She's definitely willing to break the rules if she thinks there won't be any significant price to pay. (Remember Gillingham, or even Pamuk?) But her marriage with Henry, even if it has ups and downs, means something to her.

If leaving something behind means less misery for you, why wouldn’t you do it? To be fair to Mr. Barber, while he knows she is married, he also knows that marriage isn't going well. She compared him to her "perfect" husband and called her current one a "good helpmate." She also didn't answer the question of if she loved her current husband. With all that information a fair assumption might be that Henry's extended racing tour may involve infidelity. That being the case Mary might be open to a relationship with him. That's why he asks. He's infatuated and a bit of a romantic.
