one
time to take these satin workers down
What about gun confiscation? I have some very valuable guns.
I want to hug Ron Paul.
Forget about what the constitution promises or the laws states. It your god given rights to defense yourself from thieves. Who care about due process or new legislation, you have a right to live and defend yourself from tyranny.
Now I guess ya understand when a pig gets blown away doing a traffic stop........I feared for my life....that is there BS line.....
I think (and hope) President Trump either has not took a good look at this law or has been misinformed by one of his advisors. They collect a lot more
Once again a good idea is abused by law enforcement.
Brian MacKay No, it was never a good idea. The Founders knew that and so it was explicitly BANNED in the bill of rights. They had suffered those abuses under King George (all three of them and their predecessors).
Totally bad "idea". It's anti-American.
how can this be happening?
Trump is way off on this.
Sheriff of Nottingham is running a muck.
I am a liberal who supports Ron. Rand is just a Republican, but Ron is a real classic liberty minded guy.
You don't even have to be a suspect to have you property seized. Just have a large some of money, like bank deposits in your possession. What has Mr Paul done besides speak out about it.
Ron Paul should’ve been president ::
Nice, neo-nazi cop in fake uniform boo hoo need a conviction to steal. If they have a job they have a right to have that money they say that money is there money that's a lawsuit
Don't keep no cash on you that's a lawsuit that'll put a stop to that
Ron Paul is the greatest President that America was not allowed to have.
So are prescription drugs and sometimes, they more dangerous.
Big government is bad government. Especially on a national scale.
I always knew Rand Paul was a cartel leader.
It's what I called retribution Look What U demons did to the original people of the Americas you thought you can get away with it you reap what you sow
No seizure violation of constitution
Only 100,000 comes into victorville city budget
I agree with Ron Paul on this. Good work.
NOT EVERYBODY IS NOT A DRUG DEALER...
More cracks in the Republican armor are showing and getting larger.
Only from non-citizens. For everyone else, there is NO such thing. No drug war, or any other craziness. Only ID required, then the CITIZEN will hear, "Do you need help? Have a nice day, please move along."
+kart2454 Thank you for the insults. I see you do not understand a HYPOTHETICAL comment. As in this would not apply to citizens.
Only from "non-citizens" are you daft?
And to think we have "freedom".
Ha ha ha....
You telling the truth Mr paul
Brother said thieves with a badge and gun
...because they are equal.
make cops prov what they say by a lier test to prove it
Btw is it a crime to resist forfeiture? I mean your not under arrest so your not breaking THAT law.
I didn't the President jump on the wagon. ? .
make cops take liers test to prove what they say and do on there reports
It's call communism. Use the right word please.
Government won't stop the making booze? Isn't that weird.
Criminals
I'm out
Sickem Paul.
This was enough to swing me away from being a trump supporter. This is just fucking common sense.
Why are people blaming 'law enforcement'? Aren't the 'idiots' who make these laws responsible? I never believed it was right neither. Get rid of 'stupid lawmakers'!

Nothing positive has ever came out of Ron Paul's mouth.
Jirah J .... You're full of SHIT.
yeah maybe what is going on is not positive
Sarcasm lol

Hahahaha
So they should return illegal drugs????
No they should legalize so none of it would happen in the first place.
Or They should keep it once they are convicted of wrong doing. Otherwise return everything except illegal drugs
