Basically, his legal team is part of either the podcast production _or_ is some kind of go-between (not a 3-way call, but possibly call to his attorney, then phone passed onto the podcaster), so the calls are made a private attorney calls, which is why they're is no background noise. Since it's done through his legal team, and there's no specific CDCR policy blocking this specific thing, there's nothing the department can do about it. Per my conversation with AW Steadman, "So...basically they're exploiting a loophole?" "Yeah, pretty much."
