The illustration of 91 (d) implies that oral evidence is not excluded from a verbal contract, which was not required by law to be reduced in writing. All contracts need not be in writing. For example, wedding catering contract & such other.

Anurag and Ravinder started a business for that they did a contract. All the terms and conditions of contract were written down between the parties. Both the parties were agreeing that if any dispute between them will be decided by arbitrator. Later on a dispute was arises between the parties. Anurag gave the written contract as an evidence that dispute will be decided by the arbitrator only not by the court. Ravinder wants to give the oral evidence that they are not intended that such types of disputes would be decided by arbitrators. Can Ravinder give that oral evidence as per the provision of sec 92 of Indian Evidence Act?

Arent 91 and 92 a bit different? Like 91 is a bit wider as it includes contract,grant and disposition as well anything reduced into writing whereas s 92 just includes contract,grant and disposition.

Section 91 donot includes anything reduced in writing. For eg. A deed of adoption will not come under section 91.
