    Robbing a dead person is as low as you can get. My dad passed away last April and we are watching over his estate like a hawk. My dad worked his butt off for decades to make sure me and my mom would be okay the day he passed away. Thank you, dad. We are doing all right. It’s still extremely difficult to grasp that you are gone. 😢However, you are rid of your horrible illness, nursing homes, and, even though they were much better, hospitals. RIP, dad ❤❤

      There shouldn't be a problem if your parents were married before the death of your dad. If your parents weren't married then your dad should have created a living will before his demise that would name you and your mom as the sole beneficiaries of his estate.
      Anyway, sorry about your dad and I wish you and your mom every happiness.

      Completely agree. Someone who is a notary knows EXACTLY what the rules are and she broke them. Should the state go after her in this case, absolutely. If she willingly broke the law and was easy to anger under simple questioning, IMO she has done this before and possibly for cash under the table.

    whenever a defendants resorts to character defamation to justify criminal action, it means they have no factual defense, so they try their best to make it seem like stealing was the only option. at the end of the day, with all the claims against the father, its the mother who is on trial.

    When my husband passed, I made SURE I understood the law regarding inheritance of property and assets. There was no will. And yes, the buzzards were circling within hours, asking about money in our shared checking account. It was disgusting.

      My parents wrote their house over on my name but secured a right of use in the process, so I cannot evict them (which is fine because they are elderly). They did it so if any of them are gone, the voltures (my brothers) don’t get a cent.

    Disgusting..I can't stand people who prey on the deceased. Its happened in my family too, and it's reprehensible. To stand in court and disparage a deceased person is grimy imo. He's not here to defend himself. She sure doesn't have a problem beneting from his money. Even IF any of it is true, lets say he was the meanest person ever; what does any of it have to do with his surviving children? Theft is theft, and Im happy that she will have to pay it back.

    I like how Judge Boyd cut off the testimony from the witness who signed the affidavit of heirship - basically, she's about to testify to committing fraud and is going to need an attorney representing her 🤦🏼‍♀️

      She definitely knew better than to notorize a document that she wasn't present to witness the signatures. It's also unethical and illegal to notarize documents for family members.

    I couldn't do that. My late husband made sure I would be provided for if he passed before me. His son and I have worked together closely in settling his estate. My half-sister and stepmother screwed my brothers and myself on my dad's estate. But you know what, I'm not the one who will have to answer for it. I'm good on all fronts and when I'm gone I will make sure all my ducks are marching lockstep. I helped my husband with his mom's estate when she passed. People, please take care of your business and don't leave it for whoever is left. It almost never turns out well.

    I don't know all the facts of the case. This is just my personal take on these witnesses and their "testimony".
    Everything her niece (from her side) and daughter said about their marriage, their relationship, conversations between them and even the alleged abuse - it is all here-say and completely one-sided especially since the father/husband -> is dead and unable to tell his side or defend himself. 🤷🏼‍♀️
    They can basically say anything about him without any evidence. The first "witness" is testifying about the defendant financial status but under cross examination- has no clue except what the defendant told her.
    Her daughter is emotional but that doesn't necessarily make everything she says true.
    Too bad families cannot seem to work things out but money does tend to make everything worse.
    Lastly, she is taking a plea and basically admitting to the action alleged. 🤷🏼‍♀️
    She took the proceeds, was supposed to distribute the funds and didn't.
    She declined a trial to refute the charge. Guilty.
    It's simple actually.

      ​@dpofah In a court of law that is ABSOLUTELY heresay and for the reason explained above. The father/husband is not there to cross examine. ANY conversation between two people is NOT admissible in court unless BOTH parties can testify to it.

The legal definition of hearsay is any statement made by a person in court that says another person said something while not being in the courtroom. I don't believe these women but the daughter testifying about alleged abuse that her father put her through is NOT hearsay. It is witness testimony. She can absolutely testify about any abuse she alleges her father put her through since she is sworn in even though her father is now dead.

    Crazy how so many attorneys don't speak clearly and stumble through what they are trying to tell the court...... Seems like they would be a little better prepared. Heck, the first witness spoke more clearly and was more concise than either of the attorneys.

    This type of testimony about a decedent (how controlling or abusive he was) is not allowed in estate litigation because the decedent can't respond. In this case, this is intended to justify the wife's actions, but mostly to make the Judge feel bad for her - wah wah, she had such a hard life. This testimony does nothing to justify the theft and unlawful sale of a house that did not belong to her. To me, this witness testimony was completely useless.

    My dad and uncle were going to leave me their house. My dad passed away first, I moved in to be there for my uncle, he passed away 1 and half 2 years later. he had written a will, but his son moved in right away, my cousin. went through al his stuff and threw the written will away. Then but he slowly took over the house and the property. I went to stay with my kids for the winter so I could make it to work, and my cousin locked me out. and started selling all my stuff. I got a message from a mutual friend asking for my cell phone password because my cousin sold him my old phone. my brother went out there once to see if he could stay, but the cousin said no. The property taxes haven't been paid, and I am not going to help because what he did was wrong. As stupid as it sound, I lifted my hands. Karma will find her way. While I continue to prosper with my children. And with my career.

      Oh put your hands down and learn how to use your brains.
      The Will should have been placed in the hands of a lawyer.
      You can also look into getting a quit claim deed for the home because you can use this as a simple way to transfer or divide a property..
      So use this instead of calling on karma.🙄
      Plus your cousin has just as much right to that home as you do and that includes selling off any property in the home.
      It also includes changing out the locks after you left the premises.
      So do some digging instead of waiting around for divine intervention to come to your rescue.

    When my father died, the money my mom got from insurance and then the monthly checks for me and my sister until we turned 18....my mom squandered every.single.penny. none of it went to paying for school or anything to benefit us other than paying for the roof over our heads and food. The rest went to who ever my mom was with at the time or her manipulative, money hungry sisters (my aunts) and grandma(her mom)

      As harsh as this sounds the Insurance Money went to your Mother, not you or your siblings. Your Father could have left half to your Mother and split remaining to his Children. Also some people think that Life Insurance is something that just POOF automatically happens! It doesnt. It has to be paid for Monthly by the Individual or some people get a Minimum from their place of work for free. I know some Widowed people immediately take the life insurance and pay or pay down their House so they know that they wont be homeless. Did your Mom do this? And were you privy to the Insurance paperwork and know the amount she received? (Not negating your experience just pointing out things some people dont think about)
      If the monthly checks you are referring to the Social Security Payments paid to Survivors its money to be SPENT on taking care of a Roof over your heads and food! Its NOT supposed to be put into an account for one to receive at age 18! If you read how SS Benefits work you will see how the money is to be spent. Also if the SS realizes the money is being put into a separate account they have the Legal right to stop all SS Benefits as your Surviving Parent would be deemed to not need that Benefit Monies.
      SS Benefits:
      Is calculated on the number of Points the Decedent paid into Social Security. This depends in the age and salary from the last 3yrs. (Why working “under the table” is horrific for decedents family)
      The Caregiver and each Child under the age of 18 will receive the Monthly Benefits.
      The Caregiver will receive Benefits til the youngest Child reaches 16.
      The Children will continue to receive Benefits til the Child reaches the age if 18 or Graduates High School, whichever happens first.
      Now as for School, are you referring to College? If so then no, unless a College fund was set aside, separate from the SS Benefits, there is NO Money for College. Thats how LIFE works!
      I will say that I will grant that your Mother may not have Budgeted for herself or her Children, the money she received was to take care of herself and any remaining Children of the Decedent. She may have spent more than she received and used the money for the bare minimum, as Ive seen many Women do who lose their Spouse. I just want you to realize that I am extremely sympathetic to how you lived after your Father passed and if she was or became a more irresponsible Parent, for that Im truly sorry. Both Men and Women become people they werent before they became Widowed. I cant explain it other than to say that the last couple Generations are NOT prepared for Death, especially the Death of a Spouse, or even give it a Thought TIL it happens to them. Then they act like its Rare and Unique, like WHAT my husband/wife Died.. WHY? 🙄 (yeah… zero sympathy for people who act like Death is a non-existent thing).
      Know I sympathize with you and know how hard it is to lose a Parent. I was 3 mos into my 16th Birthday when my Dad passed. And my Husband died in 2016 at the age of 44 leaving me and our 2 boys who were 12 and 7 at his passing. I was more mentally prepared than most as I had experienced much death growing up. I also was a Stay at home Mom so KNEW that I needed to be EXTRA Frugal knowing I still needed to raise my kids AND pay for College. And now Im paying for oldest who is in College and youngest is in 10th Grade. Its not easy and I still am concerned about money, but again luckily Im Frugal AND didnt have to go back to work after my Husband died.
      I also do tell every couple I meet or know to make sure they have Life Insurance on each other and to pay for the maximum you can get if one of them stay home with the kids.

    I think the lady deserved to go to jail, but I think Judge Boyd made the right decision. The money couldn't be repaid (I'm assuming she doesn't have it anymore) if she is in jail. By keeping her out of jail, she can't say "I can't earn money to pay it back." This way she has to return what was rightfully theirs to begin with!

      It means she's on probation for 10 years and if she fails probation her sentence will be 10 years starting the date probation is revoked.

      It means that she will be on probation for 10 years and if she fails to meet her probation conditions, she will serve 10 years starting from the date her probation was revoked

    I got an attorney for my case and she didnt like my brothers attorney she said he was a bully and now I lost out because she refused to fight for me and I already payed her ....Beware who your attorney is and make sure they know what they are doing

    I consider the Honorable Judge Boyd to be quite strict compared to many, many, many other judges I've seen in recordings.
    At the same time, she decided to let this criminal off QUITE, QUITE, QUITE easily!
    I firmly believe any other judge that had received this case would've IGNORED the plea bargain and thrown both the defendant and her notary witness in federal prison!
    I know I more than likely would have after hearing the testimony were I fit to be a judge!
    GRAVE ROBBING IS DISGUSTING!!!!!!!!!!!!!!!!!

    The daughter is testifying under oath the emotional reactions she has...she's being truthful. He's dead and in hell great place for him I never met him ...but know him well !!

    The sound was so bad on this one. Made it even harder to follow. I do believe the daughter about the abuse. CPS will have records. But the abuse is not relevant to the charge. Judge Boyd stuck to the facts. This is why I watch her and Middleton.

    23:26 I want to say that this actually happens a lot that the widows or widowers they don't want to give the money to any children or family members as recommended by somebody's will and they end up spending the money this actually happens a lot and most of the time people get away with it but I'm glad that these kids put her into this and made her see the crappy person she is cuz she stole the money from the kids where the money should have gone

    I believe the daughter, she still didn’t want to bad mouth her violent and controlling father. Those attitudes and behaviors never go away, especially when all we want as children is the approval of our parents. I’m less than impressed with the state, he was so nervous and couldn’t get his words out, how embarrassing that the witness had to correct him on the sale of the house “$111 DOLLARS? Do you mean thousand?, I was like oh God” I’d be in my car pulling my hair like Chris Farley when he interviewed celebrities 😂 *stupid stupid stupid!*

    Death brings out the worst in people when money is involved. We all know this. Don't know why I bothered to comment on it. I guess I just never get over the amazement of the amount of greed in people. And most times it doesn't end up in court so the individuals that are stolen from never get any kind of justice or restitution. And what's even sadder is that a lot of the times it is like actual physical things that have sentimental value that are lost which to me has no true monetary value.

    I will never understand when an attorney will ask a witness if their client is going to obey or follow an agreement with the court ? HOw do they know they are not that person nor can anyone read minds?
    Her witness only heard everything she is saying by the client only go figure and notice how defensive and rude she is toward the STATE. WOMEN!
    The daughter sure can put on a ACT~
    Vindictive women, notice the daughter stated her father changed when SHE TURNED 14 yet we all know young girls are total brats at age 14 talk about deflecting it off her. Women like these turn my stomach

    Is a notary public I will not and never will notarize a quit claim deed. Especially if it's someone I don't know or even if I do know you. I know friends that have that have lost their homes due to fraud😢😢
