  • In this lecture, I provide a brief overview of the tort of negligence, and its place within the law of torts. I also begin to explore the idea of the duty of care. The 2003 Civil Liability reforms to the law of negligence in Queensland will also be discussed. This lecture and lectures 3 to 6 of this series of lectures on the Law of Torts, will focus on the tort of negligence.
    By watching this video, you should be able to:
    • Identify the basic elements of a negligence action with reference to both common law and the Civil Liability Act 2003 (Qld);
    • Discuss and explain the role and meaning of ‘duty of care’ in the tort of negligence;
    • Explain the Australian approach for establishing duty of care and have an understanding of the various control tests and limiting factors used by the Courts;
    • Apply your understanding of duty of care principles to fact scenarios; and
    • Discuss the different views on the role of policy factors in establishing negligence actions.
