Hi! Thanks for noticing. Yup. It's just a typo error. The suggested answers were made in a rush, after I got hold of the questions and I made the video by reading from my notes. Caveat lang. They would be my answers if I also took the bar. No notes whatsoever. No checking the books or codals. So, I was not able to make the exact or perfect legal basis in the answers. Hi Zaira. Both void and voidable marriages terminate the marriage. Legal separation only separates the spouses from bed and board, but the marriage tie remains. In all three, the property regime shall be dissolved and partitioned. Also, in all three, the legitimate status of children shall remain. The exception is when the marriage is void for being contrary to law, public policy or morals, in which case the children shall be considered illegitimate.

It depends po sa ground. Kung ang ground is lack of parental consent, then it is from the celebration of the marriage. If it's grounded on fraud, then it is from the time of discovery of the fraud.

Sir, I have a question, if a woman married a man who had a valid marriage with his first wife unknown to her and the first wife did not act on it and after 11 years , the first wife died , is there a need to annul the marriage contracted by a woman to her husband if they plan to have a valid marriage ?thank you sir.
No, there is no need to annul the first marriage because the first wife is already dead. It would be moot and academic. But the widower must remarry the second wife after the death of the first wife because their marriage was bigamous while the first marriage was subsisting.

Kung di nila alam ang ginagawa nila at wala silang control sa mga actions nila, then the marriage is void kasi both of them were not in a position to give consent to the marriage. But if conscious and were capable of giving consent naman, then the marriage is valid.

Isa pa, I assume walang marriage license yan kasi hindi sila i-isyuhan ng marriage license kung less than 18 years old ang babae. Mag file kayo ng kaso para ma-cancel ang kasal nila. Hello. Kung nakaregister sa PSA ang kasal, kelangan mo ng court order para ma-cancel yun. Sa kwento mo, may basehan ka para mapawalang bisa yun. Dahil court lang ang makakapag utos para maka-cancel ang kasal mo, kelangan mo ng abugado para mag-file ng kaso sa court. Good luck!

Good day! Madami ngang grounds na mapawalang bisa ang kasal nyo. Yung sa walang parental consent, you should file the action to annul the marriage within 4 years from the marriage. Yung sa walang marriage license, you can file the action at any time, walang expiration date yun. Yung sa pananakit nya sa inyo, pwedeng kaso dyan ay legal separation at Violence Against Women and Children. Kumuha po kayo ng abugado para matulungan kayo mag file ng kaso.

If a marriage is null and void, wala syang bisa from the beginning and it cannot be ratified by the parties. Baka legal separation ang ibig sabihin. In legal separation, the marriage can be suspended but it can be reinstated if the spouses reconcile.

Hello. Kung nakaregister sa PSA ang kasal, kelangan mo ng court order para ma-cancel yun. Sa kwento mo, may basehan ka para mapawalang bisa yun. Dahil court lang ang makakapag utos para maka-cancel ang kasal mo, kelangan mo ng abugado para mag-file ng kaso sa court. Good luck!

If a marriage is null and void, wala syang bisa from the beginning and it cannot be ratified by the parties. Baka legal separation ang ibig sabihin. In legal separation, the marriage can be suspended but it can be reinstated if the spouses reconcile.
