সেনাবাহিনীর সদস্যদের সামরিক আইনে বিচার হয়েছে। সেনাবাহিনীতে চাকুরী সেনা আইন মেনে করতে হয়। কোন মুক্তিযাদ্ধাদের জন্য কোন আলাদা সেনা আইন নাই। বিভিন্ন আলোচনায় বুঝা যায় সামরিক/বেসামরিক সকল ক্ষেত্রেই তৎকালীন সরকার সম্পুর্ণ ব্যর্থ হয়েছিলেন।
কর্নেল তাহের কি তখন সেনাবাহিনীতে চাকরি করতেন?
সামরিক আইনে সামরিক শৃঙ্খলা ভঙ্গের অপরাধে কিছু শাস্তি দিতে পারে, তবে মৃত্যুদণ্ডের মতো সর্বোচ্চ শাস্তি সামরিক আদালতকে অধিকার দেয়া উচিত নয়। মৃত্যুদণ্ড একমাত্র সুপ্রিম কোর্টের উপর ন্যস্ত হওয়া উচিত।

What a self-made dramatic story you are publishing. The facts of 7th November can be explained by Military officer as they are the eye-witnesses of the incident. Whatever may be the case, no disciplined force can place their wants the way Colonel Taher did. That's just Mutiny/Insubordination and must be dealt by Military Law. Nobody can go as per his plan when the Chain of Command is broken in the Military. Situation changes every moment. Anyway, Colonel Zia could restore the Chain of Command in the Military and that saved not only the Bangladesh Army but also Bangladesh.

This is a biased perspective! Shahaduzzaman is a very talented person and accomplished writer. I have read his ‘ক্রাচের কর্নেল’. Although well written, it is full of revolutionary romanticism and naive idealism. Col Taher was an ultra-revolutionary and a dangerous demagogue. If he was successful in his plans in November 1975 then he not only would have destroyed the military forces of Bangladesh but also the country’s very existence would have been at stake! Ziaur Rahman salvaged the country from a disastrous situation of that time and will be remembered as a hero for bringing back Bangladesh from tremendous chaos and confusion to the path of democracy and development post 7th November 1975. There was no reason for Zia to listen to Taher or the ‘Biplobi Shoinik Shongstha’ (BSS) who were nothing but insignificant paper tigers. Taher tried to use Zia’s popularity to fulfil his political objectives but he underestimated Zia’s maturity and brilliance. Taher or BSS did not have widespread support among the general soldiers nor JSD’s ideology was popular among the common masses at that time. Although his patriotism cannot be questioned, Taher severely breached the Army discipline and paid a heavy price for his foolhardy actions. We hope that our living room based intellectuals will do a bit more balanced and objective analysis instead of biased romanticism.
But it was the shrewd Zia who had begged to Taher to save his life.
Zia later betrayed with Taher.
Once Zia got freed he sent forces for killing Khaled Moshraf.
Since Zia was failed to bring back the chain of command in the army thus Khaled Moshraf proactively acted to remove all killers of Bangabandhu from the Bangabhabon and in that process he forced killer Mustaq to resign and made Cheif Justice Syem as acting president.

নভেম্বরের ৫ এবং ৬ তারিখে গণবাহিনী আরো সক্রিয় এবং সংগঠিত হয়ে উঠতে শুরু করে। কর্নেল তাহেরের নেতৃত্বে একটি অভ্যুত্থানের পরিকল্পনা চলতে থাকে। সাখাওয়াত হোসেন বলছেন, গণবাহিনী যে একটি কিছু করতে যাচ্ছে সেটি স্পষ্ট হয়ে ওঠে ৬ তারিখ বিকেলে, যখন ক্যান্টনম্যান্টের ভেতরে গণবাহিনীর নামে একটি লিফলেট ছড়ানো শুরু হয়। ব্রিগেডিয়ার সাখাওয়াত হোসেন বলছিলেন, লিফলেটের একটি কপি তিনিও দেখেছিলেন। লিফলেটে খালেদ মোশারফ, শাফায়াত জামিল এবং কর্নেল হুদাকে 'ভারতীয় চর' বলে প্রচার করা হয়। এরই মধ্যে বিচারপতি আবু সাদাত মোহাম্মদ সায়েমকে প্রেসিডেন্ট হিসেব শপথ পরানো হয়। কিন্তু প্রশাসন এবং সেনাবাহিনীতে ঠিক কী হচ্ছে সেনিয়ে বেশ কিছু অস্পষ্টতা রয়ে গিয়েছিলো।
"একটা ক্যু-তে যে হোমওয়ার্ক হয় সেটা ছিলো না। যে যার মতো করে চলছিল। এই বিশৃঙ্খল অবস্থার মধ্যে যখন ৬ তারিখ রাতে এই লিফলেট জওয়ানদের মধ্যে ছড়ানো হলো তখনি সবার কাছে স্পষ্ট হয়ে গেলো যে গণবাহিনী নামে একটি ফোর্স ক্যান্টনমেন্টের ভেতর কাজ করছে"। এদিকে গণবাহিনীর বিদ্রোহের মূল পরিকল্পনাটি হয় ৬ তারিখ সন্ধ্যায়। "বিশাল একটি হলরুমের মধ্যে সেনাবাহিনীর প্রায় ৬০-৭০ জন সদস্য ছিলেন। সেখানে গণবাহিনীর নেতৃত্বস্থানীয়দের মধ্যে কর্নেল তাহের, তার পরের অবস্থানেই ছিল হাসানুল হক ইনু এবং আমি নিজেও ছিলাম। সেখানেই প্রত্যেকের কাজ ভাগ করে দেয়া হয়"- বলেন অধ্যাপক আনোয়ার হোসেন।
তবে তিনি বলেন, দলীয়ভাবে জাসদের সিদ্ধান্ত ছিল প্রস্তুতি নিয়ে ৯ই নভেম্বর অভ্যুত্থান হবে। কিন্তু ক্যান্টনমেন্টের পরিস্থিতি আরো উত্তপ্ত হয়ে ওঠায় সেই রাতেই বিদ্রোহের সিদ্ধান্ত নেয়া হয়।
