    Really glad you spent time to share this! I really like preconstruction agreements because it gives me the ability to share reasonable expectations at defining the details, costs, and time frame all while knowing that I am not wasting time by not getting paid for this service. It is also a great time to vet the client and confirm how well trust can be established. Great job on this vid!

      Not sure where you do business, but I am here in the Bay Are. Did you use a specific template? I have developed my own, much like NS builders. I find the most challenging segment is "payment" the wording for the non refundable retainer is hard to get right. I am always curious how people word those sections.

    What a fantastic video, a GC here in the Bay Area, after years of wasting time with clients who run off, we started the practice of Pre Construction agreements, this video just made our a whole lot better. Thank you for putting this out here!

    Thanks for bringing attention to the need for contractors to be paid for planning projects. Please provide a link to the document when it’s available so we can refine our agreements.

    Great video Nick. Have gotten on your podcast and social platforms lately. I'm upset it took this long! Your videos really dig past the homeowner details and really help us other subs and tradesman looking to strive further. I try to push innovating products to my contractors daily. They just simply do not care about the homeowners longevity. Seeing higher GC as yourself go the extra step is something we need more of. Studying for my GC this year and really appreciate the time you take on all your platforms. Its educational, inspirational, and motivating. After 7 years as a siding sub, I have decided to put my foot down and become my own GC. Thanks for sharing all of your experience and knowledge.

    We primarily offer design + build; however, I can see this as valuable if there is an outside architect because they will and do need us to contribute. I am not sure our market is ready for something like this since so many contractors seem to consult for free or race to the bottom for pricing.
    It would be nice if contractors all came together and would mention to the clients that a bid-only arrangement will not get them the best product. You've inspired a new blog post (or video) depending on how much time that I have.

    I actually have this exact contract and modified to my liking. (Everything you read is pretty much verbatim to mine and I got it offline too!) I also modified it to read as a construction consulting only contract if someone wants be to consult.
    This pre-con agreement is fantastic!

    Looking forward to a future podcast where you explain “best practices” for finding that excellent lawyer that every podcast, on-line course and construction management book recommends that you consult with before using their template documents.

    Nick, I have been using a Pre Con agreement for months now, but I am having trouble on how to end the document, I have a quick Terms of payment section, showing the retainer required, then a signature, just wondering if anyone had insight on how theirs is laid out.

    @NS Builders , what takeoff software are you guys using,? You mentioned throwing a quick estimate in the takeoff software in the video, which piqued my interest being that all of the ones I have used thus far are what I would call clunky and seemingly inefficient for software, specifically, there are tremendous amounts of inputs required where it would seem many of the inputs could easily be prepopulated as a selection rather than data entry, that is one example of the disappointing aspects of TO software.

    Hey Nick, great video as always. We run a similar system but always looking for ways to improve. I'm curious on your retainer, if you end up under your projected hours on the design/management do you credit hours back or does that go as profit?

    I like the idea but aside from getting involved in the design process where is the benefit is the customer? It’s sounds unilaterally beneficially for the GC with lots of construction contract overlap.
    It’s almost like a letter of intent in the Commercial Real Estate world.
