  • Today we’re in Judge Fleischer’s courtroom for an angry dad moment. The defendant, originally charged with DWI, was ordered (by Judge Fleischer) to attend a special program called Pre-trial Intervention (PTI). She was also ordered to sign up for intensive classes, and begin them by this hearing, according to the judge. She signed up for the class the day before this hearing. She’s also had a bond violation in the past, so Judge Fleischer is fed up with her behavior. Her attorney puts forth a VIGOROUS defense on her behalf, but will it be enough to persuade Judge Fleischer?

      But to me , it sounds like She didn't give a shit to the Judge ..
      He told her to sign UP the minute she left the court room...
      But she didn't !! I think SHE should of went to prison the minute he found out she wasn't doing any class . .she simply refused ..
      That's why he got very ticked off at her !!
      I don't blame the court judge , one bit !!
      If YOU told to do something...YOU DO IT NOW ..THAT minute!!

    She stands there clueless and has no idea how much her attorney is fighting for her. Judge Fleischer looks so mad and frustrated again. So hesitant to give in to her defense attorney. It's not IOP if it's not multiple times a week.

      I currently live in Europe, here it costs about $3500 to obtain a license (driver's ed, driving lessons, state testing etc)! If you are caught with a DWI/DUI there are no scram devices etc., your license is going to be suspended you get points. Max. points in 2 years is 12. If someone uses drugs/alcohol these points are used up quickly and then it's prison!

She needs to spend a substantial amount of time in jail or in a secured rehab. Losing her ability to make her own choices might help her learn to make better ones.

      ​@@saramarie42900She waited 4 weeks to do what she was told. When she finally registered, she picked a class that doesn't even meet the requirements. She also tested positive for alcohol at least once previously. Bonds have many conditions not just drug testing.

    I.O.P Intensive outpatient drug classes. I had to take those when I had a drug charge. They are so easy you can finish them in a month. When i went 15 years ago. It cost 700 to 1000 bucks. I had all my classes done iop sop and community service done in 3 months. Took six drug tests and passed those with no problems. They let me off probation 6 months earlier. People need to understand that u are their property when you are on paper.

      So did I...only reason is because she needs to learn her lesson, she waited a month to sign up for a required class and if she was dirty that would show she cared less about anything than judge would enforce stricter rules and mess with her probation. Defense attorney can't make her do anything, but her even having one bad test for alcohol is ridiculous!! She doesn't understand that she can't drink one sip of alcohol...she doesnt have any urgency to get things done or clear understanding of the severity of this.

    I had probation once for excessive traffic tickets. Not only would I call when I was supposed to but I would pay before the due date. The ladies at the office LOVED me. To this day I call to say hi 😂❤

    Someone trying to fix things would show very different behavior. As someone who's been there I know. If they aren't serious, any leniency just hurts them and wastes your time.
    And look, all 3 of them even were trying to think of what would actually help this person if they actually took initiative. Literally the defendant is the only person working against herself

      ID scanning should be required anywhere alcohol is sold and it should come up that they are not allowed to buy alcohol.
      Maybe an immediate drivers license change and adding it to the back of their license. (Like how some are required to wear eye glasses or hearing aids etc)
      Can’t do anything about illegal drugs or her buying off others for alcohol.

      Sometimes costs come into question because at some point it becomes counterproductive for the person paying for it. If they cannot afford it, they can’t go, they end up in jail, if they truly are making the effort, having a job, working every hour they can, going to the programs, not screwing up, sometimes it’s not possible to make enough money to go. This girl is a joke though, she’s not taking anything seriously. Probably daddy’s money too.

      I've noticed that lawyers seems to get more leeway than pro say defendants do. I actually understand that--they're colleagues that have probably worked together on many cases and thee judge knows the lawyers know how things are done. The discussion at the end seemed very informal, which I think is fine.

    I do not understand how people don’t take felony charges, let alone MISDEMEANOR charges, seriously! These are things that real estate agents can see, future employers, the COURT SYSTEM! Take these things SERIOUSLY! Quit smoking, write the essay, pay the fee, show up to court, AND GET IT OVER WITH! 👏🏽 Trust me, I’ve dealt with the court systems before. Best to get it done and over with

      You know I don’t think it has to do with the sex, I think it’s mostly the situation of the person, did you see the video about the trans boy, the judge knew he was a minor and he wanted to help him, let’s keep in mind RUclips is not showing all his cases, they only show certain ones, like those that think they will get away with it, but don’t and this one, if she would have came back with something in her system he wouldn’t have cared, I think that’s what helped her, unfortunately common sense is not something a lot of people have, but comparing her case with others we have to agree she isn’t close to what others have done

    17:32 I believe Judge F did tell her what she needed to do but she wasn’t listening and didn’t retain it, so she called around to all the IOP programs they gave her and found the easiest one. 🙄 people like this will put in effort if they feel it benefits them.

    This was frustrating to watch. We have too many deaths related to DWI's in the greater Houston area. I hope other judges do not allow second chances when someone does not follow the rules given to them during that initial court proceeding.

    I got 3 years of probation and jumped through EVERY HOOP. It was for a simple possession charge, a crime that doesn't involve another person and is completely nonviolent.
    I jumped through every single hoop. Every. Single. Hoop. Once a week for 2 and a half years.
    Most people after you go for awhile and show youre doing what you should get dropped down, mine went in reverse because my PO changed to a new officer and I was one of her first cases.
    2 and a half years going once a week. The only reason it even changed was because I finally called my lawyer after TWO AND A HALF YEARS of doing everything they asked, but COVID happen then anyway so it didnt even matter.
    I cannot emphasize how hard lengthy probation can be. You're not locked in a cage but youre certainly not free. It's like a gigantic safe hanging above your head for the entire length of probation. Your freedom is dictated by someone else. Your freedom of movement is restricted: I got a pass every time I left the COUNTY, let alone the state.
    My crime didn't involve a vehicle, they suspended my license anyway for 6 months. Did I drive with a suspended license?
    No. I took a bus EVERY WEEK TO one of TWO probation offices they could send me to, because again my old officer only worked out of the one city closest to me, but the new one worked in that one and one much further away.
    I remember taking the bus to that office in the SNOW. Two hours on a bus for a 10 minute meeting after an hour of waiting.
    Every week. For 2.5 years.
    This is an example of someone who just "doesn't get it." They will, EVENTUALLY, but it might take an actual rock bottom.

      Possession isn’t a victimless crime. You were only able to possess because someone sold to you. Someone was only able to sell to you because of multiple chains of people leading back to the supplier. At every stage of the process there are victims and crimes being committed. You were both a victim of the dealer and a criminal at the time of possession.

    Her behaviour may not be intentional. What if she has ADHD and can't get stay focused and organized despite her wish to comply? I'm just saying don't judge her too soon until you know for sure that she could comply and didn't. That said, ADHD doesn't get her a pass, it just means that she needs a shorter leash, and will do better with shorter deadlines. So I agree with how the judge is handling the compliance of this defendant.

    She needs to be sentenced immediately. She has no intention of doing what right. Give her 6 months in jail followed by 3 years supervised probation. Every time she fails to comply to her probation stipulations she gets another 30 days in jail. Stop babysitting this woman.

      @@kendram1893i’m in recovery 17 years (thankfully, i hit my bottom at a young age) and i also work in the field… i have to say, she could very well have substance use disorder, but her test came back negative. She’s been abstaining for the majority of the time. I’m inclined to think she’s an immature brat - and sadly, there’s no IOP for that…

    This is what you want in a defense attorney. I am not excusing this donuts behavior, but the defense attorney is doing everything that she can in her job.
