What i find confusing is isn't this band benefiting by sharing this name with Cody? Due to Cody's widespread fame a lot of people will be looking up the american nightmare and songs from this band could show up in these searches; its drawing way more eyes than they would without that association. Like i get where they're coming from legally but the lawsuit will probably do more harm than good. Without that association, the likelihood of reaching a large audience decreases significantly. Also would Dustin Rhodes figure into this matter as he used the american nightmare name years prior to both Cody and this band? I don't know if that was ever copyrighted by Dustin or what. Regardless, it looks like a messy situation.

there's an interview on youtube where Roman Reigns says that the WWE Merch designers create so much merch so fast that he doesn't even know about all the merch referencing himself. the channel interviewing him shows him a pair of BOXER BRIEFS that say "Acknowledge Me" and you can tell he is trying to not physically cringe before he says he had no idea they even existed. in the same interview he commented something about the Merch team giving him stuff to wear that he never saw before until they get him the tshirt...there's a 0% chance Cody Rhodes gets to preview or approve the merch that is created. that's not how the company operates at all. anyway, this will probably get settled out of court.

They probably saw it on google, clicked on it, and bought it without really paying attention to the specific site. They probably figured it was a clothing site. The tag on the back of the shirts is a WWE logo. While it’s not clearly displayed on the front of the shirt, it is on the item and every piece of merchandise they sell has the wwe logo or name displayed on it making it clear it is wrestling merchandise. I don’t think he really has a case.

You have to keep paying for it every 10 years, and only one person can own the name at a time. So it’s physically impossible for Dustin to still own the name if the Band bought the rights to the name.
The Band is trying to get their paycheck, but also this at the same time, this is nothing new for WWE. Use something similar/same as a band, person, etc. Promise payment, and fail to due so. What i find confusing is isn't this band benefiting by sharing this name with Cody? Due to Cody's widespread fame a lot of people will be looking up the american nightmare and songs from this band could show up in these searches; its drawing way more eyes than they would without that association. Like i get where they're coming from legally but the lawsuit will probably do more harm than good. Without that association, the likelihood of reaching a large audience decreases significantly. Also would Dustin Rhodes figure into this matter as he used the american nightmare name years prior to both Cody and this band? I don't know if that was ever copyrighted by Dustin or what.

The tag on the back of the shirts is a WWE logo. While it’s not clearly displayed on the front of the shirt, it is on the item and every piece of merchandise they sell has the wwe logo or name displayed on it making it clear it is wrestling merchandise. I don’t think he really has a case.

As for Dustin, that does not matter. He obviously does not hold the trademark anymore. You have to renew it every 10 years. If Dustin still owned the trademark, they would have been no way the band could have bought the name. Only one person can own the trademark at a time.

1. How in the world would it possibly matter that Dustin used to use the name. He clearly does not own the name anymore as the band has owned the rights since 2016. You cant get a trademark someone else currently owns. He had to have lost the rights which makes it irrelevant whether he used the name or not.
