- The morning session of Day 25 of the ongoing trial of romance novelist Nancy Crampton Brophy is underway.
Crampton Brophy was arrested in September 2018 in the shooting death of her husband Daniel Brophy.
Daniel Brophy, 63, was killed as he prepped for work at the Oregon Culinary Institute in southwest Portland on June 2, 2018.

Apparently the defense has shifted their strategy from throwing random shit at the wall to see if it sticks, to throwing random shit at Andrea Jacobs to see if it sticks. Zzz...

This conversations between the Judge and defence are ridiculous.
Okay, I was giving them the benefit of the doubt , but the defense just straight up lied to the judge.
The prosecutor didn’t reach out to a lawyer seeking witnesses in jail. The lawyer they put in the middle of all this didn’t reach out to the defense lawyers, THEY REACHED OUT TO HER!!
...so this is Nancy's trial, its the other inmate thats on trial? What is this
I bet when the trial is over the jurors will say they gave very little weight to Ms Jacobs testimony during deliberations.
Why are all these women the same? Unprofessional, overly chattery and dramatic in Murder She Wrote kind of ways
Nancy talks too much & she’s super social so I completely picture her getting beside herself and slipping up. She can’t help it, she literally talks TOO MUCH!! And she showed her true colors in the recorded jail phone call too.
Nancy probably blabs the whole time she's in jail, but couldn't imagine anyone turning her in, for the reasons AJ said. Delusional, as in everything.

Maxfield is only doing this to resurrect what we all saw as an EPIC fail from 2 days ago. She wants this do-over to save her own reputation. She's making the HUGE mistake of calling attention to AJ's testimony.
In the meantime, AJ's fan club just added 1,000,000 more members. She's gone viral, for gosh sake.
I hope AJ is safe tho. N she did really look like she didn’t want to be there. Can’t really see why she’d want too, if she had a choice. N she really looked like she wasn’t of course proud of what she’s done in the past. Like they make it out she is.

Not true. He has made several rulings against the defense.
A diligent defense is necessary but why so many witnesses ask ,"what do you mean?" I am not stupid and its confirmed by these defense lawyers being so ridiculously minutely in the weeds that folks are lost. The defense has lost the jury by acting so shady .
@@maryspeth3469 - They may, indeed, be losing the jury by putting on so many witnesses and wandering far astray from the most important parts of the prosecution case, but I don’t think it is the job of the judge to rein them in, except within certain limits. The limits of relevance are not well defined, so some might think he is being very generous in what he allows. I expect the jurors will have a feeling for what is important and waste their own time on side issues.

The judge is probably giving them all this leeway so that they have no grounds for appeal. No judge wants their cases overturned.

Mr. Howard’s testimony segment was a parody of the defense’s entire case. Aside from the comedy of errors, it appears the defense was trying to get something (GSR info) into evidence the judge had excluded.
This is crazy. Is this just unlimited, has to how many tries the defence gets.

This was allowed because of the lack of preparation that the defense was afforded by finding out about Jacobs on 4/28/22. It’s a very limited scope.
The defense “ladies” are like yappy, annoying, little dogs just trying to wear everyone down. It’s exhausting.

If a witness hasn't studied the actual case, they can't speak on it. So you use hypotheticals.
Why is this trial taking so long? The defense attourney's have the personality of wet socks ..and the Judge is letting everyone else run this trial but himself! He cant make a decision on anything..snooze fest..cant wait for closing and the verdict, because I'm so over this

That’s just incorrect. He has made several decisions on contested issues, and usually decided them promptly.
This case is being decided by Judge Ramras with legal rulings on what is or is not allowed as testimony and exhibits. I don’t want NB to be successful on an appeal so I’m glad judge is listening to both sides. I’d say 80% of the rulings are for the defense.

Wrong. They are just doing their job and many defense objections have been upheld. The judge upholds them not because he favors the defense, but because it was correct application of the law. He has also ruled against the defense on some of their important motions, notably quashing a mess of subpoenas for attorney files, and has upheld prosecution objections. I am hopeful that he will not give defense a special instruction for inference. My impression of judge Ramras is that he is completely impartial in his performance of his duties. What he thinks privately I have no idea.
The defense keepz throwing up the appellate court. To me, it sounds like threats . They say it over and over.
@@GH-oi2jfI agree 100%. I’ve been impressed with the judge. Haven’t looked up the #’s but I’d bet he has a low %/ratio of cases where convictions are overturned on appeal.

Judges are terrified of the defense winning an appeal, yep you are right, rulings favor the defendant.
No, he wasn’t pro-defense. He’s an experienced, thoughtful & careful judge who wanted to ensure this case was tried only once. Better to err on the side of caution, give defense some leeway & have the conviction confirmed on appeal.
Judge Ramras was a prosecutor for 15 years before he was appointed to the bench in 2017. Prior to that he worked as a Justice Advocate and later as Area Defense Counsel in the US Air Force. It seems to me that Judge Ramras is properly making rulings in favor of the defense when it’s a close call out of an abundance of caution to ensure that NB gets a fair trial. I’ve struggled with many of the Judge’s rulings in favor of the defense throughout the trial but I defer to his knowledge, experience and expertise.
Am I missing something here? The defense's forensic witness says he was unable to determine the distance Dan was shot from. So he couldn't have told the defense, so they couldn't have told Nancy on the phone. Ergo, AJ cannot possibly have overheard that. What's going on here?
Only the shooter knows. And the shooter told AJ.

How many actual witnesses were in front of the jury this morning? Just one? The ex-prosecutor with the pixie cut?
Not much but desperate attempts by defense to sneak in whatever they could. Most were not allowed.

It is normal for defendants to waive that right.
Does anyone understand the function of a "proffer"?
It informs the judge what evidence a prospective witness has, so he can decide whether to allow the testimony.
@@GH-oi2jf Defense put up an attorney (pink jacket, blond bob) as a proffer. The judge had disallowed her testimony. What was with that?
@@sleuththewild - I suppose to see if she had anything new to add of use in the new context (sur-rebuttal).
Edit: I see that the judge said at the outset of her testimony here that she was excluded from the trial. I don’t understand why this testimony was needed, after all.
The reason the proffer is made, even when the judge has already decided the testimony will be excluded, is to ensure a full record is preserved for appeal. You can’t argue an error was made on appeal, if you didn’t make a record of the evidence that should have been admitted or excluded.
Such scrambled up coverage of this trial. So is everyone high there?

Was the part of NB's gun that was missing ever found? Was that part of the "ghost gun"?
Never found. I'm guessing it is in the ocean.
@@MaryContrary1 - The ocean is quite a long distance for that purpose. She might have just dropped it in a dumpster in the area of OCI or elsewhere.
It was not found. It had nothing to do with the ghost gun kit. It was an extra slide and barrel which fit the gun she purchased at the gun show.
Thanks for the responses. It's been hard keeping track of all the details of the case because the Defense has included so many imbecilic distractions.

Defense says that the witness Anndrea Jacobs overheard Brophy’s call on the lawyer phone when her attorneys told her about the GSR expert (who didn’t find anything)

I think the judge could see as well as the jury that NB is totally fuked along with the appalling defence so giving them every chance to show competency has to level it out with the shit hot prosecution.
Basically, you’ve summed it exactly. Seems many watching thought the judge was “pro-defense”. But he wasn’t. He was just very, very careful. Wanted to make sure this trial occurred only once & would be affirmed on appeal.
