For every crime committed, there is always a penalty that is imposed. A law will not be a penal law if there is no penalty (fine or imprisonment or both) prescribed for the crime committed.
Hello. Thank you for this explanation, Fiscal! Clarification lang po on rape, wherein marriage of the offender with the offended party would extinguish criminal action. But in the footnote of the codal, it was stated that rape is already deleted from Art 344. Does this mean that the deletion of rape in said article is only with respect to the filing of the complaint?
Since rape is no longer a crime against chastity, the 3rd par. of Art. 344 insofar as rape is concerned no longer applies. This means that the police can pursue the case (i.e. file a complaint before the fiscal) even without the consent of the offended party, her parents, grandparents, or guardian. Also, the mere express pardon by the offended party (rape victim) will not extingush the offender's criminal liability. The only way by which the offender in rape can be pardoned is when the offender marries the offended party (victim) as provided in the 4th par of Art. 344. This will have the effect of extinguishing the criminal action or remitting the penalty imposed. To answer your question, the 3rd paragraph no longer applies to rape but the 4th paragraph still applies.

RA 10951 is a law that merely increases the amount of the fines for certain felonies in the RPC. Since it increases the penalty of fine, it will not be given retroactive effect except nalang if it is favorable to the accused. Wala pong kinalaman o hindi po maaapektuhan ang article 22 dahil hindi po sya kasali sa amendment. At hindi pa rin po kasali ang habitual delinquent kahit na ang epekto ng retroactivity ay papabor sa mga convicts.

I have a Police Cover Up Case. I cant make a Police Report because I would be reporting the Police Felonies made against me? I get no Due Process after the robbed me my Boathome over a dead battery. I paid their demands prior to lien sale but when I got my boat back it was gutted and destroyed. No reason! I need help. I need an Attorney. Could you help me re 1st, 4th, 5th and 6th Amendment Rights Violations. City of LA.

Hindi po tataas ang penalty of imprisonment. Magkaiba ang criminal sa civil liabilty. Pag hindi nakabayad ng danyos ang offender, papatawan po ng interest at 6% per annum ang danyos from the time the judgment of conviction became final until fully paid.

@@FiscalEJ to clarify lang po, if in cases of seduction, abduction and acts of lasciviousness, if the victim pardons the offender even if the victim does not marry the offender, the criminal liability will be dissolved? And if during the pendency of the case it will be dismissed, or when the offender is serving the sentence, the offender will be released?

What do u mean by "is given after the criminal action"? U mean nung pinardon ng victim ang accused, natapos na ang paglilitis ng kaso?
