English criminal law is a system of laws and principles that govern the punishment of individuals who commit crimes in England and Wales. It is based on a combination of statutes and common law principles.
The theoretical elements of English criminal law include concepts of punishment, evidence, defence and prosecution, and criminalisation. These elements shape the foundation of the criminal justice system and guide the application of criminal laws.
To establish criminal liability, certain elements need to be proven. These elements include the actus reus, which refers to the physical act or conduct of the accused, and the mens rea, which refers to the mental state or intention behind the act. Various defences are recognised, such as incapacity, compulsion, and mistake.
English criminal law covers a wide range of specific criminal offences, including murder, manslaughter, sexual offences, non-fatal offences, and property offences. Each offence has its own elements and requirements for establishing guilt.
It is important to note that the information provided here is a general overview and should not be considered legal advice. The application and interpretation of criminal law can vary depending on the specific circumstances and jurisdiction.

I love your videos because they are a quick refresher for law students who just need a quick brush up and reminder on certain topics, and a good introduction to new students and those thinking of entering a career in the legal field. Keep it up. I do however wish one day we could have a longer, deeper dive into certain topics. Your videos are great for scratching the surface but always leaves me wanting to find out more.

Hi! I definitely get your point. The nature of teaching on this channel at the moment means I'm trying to get as much content covered as possible. This means that the detail is potentially lacking in some areas.
In the future I do definitely want to go into far far more detail on all these topics though!

@@thelawacademy1 that’s absolutely fine. Your short and sweet videos are enough to get me interested in the subject at hand so I tend to find myself doing more research myself. Look forward to the future.

I’m here to try and do my own personal research and looking for answers to a recent court ruling where I was a defendant, totally disoriented by the whole horrific ordeal and left drowning with little guidance or help / feedback from my solicitor . Unfortunately my brain can’t comprehend any of it as it seems to be constantly contradicting itself with multiple options leading to even more confusion. 😵‍💫

@@newagetemplar6100 I’m sorry to hear that. Law is by no means an easy to grasp or understand and even legal practitioners who have been in the field for many years are still learning new things every day. It isn’t something you can just pick up and understand, not meaning to offend or downplay your research in the slightest so I apologise if it comes across that way, I’m just speaking the truth.
If you are not happy with your solicitor, you can request someone different to represent you if you feel they have not done their job properly or skimming the details and not giving you correct and accurate legal advice, even if it’s a duty solicitor you can request someone else.
I wish I could help you but I am not qualified to give legal advice for the moment and I wouldn’t even attempt to because it can be so easy to give incorrect information and set you up for failure and anyone who is not qualified shouldn’t attempt to either, that’s another potential lawsuit waiting to happen.
I can give you reference material to help guide you down the correct research path for the section you’re trying to understand.

Doesn’t maintaining an assumption of mens rea (mens rea: the prohibited mental or fault element for the commission of a criminal offence. May include intent, purpose, wilfulness, knowledge, recklessness, willful blindness, criminal negligence, or negligence. Citation-Essentials of Canadian Law) violate the section 11 Canadian Charter right of three presumption of innocence?

So would I be right to presume that strict liability circumvents due process?

Hi! I'm not sure. I would have to research that in more detail.

@thelawacademy1 thank you. I have found much academic work that says it is. However, I am a Litigant in Person.
My studies of the law have taken me to Clerk and Lindsell 16-07, which I believe is a reliable authority..
I know this is an academic channel.
      Thank you for your reply.
I will not rely on any academic channel. The law will always now fascinate me. I will continue to read and study.
