Of course we've had identification warnings in Ireland since AG v Casey in 1963 as well as a bespoke Galbraith test when it comes to such evidence. Far be it from the English courts to have even the slightest regard to the jurisprudence of its closest common law neighbour, even when we've considered precisely the same issues and arguments often only a few years previously.
Not having 'even the slightest regard' may be a little harsh as the Turnbull ruling mirrors substantially the recommendations of the Devlin Committee (Lord Devlin being a senior member of the judiciary of Eng & Wales) which did consider the situation in Ireland including the case of Casey (Appendix L to the Report refers).
