    Atf stated the brace was OK.
    ATF re-iterated the braces were OK.
    Now they say it is a felony after nearly a decade of being on the market and millions of examples being sold.

      Right at the end he admitted that its not the brace, INFACT it is the long and short barrels that's attached to them!??!.

      What I think is weird is that the ATF director should be pro 2A. He should be looking to see that our rights are maintained and not just try to see if he can take guns away. He represents ALL the people of our nation and that means he represents the Pro 2A half of the nation as well.

      Rules are NOT laws. The Constitution states only Congress can establish rules. These agencies have been unconstitutionally given lawmaker status. The Congress has abdicated their duty so they don't have to do their actual job and they aren't blamed for unpopular rules.

    Ask any DA in the USA, and the first thing they will tell you is that “ignorance of the law is no excuse.”
    No prosecutor in this country will give a whit about whether you knew about a law before they put you in prison for the rest of your life.

      He is also lying when he says they wont go after you if you simply remove the brace from a gun and keep them apart. If they catch you with both items in your possession, even if they are separated, that is a felony also (intent to construct or something like that) so he is openly lying about that it will not make felons out of millions on this basis too.

      @@flockwitaglock2139 It is only one example. They shot and burned children alive in the past.Not much happened. No one was fired. In fact commendations were handed out.
      This is a deeper systemic problem than defunding or abolishing the ATF. It is cultural and societal and I think that we are past the tipping point of stopping the sheep from tumbling over the cliff.
      I think the best that can be hoped for is not getting dragged over with the mob.
      Remember Matt's case. You can blame the ATF for getting butt hurt. You can blame the judge for allowing some rather ridiculous theories from the prosecution. You can blame the prosecutor who enjoys absolute immunity but in the end there was a jury of 8 women and 4 men that voted unanimously for conviction of a non crime. That case was a first amendment case not a second amendment case.
      This is where WE are today. Standing on enemy territory in our own homeland.

    I appreciate the congressman calling ATF in for questioning, but I feel this is all for show, some unsuspecting person is going to get 10 years and nobody going to be safer or will any violent crime be stopped Congress needs to actually do something about the brace rule, because it’s going to take years to get through courts, people will be in prison over stupid rules not laws

      "Shall not be infringed on".
      Gun laws are an "infringement"
      definition: the action of limiting or undermining something. "Limiting" who can have a firearm and where,when by directly "undermining" the 2nd amendment.
      1st part "a well regulated Militia" was described as "able bodied men willing and able to take up arms if they should need to in order to secure and maintain a free state of living".
      The 2nd amendment was put in place to prevent (government) over reach from (infringing) on our (rights).
      This means police,military or reserves do NOT classify as "militia" as some argue becuase they are a "government" entity.
      Time for case law.
      Miranda v arizona "where rights secured by the constitution are involved, there can be no ruling or legislation which would abrogate them".
      South carolina v united states " the constitution is a written instrument,as such its meaning does not alter. That which it ment when it was adopted,it means now".
      Marbury v madison 1803 u.s. reports vol. 5 page 137
      This is one of the leading cases in the history of the united states of america, the opinion of the court was given by the honorable judge John Marshall cheif Justice on the supreme court. His opinion was anything that is in conflict is null and void of law clearly he said that "for a secondary law to come in conflict with the supreme law was illogical, for certainly the supreme law would prevail over all other laws and certainly our forfathers had intended that the supreme law would be the basis of all law, and for any law to come in conflict would be null in void of law, it would bear no power to enforce,it would bare no obligation to obey, it would purport the settle as if it never existed for unconstitutionality would date from any enactment of such a law. No courts are bound to uphold it and no citizens are bound to obey it. "
      It operates as a mere nullity or fiction of law, which means it DOESNT EXSIST in law.
      Nysrpa v bruen 2022 " the right to keep and bear arms includes bearing arms for personal protection outside of the home, current and future laws would be required to meet historical tradition"
      Mcdonald v city of chicago 2010 "the 2nd amendment is fundamental for self defense and applies to the states under the equal protection clause of the 14th amendment"
      District of Columbia v Heller "The right to keep and bear arms is infact an individual right, and no active militia participation is necessary to excercise that right.",
      1939 miller v. united states "military and militia style weapons are protected under the 2nd amendment"
      Plummer v. State was an 1893 court case decided by the Indiana Supreme Court. The case overturned a manslaughter conviction, ruling that the convicted defendant had been protecting himself from the illegal use of force by a police officer.
      If you are pro 2nd amendment you are pro 2nd amendment for everyone.
      if you are not then you are not pro 2nd amendment, you're pro 2nd amendment to those you approve of.
      All these gun laws violate the constitution period and people need to stand up to this.
      Absolutely every person in the United states has an equal right to keep and bear arms.
      It does not matter what some state law says or city law says it does not matter your background.
      your are a "person" and a "citizen."
      All state and city laws are bound by the constitution and if they are not they do not have to be followed as they are tyranical in nature.
      Every single gun law on the books is illegal. Nics background check is illegal,switch bans,magazine bans,bumpstock bans,assault weapons bans are all illegal.
      Every gun law legally has to go.

      It's actually the fault of our elected officials AND the people. They have allowed the government to get so big that that congress pawns off part of their job to different departments.     It is a brace, a harmless brace that allows the shooter more control, it does not empower the weapon, it does not make the rounds faster so WTF is really going on? They are opening a door they will bust wide open if given the chance.

      Out of all the constructive and worthy things that could be done, the ATF focused all their time and energy on this.

    I feel like the director keeps falling back to "we're only targeting criminals with this rule" justification. It seems like if you have to tag additional charges on someone for doing a crime with a pistol brace rather than a non-braced pistol, maybe you need to re-evaluate the severity of the crime in the first place. Seems what they used to commit the crime doesn't make it more or less grievous. Are we saying it's more OK to do the crime with a long gun than with a SBR? Does it matter if someone is murdered with a 9mm or a cast iron pan?

      It is the exact same logic that carry permits used. It was to prevent blacks from being able to carry guns. It was "understood" at the time of passage that the restrictions wouldn't be enforced against whites. Time just passed and people forgot.

    Even if you could brace a pistol on your shoulder, that changes absolutely nothing about the pistol. The caliber stays the same, the magazine stays the same, the barrel length stays the same. It's not a fcking rifle just because it has a stock! It's a pistol with a stock!

    Americans have the right to possess any weapon used used by it's military.
    Your arguments about the public not being allowed access certain weapons while it's governing body has been noted as attacking the constitutions and the people of America as the enemy.
    ATF has no authority to be the governing body of tyranical dictating. Furthermore telling Americans what alowed to possess, Canada will not stand for the mutiny either.

      @traczebabe that's really my point. I worded it poorly. I'm tired of all these hearings and the truth coming out, to then just die in the public info sphere.
      So they bitch and then get a clip and that's all.
      They never follow through.
      The other side does everything possible to push against these policies, but there's nothing ever done on this side.
      Just reminds me of the turtle McConnell "slow down." 🐌 "hold on now..." and allow themselves to be trampled.

    This will open up the Pandora's Box that any sighting device installed on a firearm deems the firearm more deadly due to higher accuracy. This includes notches etched along any top portion of barrel that can be used to alight the barrel to a target, installed iron sights, scopes, dots, etc
    Any extension included off of the breach or barrel of a firearm will be deemed illegal due to increased accuracy being in direct relation to being a more deadly weapon. This includes, grips, stocks, muzzle guards, foregrips, etc.
    Do they even listen to themselves... YES, but That Is Not Their Agenda.

      If I remember correctly the director said that if they have the brace off the gun then it wouldn't be believed but yet removing a brace from a rifle makes it a long barrel pistol which is illegal so in essence owning the brace on the gun is it going to make it illegal but removing it also makes it illegal and that guy doodlebach or doodle big whatever the hell his name is can't answer a simple yes or no and he knows nothing about guns or explosives so why is he the director

      @Danner Wrong..they have waived the $200 tax fee until the end of May...nobody accepting "Amnesty" is being given stamps, but a amnesty form showing you complied, no stamp is attached. The ATF inspects businesses, not private residences...I've had NFA items from late 88 and never once had the ATF at my door....they are already bad enough, we don't have to make them sound worse than they already are

      @@anthonyivy1305 I'm referring to NFA items in total. While they're pinky-swearing they won't prosecute you if you register, they also said these items were not NFA items. I wouldn't trust that an emboldened ATF wouldn't decide to ignore that promise, too, and go after everyone anyway whether you registered or not.

    my problem with ALL hearings is, no matter the subject - no one answers the direct questions. i think IMO if you don't answer the question it's 30 days in jail for each question not answered - and they take you out of your chair right in the hearing and incarcerate you for the determined length of time . maybe then these people will start answering . they fear nothing because there is no penalty. If they did it this way the information would flow like a river .

      How about a $10,000 fine the first time they don't give a direct answer. The second time is 30 days in jail, and if the person being questioned is a gov't employee, they lose their job and are barred from all public sector jobs for life.

    WTF are executive branch agencies doing making rules (laws) anyway? Per the US Constitution, Article I, legislation (creation of laws) is the province of the legislative branch. The raison d'être of the executive branch is execute the laws, not create them. They should stay in their F'ing lane. No wonder they're fighting over spending and debt ceilings. There's duplication of roles and effort and funding of massively staffed bureaucracies never authorized by the Constitution.

    Ive never used or seen a pistol brace and the ATF keeps saying this brace makes a pistol more concealable. I’m sure I heard that several times. Can anyone explain or correct me on this.

      It doesn't change much about the weapon except the ability for a disabled person to use one. It's not so much a loophole, but was a part that was allowed to be mounted to a pistol that the ATF said many times was fine. They recently decided to reverse that after millions have been put into circulation without much issue but now it seems that people with these without going through an extensive and expensive process will be susceptible to a felony and standard 10 year prison sentence. What upsets many is that most regulatory agencies like the FAA when they find a violation can suspend a license or something of that nature. This particular agency has the ability to dictate significant laws that should be left to elected officials.

      It isn't the brace that makes the weapon concealable, it is the size of the weapon. A RIFLE must have a 16" barrel, whereas a PISTOL has no restriction. In practice, an AR pistol might have a 10" or even a 7" barrel and be significantly more concealable while the brace is commonly shouldered like a stock. The real issue isn't whether braces should be legal, but with a constitution that says "shall not be infringed",....why are short barreled rifles illegal?

    This is the penultimate example of what's wrong with our government. This little weasel is repeatedly refusing to answer how he plans to do his job to his bosses in Congress. Show me any other job where your boss can ask you simple, direct questions about doing your job and you can repeatedly choose not to answer them and still expect to keep that job.     Here this ATF Director states that original evalation was specific to the brace that was originally introduce.
    After this inquiry, Congressman Thomas Massie literally pulls the original brace out the letter was referring to and asking him directly is this regulated now. MIC DROP. Absolutely eviscerated Dettelbach.

    Last week a pair of 18 year olds stole a car, ran a red light and killed the occupant of the other car. The two that stole the car were charged with a misdemeanor. So to get this straight, these two teens stole a car, ran red light and killed someone and they are charged with a misdemeanor and if you violate a gun law and don't even hurt anyone you could end up charged with a felony and in jail for 10 years. Maybe the ATF needs to be defunded and any rules they propose needs to be approved by congress. In short, take away their ability to make rules that impact anyone without proper vetting. Defund the ATF and remove their ability to make laws that impact gun owners.

    I will NEVER comply with ATF rules and regulations as they are NOT a law enforcement branch. They are an extension of the IRS that is supposed to regulate, and oversee the collections of Taxes on firearms tobacco and explosives! Once i pay the applicable taxes at the FFL/Gun store and leave with my firearm, the ATF can no longer tell me what i can and can not do with it. CONGRESS made laws saying what i CAN NOT do, which local police enforce. ATF IS NOT AN ENFORCEMENT AGENCY!!

Try to use the confusing and vague Form 99 from ATF to determine if your pistol conforms. And if you choose to register as a SB rifle, what happens if your application is denied? You have submitted a picture of your firearm and your fingerprints and personal info and now you have incriminated yourself as to owning an UNREGISTERED short barrel rifle. YOU ARE NOW A FELON.
