    hi boss I have a trial on 12/13/16 in NJ, I was pull over for driving while suspended but I received the DMV letter 4 days after I was pulled over, I when to court and told the judge but he wouldn't listen because the DMv envelope doesn't have the post office stamp on it, he insisted to tell him if i was gilty or not, I told him I can't plea guilty for something I didn't know so he gave a trial date listed above. my question is what are my odds by going by myself since I cannot afford an attorney.

      Sorry I don't know the answer to that. I have never practiced law in NJ so I am not sure. But I can tell you that most criminal defense attorneys do free consultations so I would shop around and meet with a 2-3 local NJ attorneys. Even if you have no interest in hiring them, you may learn some pointers and get an idea of whether its possible. If getting this type of case is super easy most of the attorney should tell you that they will get the case dismissed. If the lawyers aren't confident that they can win, then you are probably not in an easy-win situation.

    If the PWC police pull over for speeding and check traffic court, why do they check violation of state instead of county? It was inside city limits (route 1), not on the interstate.

      charging under state law makes things administratively easier for the courts sometimes, but most counties or cities have a law the adopts the state laws or empowers local authorities to enforce state laws so that the county doesnt have to reinvent the wheel when it comes to traffic laws. this isnt always done but often.

      Passing a moving emergency vehicle with activated emergency lights is a form of criminal reckless driving in Virginia. Passing a parked one on certain highways requires moving over or slowing down if that is not possible

    Hello, I have a trial in about 3 weeks. Its a running a stop sign ticket. I was wondering if you can help with the mitigating evidence. My defense is that the limit line was faded. I have pictures of the limit line from different angles and they are indeed faded. I want to know how I should prepare for trial. Should I bring this up during trial or during sentencing? An will this defense work in my favor.

    I was going 50 on a 30, but the officer was nice and wrote 40 on a 30. How do I fight this? Especially with the officer being nice to reduce it in the first place?

      Depends on the jurisdiction you are tickets in but here in Va we routinely go to court on behalf of clients who have already received breaks on the side of the road. Each case is unique and you just have to see whether "fighting" it makes sense in that particular situation.

      Depends on the case and depends on your definition of win. We don't keep track of any percentage but when someone comes to us for a free consultation we tell them what we can achieve and we cannot achieve and we are rarely wrong.

    I just got pulled over for expired tags and no insurance and have been summoned to appear in court Feb 25. The officer checked yes on correctable for expired tags but not for insurance. What's the best way to defend myself in court? This is in the state of California

    If the officer has the wrong weather conditions and wrong vehicle color is that ground for dismissal

      Simply making a mistake on the ticket by itself does not mean an automatic victory under Virginia law but some times it can be use to win a case but this depends on the fact of that case. The most common way that it helps is that it can cast doubt on the accuracy of the officer's testimony.
