    When you do a regular search warrant on a premises, you search everything to find incriminating evidence. This also covers information on a phone or computer. Of course, they search for everything on the phone/computer. Incriminating evidence doesn't appear in neon bold text, it's hidden in with all the other data. This guy is totally incorrect and appears to not understand the basics. There are procedures if you think items were wrongly taken during a search warrant. Suing is not one of them. It's a publicity stunt. Lindell is in serious trouble and he is using diversion/delaying tactics to find clear air in a smog. Best of luck with that.

      No when you do a search warrant on someone's premises, you have to specify what you're looking for and where on the premises you expected to be. you can only get permission to search that general area. Such as we believe this to be in the master bedroom well you're warrant will specify that you can only search the master bedroom. Very rare have you ever seen a Warrant say you can search the entire premises you have to know what you're looking for and where you believe it to be

    The problem with Dersh's opinion (& others like him) is that they will claim any political figure who is being questioned, searched &/or investigated is a target because of their politics whether or not they have evidence of that.
    It is entirely fair for an attorney to say they want to ensure that a search warrant was properly ordered. However, claiming that it was not a proper warrant before they have proof of that is, in my opinion, unprofessional. Dersh also knows that law enforcement can physically surveill a person of interest, witness or suspect without a warrant as long as it does not invade their privacy.
    Also, he knows questioning must only be stopped after a person is arrested & asks for an attorney and that everyone is free to decline to answer questions from law enforcement.

      If they are tracking him down via cell tower data they need a warrant for that. Lindell asked to call his lawyer and FBI refused. 5th Amendment violation. They took his phone and kept it when their warrant is only for certain communications on that phone. Another 4th Amendment violation.

This is a hail Mary so he can pocket millions by selling his soul once again. Lindells hoping for some of that Epstein magic from him

      @Tio Swift you’re wrong look if you google “does a warrant allow for detainment” you get this “Some limited authority exists for law enforcement to temporarily detain occupants of the premises to be searched subject to the warrant.”
      Obviously it would allow time to actually retrieve the evidence. You think someone can just drive away or not answer the door? Hahaha
      Look he already lost the case, so I’m not sure why you think that 😃

    OK where was the violation of the Constitution in this case they had to go to a judge to get a search warrant and present evidence to the judge they needed that phone And the evidence had to be valid in a court of law
