    The International Criminal Court has said they are seeking arrest warrants for senior leaders of Hamas and Israel. So far there are requests for warrants for Israeli Prime Minister Benjamin Netanyahu, Israeli Defense Minister Yoav Gallant, Hamas leader Yahya Sinwar, and the leaders of the group’s military and political wings, Mohammed Dief and Ismail Haniyeh. We take a look at what that means and what to expect going forward.

    Preston, could you do a comparison between the civilian to combatant ratio in Gaza vs other similar wars/battles? It seem many these conversations/news articles are predicated one way or the other (ie. either the IDF is criminal, or doing a historically amazing job), but very few commentators, even you, mention this critical ratio as context. Thanks!

      It cannot be done without bias. The only combatant numbers released are Israel’s. Which are backed by nothing. And civilian death numbers are Gaza health ministry, which don’t seem to be accepted by pro-Israel side. They don’t discern between civilian and combatant. Essentially, there is no way to tell barring 3rd party investigations which Israel is blocking.

      Both, Sinwar and Deif are probably still in Gaza. Most tunnels are still in tact, and I'm almost certain there's enough supplies underground to hold them off for at least a year. This will take another year, at least. Unless Israel is forced to stop.

      Egypt is anti Humus but pro Palestine. So it’s highly unlikely that they would shelter Sinwar or other. Already the Humus leadership are in Qatar which is considered a political enemy of Egypt.

    One notable thing that I think you missed is that the ICC HASN'T charged Israeli leaders for the crime of genocide (section 6) which may actually undermine the case going forward in the ICJ. Both Hamas leaders and Israeli leaders are being charged for actions that come under section 7 (crimes against humanity) and section 8 (war crimes).
    The charges against hamas relate to october 7th and the hostages and include the outright charge of extermination (rather than extermination and/or murder against Israel), murder, the taking of hostages, and the treatment of those hostages including those of rape and torture
    The charges against Israel appear to be related overwhelmingly, if not entirely, to the blockade/siege which is evident from the rest of the statement by prosecution following the charges where nothing but the blockade is discussed although the killing of aid workers as well as the killing of civilians by other means are mentioned.
    Extermination is mentioned as a charge against Israel but they don't seem entirely sure the charge would stick as they have stated extermination and/or murder as a crime against humanity in their statement. It would appear that if they can get the more serious charge of wilful killing rather than, or in addition to murder, as a war crime, they would get a charge of extermination in addition to or instead of a charge of murder as a crime against humanity. If the ICC prosecution CANNOT successful make the charge of extermination stick, then the charge and case of genocide against Israel in the ICJ has no legs to stand on as extermination is a lesser charge along the same lines as genocide.

      @@zeondeane2832 Since the ICC operates in accordance with the Rome Statute, the ICC does indeed deal with claims of genocide as seen in the case of Omar al-Bashir. The ICJ genocide charge is being dealt with in accordance with the Genocide Convention rather than the Rome Statute which has an identical definition. The main difference being that, due to the nature of the ICC, a lot more evidence is required before bringing a claim, especially that of genocide, to the ICC than is needed for the ICJ.

      No not really, the ICC can reference that a proceeding has already started for the Crimes of Genocide in the ICJ... the two entities are separate but also acknowledge each other. As a prosecutor you can select which crimes you have enough evidence for and which you have not yet reached the threshold for....

    Some information that may be useful to know where these request for warrant comes from: Khan is a part of the Ahmadiyya Muslim Communit.
    Mr. Khan served as Assistant Secretary-General of the United Nations, serving as the first Special Advisor and Head of the United Nations Investigative Team to help bring Daesh/Islamic State of Iraq and of the Levant to answer for its crimes committed in Iraq between 2018 and 2021.
    As most people i really don't like Netanyahou and i'm no lawyer but willful killing sound kind of funny to my ear when it's a state at war, why aren't sinwar and his pals also accused of willfully causing great suffering and intetional attacks against civilians population when they didn't even try to hide the fact that they orcastrated a genocide

      When a state is at war, it is still bound by international treaties.
      Deliberately blocking food, water, medicine and fuel is a war crime per international law, violates the rules of war, and additionally results in the willful killing of civilians.
      There is nothing funny about that, and it is something Israel has been warned about from the moment they implemented that policy.
      Additionally, following your broken logic, Hamas can argue it has been at war with Israel since forever, and hence killing people was merely a result of being at war, and not a willful attempt to kill civilians.
      You *REALLY* should learn to apply arguments properly and equally to all parties involved if you want to have any chance to come to a honest conclusion.

    saying that the PA joining means that Gaza joined the ICC, while the PA having no actual authority or presence in the gaza strip, which since 2006 is de-facto a separate entity just serves to show how BS this whole "court" is. this is basically getting the benefits without any of the duties, since I don't see anyone going in and actually arresting Hamas leaders. those warrnets against sinuar ar DOA.

      Not to mention the PA starting the civil war in Gaza when Hamas was leading the "democratic" elections that were held there (once and once only) and started kidnapping Hamas members which resulted in thousands of dead and wounded and led to Hamas taking over tyrannical control of the entirety of Gaza. The PA are just as bad as Hamas for their own people, only without the gross religious zealot terrorist part against the Jews. (They have what they call the "long term plan for the destruction of Israel" so, yeah, there's that)

      The upshot is that the Palestinian Authority could be found to be violating the Rome Statute by not executing arrest warrants against Hamas leaders. Realistically, they're way more likely to say that Israel is violating the Rome Statute (to which it is not a signatory) because it is an occupying power and therefore the PA's responsibilities are transferred to it. 🤷

They acted in good faith unlike succesive Israel government which defy UN resolutions against illegal settlement expansion. In this quagmire neither side is right and neither is wrong.

      @@Rb39-ej5hh Heh, it is an unfortunate feature concerning geopolitics with power and the ability to impose one's will on another. I don't advocate for such, but this story reminded me of the famous quote attributed to Iosif Stalin about the Pope. It also reminded me of the famous Melian Dialogue, but the point of such is that oftentimes it is a reality that international laws are unable to be enforced due to the anarchic nature and relative power of nations and political bodies to enforce them. We will see how this ruling or the judgment against Vladimir Putin fare, but I will be watching such with interest to see if they are ever carried out.

    Does "arrest" necessarily mean apprehension and incarceration for the ICC? I'm only familiar with the Canadian legal system for comparison, but someone can be "arrested" and immediately released here in order to initiate proceedings - on a "Promise to Appear" for example.

    Thank you Preston. I find it interesting that these warrants are potentially going to be issued on both sides. It does give some authenticity to the adjudicating board but I really have a hard time believing that even-handed justice is being served by the international criminal court. I would like to see more about the evidence and the legal statutes which comprise these allegations.

    Preston you served in the army what strategy would you do in regards to israeli soldiers dealing with hamas snipers dressed up in civilian clothing shooting and killing israeli soldiers. American army has a policy of leveling the area where snipers are located instead of fighting a sniper with another sniper, so would you recommend israel uses artillery, level the city's and all the buildings then send in soldiers or do you have a better plan?

    Hey preston, when you say “that’s all I got from now” I’m curious if you saw the new horrific video from October 7 that the hostages families have decided to release? of their daughters, female soldiers that most of them are still in captivity. I know it’s not around current events of the war, but in my opinion it’s important to talk about or even a slight mention of these poor girls, they were bound, some of them with their faces all bloody, yelled at, and you hear the horrible terrorist are talking about getting them pregnant, poor girls😞

      In 1948 the UN offered Palestinians a state of their own. They took that offer. Well… most of them did. A few radical tribes refused to be a part of the rest and chose to kill Jews instead. That Palestinian state is called Jordan today.
      Since then, the Arabs in the West Bank Gaza turned down statehood SIX TIMES! Instead claiming that they want Palestine to be ALL of the region, INCLUDING what is Israel. The main group that demands it is Hamas. They don’t just want independence. They want it AND Israel gone.

      2000 - Ehud Barak offered independence for Gaza and 97% of West Bank. In exchange he would give up land in the Negev desert to Gaza.
      2008 - Ehud Olmert offered independence for all of Palestine and a partitioned Jerusalem.
      To Palestinians the entire region is “Dar al-Salam” (Muslim land.)
      There were 6 times that Israel itself offered independence and all six times the Palestinians chose to fight for everything instead. They don’t accept a two-state existence!

    I recommend the ICJ bring charges against Egypt and other Arab states that refused to grant temporary asylum to innocent Gazans trying to flee the conflict. Letting women, children and the elderly escape Gaza and reside temporarily in refugee centers would have greatly reduced the effectiveness of the Hamas "human shield" strategy (a true war crime).

    Well, it's a request from the main ICC's prosecutor to the Court. It might stick or not, we'll see that in the future.
    As for bias...putting the head of a state at the same level than the leaders of a terrorist organization says it all. Hamas' leaders cross borders ilegally and never into countries they can be arrested. As the head of the Israeli state, Netanyahu has to travel legally to these countries. But the point is moot as heads of state are subject to diplomatic immunity when they travel abroad. ICC or no ICC.
    I'm totally against the existence of a supranational court nobody has elected and the rulings of which don't have an appealing process.

    I think people forget that this is less about getting arrested for your crimes. And more about What it says about your country. If the ICC says you are a criminal, that means you are a criminal, no ifs or but. And the only one who will attacking The courts legitimacy Are people who are guilty And do not want accountability.
    I mean, what are you against ? What are you disputing?The charges. That have been investigated for seven months. People saying that this is a war. There are rules of combat in a war. If you break this Rules purposefully. Then you are war criminal, it's simple as that. This is not an opinion. This is not a journalist coming out. Or commentator. This is a court. And if it was anyone else, you would say it was legitimate.
    I'm so sick of seeing people. In the comments, defending on war criminals.

      The problem here is that the arrest warrant for the Israeli side is mostly for apparently stopping aid. But there's been thousands upon thousands of aid trucks going into Gaza, there's been collaborations with other countries to conduct aid drops, there's an agreement with the US to build a temporary pier.
      Even recently when Hamas fired rockets near Keram Shalom and it had to closed, it was open again pretty quick.
      Egypt closed the Rafah crossing and just today there's news they have agreed with Israel to redirect the aid through Keram Shalom.
      There's for sure a distribution problem within Gaza and people suffering especially on the northern parts. But to me these accusations that Israel has a policy of blocking aid is ridiculous.
      Also, not talking specifically about this case but you seem to be under the impression that if a court finds you guilty then you are. Are you seriously saying that wrongful convictions are not a thing?

    Due to timing this is probably unhelpfull, but the criticism of Israel and the US is absolutely ridiculous. Ah yes, and obviously so is the criticism from Hamas. Hamas had the option to not attack, and claiming they, and especially their leadership are the victims is absurd, and utterly dishonest.
    But where the USA and Israel go wrong is that nothing Hamas does legitimizes Israel's deliberate, and well documented attempt to employ access to food as a weapon. That is a violation of international law, and nothing Hamas did will change that. The equivalence argument is utter nonsense and disingenuous.

      Well documented? I saw numbers. There was enough food that entered Gaza. What Hamas does with all this food inside Gaza in not Israel's fault. By the way, it is "well documented" by gazans themselves in their tiltoks that there is and was no shortage of food.

      Additionally, it doesn't matter if food actually ran out, there are very clear statements by the Israeli government about their intentions and actions. That makes it well documented, and is enough to prove criminal intent.
      You are looking for excuses, that is rather disingenuous.

If you want to find someone guilty of murder you need to have a dead body. If you want to find someone guilty of preventing food access you need to prove that there is food scarcity and it was caused by that one who you are accusing.

      No, the intention, and action to block access to food is enough for that, those actions are illegal, even if the actions do not have the intended result.
