    I made the mistake of letting the cops search once. An hour after they left I got everything off the side of the road back into my car. Never again.

    • @justaskin8523
      @justaskin8523 Month ago +23

      One of my friends consented to a search of his car, and the cops found a gun under one of the seats. Under Florida law, he would have probably been fine if he had a Concealed Weapons Permit. But he didn't have that permit and so Florida law sees such a firearm as "too accessible" to somebody without a Florida CWP. So he got hung out to dry, and lost not only the gun, but also got hit with a crime which took away his 2nd Amendment rights for at least 8 years. That was under the old laws before Florida adopted Concealed Carry for everybody, so I don't know how it would be today.

      I was pulled over a few days ago. When he asked if he could search my car, I told him not to put one thing of mine outside the car. He also told me that him and his wife argue about him always lying. Then he told me that he's lied all the time. Without a license plate, I drove away without a ticket. He was just hired there, and I told him to always honor his oath, and he'd remain one of the good ones!

      @josephpoorman9871 In any situation I'd quickly let the them know that is it my duty to know as much as I can about the laws that could affect me and my Constitutional rights. And yeah, I know cops will say "what are you? some kind of lawyer?" The fact is every single person residing in the country has a duty to themselves to have basic understanding. It's been a long long time since I've been pulled over by a cop and they would ask me where I had been and where I'm going. Ask me now and I'll tell them quickly it has nothing to do with their stop and I'm not talking except to tell them to write the ticket and let me go. I am also not the kind of person to keep a lot of crap in my car for a cop to be interested in. I do not consent to a search, write the damned ticket as I can go.

      Ain’t it ironic and hypocritical that they mock you if you display any basic understanding of the most common and basic criminal statutes or traffic codes and assume you can’t possibly know or understand the law when the information is right at our fingertips and we have a genuine interest in educating ourselves to stay out of trouble while they have next to zero training on the statutes and codes and have little interest in educating themselves because they’re almost never held accountable when they don’t know a law or misinterpret it? It takes 4 years of college plus 3 years of law school to be an attorney to practice law but it only takes 6 months at most to complete the training at the academy to become a law enforcer.

States are passing laws, you can't use nervousness, glassy eyes, or slight confusion. Plead the 5th loud and clear, then say nothing. If you are not breaking the law and are clean, you will have a lawsuit in a jury trial if he arrests you and pulls you out, etc., all over a simple traffic violation. He just broke about five laws, and all over a ticket and his periodnoid suspension. A lawyer can win if the ticket is the only law you broke, so don't fight back, zip your mouth, and say the 5th! facts. I tell everyone I can!

      If you are not being detained, then they cannot stop you from leaving. If they stop you from leaving you ARE detained. So, test that after asking. If they say you are not detained, then ask if you can leave. If they say yes, then leave. If they say no, then IMMEDIATELY exercise your right to remain silent, to refuse a search, and ask for your attorney, and fight it in court.

    • @1000FeatheredOwl
      @1000FeatheredOwl Month ago +6

      Goes back to what Jeff is saying, that detainment is based on the principle that a reasonable person would not feel free to leave. If an officer tells you something like “You’re not detained but I just need you to answer a few questions for me before I can let you leave,” then that’s a detainment. Invoke your right to remain silent, right to legal counsel present during all questioning, deny consent to searches, ask for the officer’s supervisor (since the officer is incapable of providing clear instructions), ask for their badge number, and remain silent while you wait for the officer to arrest you or for the supervisor to arrive and determine if you need to go free or if there’s enough probable cause for an arrest.

    • @foxracing8973
      @foxracing8973 Month ago +15

      @RogerW9421not to mention there was a case that ruled that a stop couldn't be extended to bring out a drug dog bc a cop has to legally be working on writing you the ticket, ect...not just sitting around waiting 30 min for some dog to get there. Even if they do still bring a dog you can guarantee they will claim it alerted to something even if it didn't. They wouldn't bother going through all that trouble just to tell you it didn't alert to something. It's how they get away with then having the ability to search your car.
      Record everything with your phone from start to finish! There have been multiple videos I've seen of cops pulling drugs out of their uniform and throwing it into your car then walking back and claiming it was yours. The problem is most ppl are being distracted/talking to another cop and/or not recording the whole process so they get away with it.

    One point I would like to add. If you turn your phone off, and then back on, it will require a pin or password to unlock. Biometric unlocking can only be done after the first manual unlock. So if your at the airport or otherwise about to be searched, turn your phone off.
    Some versions of Android (like Graphene OS) allow you to set up a security/duress pin, that when entered into the lock screen, will immediately lock down and erase the phone.

    Back in 87 I got pulled over in an industrial park. I was just driving around the park because my girlfriend and I used to "park" there. I was missing my girlfriend who had just flown home. Suddenly, lights. Cop pulled me over wondering if I was casing the place. But once he spoke to me he could tell right away that story was legit. I was opening my centre console to get my documents out and I took a beer bottle out and explained I was taking it back to the brewery the next day because the cap was somehow melded into the glass and couldn't be opened safely. I called the brewery and explained and they said bring it in and I'll get a dozen free.
    Anyway, I showed it to him and he didn't say anything. Just nodded and took my documents then ran a check, came back and handed them back to me. Then I was on my way.That was a good reasonable cop. It all made sense to him. Anyway, next day I went to the brewery with my messed up bottle of beer(Oland Export) and got a free case of beer. Man, I remember that like it was five minutes ago and here it is 2026 now. Anyway, Labatt bought them, changed the recipe and I stopped buying it. Man, Oland Export was the king of beers in Nova Scotia.
    Life really does go by fast. Just feeling sentimental tonight. Don't mind me, I'm a retired senior. Sober 15 years now.

      Yeah, I was served a warrant with no name or address on me and my home searched with me held at gun point. They couldn’t find anything so they brought something in from their car and charged me with it. The whole system is messed up. No way to prove my side as we didn’t have cameras and such. It’s good to have lots of them all around your home and car just to protect your interests. Cops are DIRTY, CROOKED, SCOUNDRELS. NEVER TRUST ONE! Should have been thrown out of court just because of no name, no address on the warrant. Some lawyers and judges are just as bad. I know mine was. If you are poor and can’t afford an attorney you are really screwed. My children witnessed all of it and remember it. They are in their 40’s now. They have never trusted our system or a cop since. In California, they can't start with, "Do you know why I stopped you?" anymore. Assembly Bill 2773 prohibits police officers from starting traffic or pedestrian stops by asking, "Do you know why I stopped you?". Officers must now state the reason for the stop before asking any other questions, aiming to reduce "pretextual stops" and de-escalate interactions.
    But, the question is dumb, because my answer was always something along the lines of, "because you're a cop, it's in your nature" or "because you're a jerk" or "what? Do you think I can read minds?" or "who knows why you cops do anything?"

The phrase signifies completeness, like a comprehensive service that handles all aspects of a project from start to finish, just as a full dinner covers the whole dining experience from start to finish.

    Probably your best single explanation of what to do when dealing with cops. This is the video I'll recommend to anyone who wants to know.
    I do have one question, though. Most of us don't have a lawyer on retainer, so when we say "I refuse to answer a question unless my lawyer is present," what do we do when the cop, who has our phone or has us in detention says "fine, get your lawyer down here." I assume they have to let us make a call, eventually, but who do we call when we know nothing about finding a lawyer?

    • @gentoolikesfish
      @gentoolikesfish Month ago

      it doesn't matter. You don't have to materialize a lawyer on the spot. The point is 1. get them to shut up 2. if they don't give your eventual lawyer ammo to use against them.

    We must return to Common Law and ditch Maritime Law. These are just legalized land pirates preying on those who have a right to travel freely. They need to be public servants, not highwaymen who extract wealth from the common traveler.

      "Officer, can you read the motto on the side of your car?"
      "To protect and serve."
      "Good. Now can you justify trying to arrest me for driving home? How is it protecting me? How is it serving me?"

  • @DigitalRenegadeStudios

    4:36 The minute they traffic stop you, you are being detained by definition. So, you should never answer any questions. Additionally, if you think you can just start answering questions then suddenly stop whenever they ask a question you don't like, think again. They can use your silence against you to infer guilt. Salinas v. Texas, 570 U.S. 178 (2013). So just keep it simple and to every question, just say, "I don't answer questions." But remember you do have to present your paperwork (license, etc.) if driving and you must exit the vehicle immediately if asked for any reason (Pennsylvania v. Mimms). The police don't have to give you their reasons.

    Read this. I avoid cops, if I can, like I would avoid a gang of thugs who were after me. Once they have you cornered, they got you by the balls, and once you're "in the system," your life is no longer your own. I am not a lawyer, and I haven't been to cop school. All this information is too overwhelming and impossible to absorb to the point where you can verbally defend yourself at a stop. So don't try. They are trained to trick you. Somewhere along the way, they will trip you up. It's what they do. I view cops as narcissists with badges, and they will do everything in their power to cause you more strife and hardship than life itself does. They can, and will. We are still under the Act of 1871, BRITISH law. BAR means "British Accreditation Registry," and is a falsified (bastardized) version of the original constitution. The justice system is an illegal and unjust group, as dangerous as junkyard dogs to the innocent. But we can't do anything about it unless you are one of the Brunson brothers. Never trust a cop, never engage with one, never look or wave at one. They can be like rabid dogs looking for a way to bite you after a wrong answer. They are essentially a necessary evil among us, so my takeaway and suggestion from this video is: Print out the last thing this lawyer tells you at the end and keep it in your glove box.

      Bar is not an acronym, it's a reference to the literal bar that marks off the immediate precinct of the judge's seat, at which prisoners are stationed for arraignment, trial or sentence.

      I think there's some truth to what you're saying, because the justice system is only as good as the people running it, and in certain places, corruption runs amok. But in my experience, and Im a little biased because my parents were officers, I think that the vast majority are not trying to victimize people, and don't even like enforcing certain laws they think are unjust. My parents for example, were personally against cannibals, but did not like ruining peoples lives for finding one joint in their glove compartment. Their supervisor suggested to simply use their discretion.

    Voicing your intent to remain silent is required to halt an interrogation, but simply staying silent works too. The cops can keep asking though, unless you tell them no answers and you want a lawyer.
    The scenario where you say A did it; B helped. And then the cops say "and what about you?" If you then go silent, can the cop say "he accused others but when we asked about him, he refused to answer."?
    Silence is one of the mosr powerful rights. Imagine living in a country where you don't have to lie to block an intrusive government witch hunt. God bless America.

    • @melissasmess2773
      @melissasmess2773 Month ago +1

      My understanding is that you can refuse to answer their questions but you're not constitutionally protected unless you invoke your fifth amendment right. Just remaining silent can leave you charged with refusing to answer question I thought. It's always nice to start this with "With all due respect officer, I'm invoking my 4,5,6th Amendment rights" then you can't speak again or your right to not incriminate yourself is no longer in force.

      @melissasmess2773 interesting... so you say there's a legal obligation to respond to a cop? Cop asks if you murdered a thousand people and you're legally obligated to voice a refusal to answer?

    If you invoke your right to remain silent, and then answer a question, do you have to re-invoke your right to remain silent? I seen a video where someone invoked their right to remain silent, and the cop asked if they were wearing their corrective lenses and they didn’t answer, remaining silent. So the cop ticketed them for not wearing their lenses. If the person had answered, would they have had to re-invoke the right?
