      You are so ignorant. Civil Asset Forfeiture is actually fraud. Mislabeling property "The Defendant" when the property owner is known then taking their stuff is fraud and/or theft (crimes). The owner is responsible for the property. Government ends up skipping out on Due Process and forces the owner to prove the property is not involved with a crime when no crime was ever stated (like some kind of scam). Skipping out on Due Process is Unconstitutional (unlawful). Seizing property without Due Process is also Unconstitutional (unlawful) and also counts as theft or Larceny (felonies) as they never proved the property was involved with a crime. Republicans are having "law enforcement" unwittingly commit fraud. Racketeering (organized crime) could also apply. If they get caught they can invoke qualified immunity or plead mentally incompetent. More than enough proof of mental incompetence.

    Let's face it folks, Law enforcement in the U.S. didn't have a wholesome start to begin with, as an armed arm of big business and government. Therefore, no one should be surprised with this latest round of insults to our civil liberties. It should be equally unsurprising how cheap the price is to convince law enforcement to cross the legal line.

    There does not have to be any crime at all for this kind of theft to go on.
    Oklahoma police complicate all your money in your credit cards right on the side of the road. This entire thing is totally outrages.

    Complete garbage. The government runs amok. We need to pass a
    bill that all money's and the property's taken for victimless crimes all of it is
    given back to law-abiding citizens at the end of each year. Not any civil
    servants.

    As much as I support law enforcement and want to understand these sheriff's points of view, I think this would set a dangerous precedent. The ultimate outcome of something like this will inevitably affect EVERYONE not just it's intended target the drug cartels. Good intentions don't make good public policy.
    There's got too be another way to take the advantage away from the cartels and give it to law enforcement. Secondly I do believe that the war on drugs needs to come to an end or at least be drastically revised.

    Dear Mr. Paul....I have been a fan of yours for decades. You are living proof that some (not many) politicians are aware of the limitations of state power...as laid down in the federal and state constitutions. However, I am still looking for some person with political knowledge and experience who will expose the government's secret legal theory regarding civil seizures. It is a fair question: "Who..amoung the political class has the intellectual courage to expose the states reliance on Admiralty Law as its underlying rationale for civil seizure"? I reference the federal case: "Bennis v. Michigan" where one of the federal justices
    said: "We can seize your car because we can seize a ship at sea." This fundamental truth has long been known by the judicial system...but the public is largely ignorant of this "fact of law". But you sir are well respected and loved by true Americans and therefore might be the ideal person to "liberate" this fundamental truth. Wishing you well. Earl.

    I think (and hope) President Trump either has not took a good look at this law or has been misinformed by one of his advisors. I would not think that he would be allowing this if he did know all the facts and just how wrong this law is being used. If he I aware of the truth then he just lost a whole lot of credibility with me!

    Oklahoma state police have swipe thing installed in there cars that allows them to swipe your debit car or any card and see what's in your account and withdraw all of your money in your account and it goes into the state of Oklahoma's account . Your savings and paycheck are taken because the officer thinks you might have done something at some time !

      I learn something messed up everyday. NPR has a good article titled 'Device Lets Police Seize Digital Cash, Raises Civil Liberties Concerns' on these devices known as ERAD's. Police Department and the company that makes the devices argues that they can only seize money on prepaid cards, but there are a lot of people that don't have Bank accounts and legitimately use prepaid cards and without any meaningful oversight, what is going to protect their money from the inevitable advise of this unconstitutional practice?

      They blame law enforcement because law enforcement is the one who uses it to take and line their own pockets. Yes, the legislators who enacted it are to blame for allowing it to happen. But lets' be honest here, who is more at fault? the person A who handed a gun to person B, or person B who used to gun to go on a shooting rampage? Yes it's horrible that the cops were given the power to seize in this way, but its worse that cops would use this power on the innocent simply to line their own organizations pockets.

    It's best to AVOID carrying large sums of cash on you anyway; the standing advice, besides the danger of losing the "wad", is being ROBBED. However, I never dreamed the "Robbers" would have BADGES. If you're in a situation where you must carry a wad, even briefly, keep it on your PERSON at all times, preferably in an inconspicuous manner. If the money is in a glove box, they have greater latitude to conduct an impromptu search, BUT, if it's on your person, they MUST either arrest (and have probable cause not related to the cash, as carrying cash is not itself a crime nor it is considered 'reasonable suspicion' of same) and then conduct a bodily search incidental to the arrest, OR, get a WARRANT. If the cop does a "pat-down" to perform a cursory search for concealed weapon (aka "Terry Stop"), and he asks you what you have, you do NOT have to tell him, nor VOLUNTARILY produce it! Many of these horror stories have resulted from law-abiding citizens naively trusting the police and volunteering that they had cash; they were surprised that the cops just take their dough w/o even questioning them further or pressing charges! It's obvious that in many of these podunk locales that civil asset forfeiture is just a lame excuse to rob passerby and get away with it.
    Some may think of hiding the cash in a secret compartment, and while that might be successful, IF indeed it's found, then there's a HUGE problem...for one, the fact that it was concealed in secrecy might of itself convince a judge that it was the fruits of nefarious activity and therefore be subject to seizure. Also, many states, CA included, consider the existence of a hidden compartment to be a FELONY of itself, even if it's a feature from the factory!

      If you think not carrying large sums of cash is the solution wait till you hear this. Back in 2016 police departments acquired a device called an Electronic Recovery and Access to Data (ERAD) which can be used to freeze and seize funds from prepaid credit cards only (supposedly). NPR had a good piece on this titled "Device Lets Police Seize Digital Cash, Raises Civil Liberties Concerns"
