Mam ek confusion tha ki in case theft k liye kisi ko suppose 3 year ki hi saza hui and in default 9 month extra . Now total exceed 3 years as his power u/s 29. To kya 30(2) ye keh ra h ki even that magistrate can pass same sentence in total even if it exceeds his power. Kya default ka sentence + max sentence uske power k aage kia ja sakta h by same magistrate under sec 30(2) Hope u got my question

Ma'am , if the offence is punishable with more then 3 year so why will jnfc will try the case of 393 and if he will not try it so default of fine also cannot be given by him ?

No imprisonment for default in payment of fine in case of life imprisonment because he is spending whole of the remaining life in imprisonment, and court can levy fine by realisation of offender’s property according to section 70

Life imprisonment can be abolished by watching the good behaviour of the convicted person....then if life imprisonment reduced to 14 years then the punishment for default of fine will be added to that 14 years....most of the time life imprisonment reduced...

its maximum 7 year punishment, but he can give upto 3 years, if he need to give more he has to commit the case to higher magistrate
